Assignment of Overtime. 3.4.1 The parties acknowledge the following types of overtime and agree to the method of assignment with respect to each type:
A. Holdover Overtime -When manpower falls below minimum xxxxxxx levels, as detailed in Article XXI Section 2, the Chief or his/her designee shall assign overtime in the following manner:
(1) Call available officers signed up in the department overtime book
a. Call available officers currently on duty
b. If none of the above options yields an officer, the junior officer on normal tour of duty will be ordered, (held over) to work. If an officer is held over for any reason, that same officer cannot be held over again for a 24- hour period, commencing on the completion of the holdover shift. During this 24- hour period when an officer cannot be held-over, holdover overtime is to be assigned to the most junior eligible officer on duty, and so on. After 24 hours, officers will again be subject to hold over. No officer shall be required to work in excess of sixteen (16) hours in a twenty-four (24) hour period, unless it is authorized by the Chief or supervisor, and no officer will be allowed to work in excess of twenty-four (24) consecutive hours. For the purposes of this section, “officers” refers to all bargaining unit members.
B. Call Back Overtime refers to those situations where an officer has been discharged from his normal tour of duty and is ordered to report back to duty by an appropriate supervisor or authority. This overtime shall be assigned rank for rank on a rotating seniority basis among all qualified employees who basis.
C. Overtime Caused by Town Details refers to situations where officers are in the same classificationassigned to Town activities, the same organizational unitincluding but not limited to beach patrol, voting polls, school activities, highway safety grants and at the same work location. An employee may decline an overtime assignment without adverse consequence unless it is assigned pursuant to Section 3.4.2 belowtraffic details. Assignment of Overtime. 3.4.1 Overtime A notice of the availability of overtime assignments shall be posted at least 48 hours in advance of the starting time of the assignment. The notice of availability of any such overtime assignments shall apply only to overtime assignments when the authorizing supervisor has been notified of the need for such overtime assignment at least 48 hours in advance of the starting time of the assignment. No Police Unit employee shall be posted in ordered to work a second event within one calendar year unless every sworn person holding the same area as all required employment notices rank has worked an event. 2. In the event of approved leave the individual on the rotating list for assignment for overtime will not be passed up. When they return from the approved leave their assignment will then be made at the next opportunity for being assigned to overtime duty.
C. Separate rosters of employees in each classification within a section shall be maintained by the Department Head or his/her designee, for the purposes of overtime equalization. For the purposes of overtime, employees in the respective Department, Division, or Section will be maintained offered the opportunity, once annually, on April 30th to sign up for overtime. Employees who indicate a willingness to perform such work will be selected according to policies outlined For overtime equalization practices. Whenever an insufficient number of all noticesemployees have volunteered, the Department Head or his/her designee involved has the right to assign employees having the required skills on an inverse seniority basis.
D. Employees who refuse to perform assigned overtime work shall be subject to disciplinary penalty. Upon request of management personnel or a supervisor, employees who have signed up for overtime work shall be required to perform such work; however, upon presentation of an excuse acceptable to management, such employee responses, and may be relieved of overtime assignments for a period of three yearsassignment.

Assignment of Overtime. 3.4.1 1. Eligible employees, as defined by Section A5, interested in volunteering for overtime must sign up for overtime in a manner as defined by the University.
2. Any overtime that is assigned more than 24 hours prior to the overtime event will be filled in accordance with the following:
a. To the extent possible, overtime will be posted a minimum of 20 days in advance of the overtime event and employees who have been assigned to the overtime will be notified 10 days before the overtime event.
b. In circumstances where a minimum of 20 days’ advanced posting of the overtime event is not reasonably possible; the University will endeavor to post overtime events in a timely manner. Employees who have been assigned for overtime will be notified as soon as possible.

b. Overtime will be assigned in order starting with the volunteer with the least number of overtime hours worked and assigned at the time the overtime is being assigned.
4. The department may define the group of qualified employees by their shift for For purposes of assigning overtime so that call back pay is not obligated. 3.4.2 If no employee in the classification, organization unit and work location accepts the overtime assignment, employee overtime hours worked will reset to zero at the start of each schedule selection period as identified in Article 15, Work Schedules.

