Automatic Vehicle Location System Use Policy. The “Automatic Vehicle 28 A. AVL data will not constitute the sole documentation used to determine discipline 1 imposed on an employee. 2 B. Any real time viewing of data is permissible only for operational reasons and will 3 not be used for surveillance of employees, whether to monitor performance or to justify 4 implementation of disciplinary actions. Furthermore, should the County engage in a process whereby 5 AVL data is utilized beyond the scope of traditional operational monitoring, i.e., to track a specific 6 route, vehicle and/or employee, then all relevant employees shall be so notified in advance. 7 C. The County will not access such data for the purpose of disciplinary action unless 8 there is a good faith reason to suspect that an employee has committed an offense that could result in 9 discipline (i.e. no fishing expeditions). The County agrees not to request or view AVL data, absent 10 any other evidence, for the purpose of monitoring an employee who may have committed a violation 11 of some rule or policy that could result in disciplinary action. 12 D. If the County is aware of AVL data that may pertain to an investigation, the 13 employee who is subject to the investigation and/or the Union will have the right to view the AVL 14 data before an investigatory interview is conducted by the employee’s department/division. If the 15 County refuses to show the employee and the Union the AVL data upon request before conducting an 16 investigatory interview, then the AVL data shall not be used as evidence in any manner related to 17 discipline. 18 E. The County agrees to comply with requests from the employee and/or the Union 19 for access to AVL data, where discipline or the potential to issue discipline exists. 20 F. All Public Disclosure Requests related to AVL data will be forwarded to public 21 disclosure officials of the department/division responsible for the particular vehicle, or that employs 22 the Union represented employee, for response pursuant to the department’s policies and procedures.

  • Acceptable Use Policy In connection with Supplier’s use of the Headset Solution, Supplier agrees that it will not: (a) Make Available any Supplier Data that, in Headset’s sole discretion, (i) is unlawful, tortious, defamatory, vulgar, obscene, libelous, or racially, ethnically or otherwise objectionable; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (iv) is violent or threatening, or promotes violence or actions that are threatening to any other person; or (v) promotes illegal or harmful activities; (b) harm minors in any way; (c) impersonate any person or entity, including, but not limited to, Headset personnel, or falsely state or otherwise misrepresent your affiliation with a person or entity; (d) Make Available any Supplier Data that you do not have a right to Make Available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements); (e) Make Available any Supplier Data that infringes the rights of any person or entity, including without limitation, any patent, trademark, trade secret, copyright, privacy, publicity or other proprietary or contractual rights; (f) intentionally or unintentionally violate any applicable local, state, national or international law or regulation, or any order of a court; (g) harass any person; or (h) advocate, encourage or assist any third party in doing any of the foregoing activities in this section.

  • Computer Equipment Recycling Program If this Contract is for the purchase or lease of computer equipment, then Contractor certifies that it is in compliance with Subchapter Y, Chapter 361 of the Texas Health and Safety Code related to the Computer Equipment Recycling Program and the Texas Commission on Environmental Quality rules in 30 TAC Chapter 328.