New employees, recently appointed, or those returning from an absence of more than two months will be added to the overtime hours worked list using the rotating seniority process, average of total hours worked and assigned currently on the District may assign the overtime in reverse rotating seniority orderlist.
3.4.3 The following are allowable exceptions to 6. Assignment of Overtime. 3.4.1 Overtime A notice of the availability of overtime assignments shall be assigned on a rotating seniority basis among all qualified employees who are posted at least 48 hours in advance of the starting time of the assignment. The notice of availability of any such overtime assignments shall apply only to overtime assignments when the authorizing supervisor has been notified of the need for such overtime assignment at least 48 hours in advance of the starting time of the assignment. (b) Nurses who are in temporary full-time assignments shall be considered full- time for the same classificationassignment of overtime.
(c) Extensions of shifts are not additional shifts. In the event that the extension results in overtime, it will be offered to staff working the same organizational unitshift to be extended on the basis of seniority notwithstanding circumstances where continuity of care requirements require otherwise.
(a) Overtime premium is time and one half (1 ½) for the first four hours and double time thereafter in the pay period.

Posting shall be on a form fiscal year unless agreed to by the District Clinical Manager/delegate with any remaining bank to be paid out at the end of the fiscal year if not taken as lieu time; or
ii) Paid out at the appropriate rate; or
iii) Taken in time off at the appropriate amount of time owing; or
iv) Subject to applicable legislation and CSEAthe employee providing required documents the employer will cooperate to have the monies accumulated transferred to a nurse’s RRSP. Assignment of Overtime. 3.4.1 Overtime The assignment of overtime shall be assigned subject to the following provisions.
A. Records of paid overtime hours worked or refused shall be kept by occupation by shift within departments for the purpose of distributing overtime work as equitable as possible by occupation on a rotating seniority basis among each shift within the department. i) Banked to a scheduled project and declines to accept, the employee forfeits his/her turn maximum of sixty (60) hours in the rotation. That employee will not be offered overtime until the list has been completed and his/her name comes up again in order course of seniority.
3.4.5 Notice of scheduled overtime, for situations that are recurring or have advance notice, and which are offered on a rotational basis shall be posted in the same area as all required employment notices and announcements and will remain up until the work has been completed. Posting shall be on a form fiscal year unless agreed to by the District Clinical Manager/delegate with any remaining bank to be paid out at the end of the fiscal year if not taken as lieu time; or
ii) Paid out at the appropriate rate; or
iii) Taken in time off at the appropriate amount of time owing; or
iv) Subject to applicable legislation and CSEAthe employee providing required documents the employer will cooperate to have the monies accumulated transferred to a nurse’s RRSP. Employee responses The nurse is required to have the appropriate documents completed and returned to the overtime posting shall be on a form agreed to Payroll Department no later than March 1st.
(b) If nurses do not indicate any of the above by the District and CSEA. Assignment of Overtime. 3.4.1 Overtime The procedures in this sub-section (sub-section * * * 8) shall not apply to the Water Distribution mandatory overtime list for stand-by/emergency operations. In the event the procedures outlined in this subsection create an operational inefficiency, the parties agree to meet and confer on separate provisions which shall be assigned on incorporated via side letter to this MOU upon mutual agreement.
a. The Personnel Services Department shall maintain a rotating list of work units. Any changes to the list will be provided to the Union in advance of the change.

(2) If it is not possible to staff the * * * overtime assignment from the voluntary overtime list, consistent with the provisions in subsection c(1) above, qualified employees will be required to work overtime and will be assigned in reverse seniority order in rotation, unless * * * management is able to staff the assignment with volunteers from other work units.
(3) Overtime which is the result of a need to finish work, or an assignment which started during the regular work day will, absent extenuating circumstances, be completed by the employee(s) who are doing the work or assignment.
(4) In the event a work unit assigns employees to be on standby duty, * * * overtime will be performed by the employee(s) assigned standby unless the unplanned overtime is the result of a need to finish work pursuant to subsection c(3) above. All other overtime assignments will be assigned consistent with subsections c(1) and c(2) above.
(5) The City reserves the right to determine whether or not an employee is offered possesses the qualifications necessary to perform the scheduled overtime for a scheduled project work.
(6) Employees on the voluntary overtime list who are on unscheduled leave during their regularly assigned work shift prior to * * * the overtime assignment will go to the bottom of the list and declines to accept, the employee forfeits his/her turn in the rotation. That employee will not be offered eligible to work overtime until the list has been completed and his/her name comes up again in order of senioritygoes through an entire rotation.
3.4.5 Notice of (7) Employees on the voluntary overtime list who are on scheduled overtime, for situations that are recurring or have advance notice, and which are offered on a rotational basis shall be posted in the same area as all required employment notices and announcements and will remain up until the leave during their regularly assigned work has been completed. Posting shall be on a form agreed to by the District and CSEA. Employee responses shift prior to the overtime posting shall be on a form agreed to by the District and CSEA. In lieu of posting, an organizational work unit may use electronic communications when all employees in such unit regularly use electronic communication. All such notices whether posted or sent by electronic communication will contain a description of the work to be done, the anticipated length of time to accomplish the work, the date(s) on which the work assignment will be scheduled, and contacted for an overtime assignment consistent with subsection c(1) above.
(8) Employees who are assigned * * * overtime in accordance with this provision who do not report for the date and time of posting. The notice shall be posted within a reasonable time of the District learning of the * * * overtime work. Records will be maintained of all notices, employee responses, and removed from the * * * voluntary overtime assignments list for a period of three years(3) months and may be subject to disciplinary action.

Overtime pay assignments will not be given to temporary employees unless the regular employees that would normally be assigned the overtime are not available or one of the seniority exceptions apply.
3.4.4 All overtime shall be offered to everyone on the applicable overtime list in descending order of seniority until the list is exhausted. Assignment of Overtime. 3.4.1 Overtime (a) Insofar as the requirements and efficiency of operations will permit, overtime work shall be assigned on divided as equitably as possible among regular employees within a rotating seniority basis among all qualified employees Department who are qualified and able to do the work required. For overtime purposes the Departments are: Warehouse Production Production Equipment Maintenance Cooler Service Fleet Building Maintenance Quality Control Subject to Article 13.09, overtime is recognized as being voluntary but if there are insufficient qualified volunteers to do the required work, then the Company reserves the right to require employees within the appropriate Department to work overtime as per 13.14(b). Any employee refusing overtime offered shall have the offered time recorded as overtime on the records of the Company for the purposes of this Article. The Company shall furnish the Union with a copy of the overtime records for each Department once every three (3) months.
(b) Insofar as the requirements and efficiency of operations will permit, overtime will be assigned to immediately available temporary or probationary employee(s) only when regular employees in the same appropriate classification, the same organizational unitor department, have refused to perform such overtime when it arises, and at provided the same temporary or probationary employee(s) are qualified and able to satisfactorily perform the work location. An employee may decline an overtime assignment without adverse consequence unless it is assigned pursuant to Section 3.4.2 below. The department may define the group of qualified employees by their shift for purposes of assigning overtime so that call back pay is not obligatedrequired. In order to determine if an the event that all regular employee(s) have refused overtime, and a temporary or probationary employee is qualified, the department should consider the employee’s work record in the department, including being in an unsatisfactory status on a current evaluation or having a formal discipline action in process.
3.4.2 If no employee in the classification, organization unit and work location accepts the overtime assignment, using the rotating seniority process, the District may assign the overtime in reverse rotating seniority order.
3.4.3 The following are allowable exceptions to the seniority overtime assignment process: When overtime is authorized for completion of a specific assignment, project, or work in progress, the employee who began the assignment, project, or work may be assigned the overtime; When the District determines it is necessary to consider special skills and training of employees to perform particular work; When employees are available unable to perform the work required, then overtime will be assigned to the most junior regular employee(s) immediately available within the Department to perform the overtime when it arises and who is/are qualified and able to satisfactorily perform the work required, on a non-over-time reversed seniority basis, unless a medical appointment has been made which conflicts with the District shall not be required ability of the employee to assign attend the work on an overtime basis. Overtime pay assignments will not be given scheduled appointment and to temporary employees unless the regular employees that would normally be assigned perform the overtime are not available or one as offered. Notice of the seniority exceptions applymedical appointment shall be supplied to the Company at the first opportunity.

Assignment of Overtime. 3.4.1 Overtime N.1 It is understood that overtime is on a voluntary basis only. All efforts will be deployed in order to avoid overtime. In the event that overtime is required it shall be assigned dealt with as follows:
(a) Overtime shifts are considered additional shifts and will be offered in accordance to the following:
i) Overtime Shifts with more than 24 hours’ notice – Regular part-time nurses including regular part-time nurses who are job sharing equitably by seniority and who have declared their availability to work overtime shifts. If none are available then offer to available casual nurses, and then to available full-time nurses, who have submitted their availability, equitably by seniority.
ii) Overtime Shifts with less than 24 hours’ notice – Regular part- time nurses including regular part-time nurses who are job sharing by seniority and who have declared their availability to work overtime shifts. If none are available then offer to available casual nurses, and then to available full-time nurses who have submitted their availability. RNs already scheduled for a shift, on a rotating seniority basis among all qualified employees vacation, stats, LOA, union leave, etc., on the day in question need not be considered available for overtime shifts in compliance with the above 2 paragraphs.
(b) Nurses who are in temporary full-time assignments shall be considered full-time for the same classification, the same organizational unit, and at the same work location. An employee may decline an overtime assignment without adverse consequence unless it is assigned pursuant to Section 3.4.2 below. The department may define the group of qualified employees by their shift for purposes overtime.
(c) Extensions of assigning overtime so that call back pay is shifts are not obligatedadditional shifts. In order to determine if an employee is qualifiedthe event that the extension results in overtime, the department should consider the employee’s work record in the department, including being in an unsatisfactory status on a current evaluation or having a formal discipline action in process.
3.4.2 If no employee in the classification, organization unit and work location accepts the overtime assignment, using the rotating seniority process, the District may assign the overtime in reverse rotating seniority order.

3.4.4 All overtime shall be offered to everyone staff working the shift to be extended on the applicable overtime list in descending order basis of seniority until notwithstanding circumstances where continuity of care requirements require otherwise.
(a) Overtime premium is time and one half (1 ½) for the list is exhaustedfirst four hours and double time thereafter in the pay period.
(b) For the purpose of qualifying for the double time rate, actual hours worked shall be considered in the event of a call back of less than four (4) consecutive hours.
(a) Lieu time off for overtime, or hours accrued in learning opportunities at their regular straight-time hourly rate of pay as per Article 9.07, shall be scheduled at a mutually agreeable time. Once Banked time may be, at the last name on the list is reached the process will resume from the top discretion of the list. If an employee is offered overtime for nurse:
i) Banked to a scheduled project maximum of ninety (90) hours in the course of a fiscal year with any remaining bank to be paid out at the end of the fiscal year if not taken as lieu time; or
ii) Paid out at the appropriate rate; or
iii) Taken in time off at the appropriate amount of time owing; or
iv) Subject to applicable legislation and declines to accept, the employee forfeits his/her turn in providing required documents the rotationemployer will cooperate to have the monies accumulated transferred to a nurse’s RRSP. That employee will not be offered overtime until The nurse is required to have the list has been appropriate documents completed and his/her name comes up again in order of seniorityreturned to the Payroll Department no later than March 1st.
3.4.5 Notice (b) If nurses do not indicate any of scheduled overtime, for situations that are recurring or have advance notice, and which are offered on a rotational basis shall be posted in the same area as all required employment notices and announcements and will remain up until the work has been completed. Posting shall be on a form agreed to above by the District and CSEA. Employee responses end of the fiscal year this overtime will be paid out to the overtime posting shall be on a form agreed to by the District and CSEA.
