BROKER DUTIES a) Broker shall provide all usual and customary services of an insurance broker and agrees to follow and be governed by the conditions of this Agreement and by CCHP’s marketing and underwriting policies and guidelines, rules or codes of conduct, and other policies and guidelines as communicated to Broker from time to time (the “Policies”). CCHP may update the Policies from time to time in its sole discretion, and Broker must comply with the updated Policies within 30 days after receiving notice of such update. b) Broker shall at all times be an independent contractor and nothing contained in this Agreement shall be construed to create an employer/employee relationship between CCHP and Broker. Broker shall be responsible for all taxes on compensation earned under this Agreement. c) Broker shall comply with the quoting and binding guidelines established by CCHP. d) Broker shall at all times comply with CCHP’s privacy and confidentiality policies, as may be amended from time to time, concerning financial, medical and other personal information. Broker agrees to execute any ancillary agreements CCHP deems legally necessary to ensure compliance with its privacy and confidentiality provisions. Without limiting any such ancillary agreement, Broker agrees that, except as and to the extent required by Law, the Broker will not disclose or use any Confidential Information to any other

BROKER DUTIES. Broker shall perform the following duties pursuant to this Agreement: a. Furnish contact information to FACo from time to time on persons or entities (each a “Borrower”) interested in obtaining aLoan. b. Broker agrees to provide FACo with direct access to Borrower for the purpose of obtaining necessary documentation and verification of information necessary to underwrite and close the Loan, including but not limited to, an application. c. Broker shall provide the Borrower with all applicable disclosures and notices as may be required by law, which disclosures shall be substantially in the form as promulgated by the National Association of Mortgage Brokers. The timely delivery of all necessary and appropriate disclosures shall be the sole responsibility of theBroker. d. Broker agrees to provide FACo with any and all documents in its possession required under the FACo underwriting guidelines, as well as additional documents as may reasonably be requested by FACo in its sole and exclusivediscretion. e. Broker shall respond in a timely manner to all requests from FACo and to assist FACo in obtaining necessary information from Borrower or Borrower’s representative in order to facilitate the underwriting and closing of the Loan. f. All applications submitted by Broker to FACo will be true and complete and will reflect all information required by FACo. g. Broker agrees to provide to FACo copies of all material information in its possession regarding the borrower, sponsor, property portfolio and Loan and shall promptly forward to FACo any and all additional information regarding such borrower, sponsor, property portfolio and Loan it may receive or obtain. h. Broker agrees to supervise, monitor and direct all activities performed by its direct agents and employees in accordance with applicable law, rule and regulation and the terms of this Agreement and shall indemnify FACo for any breaches thereof. All such agents and employees shall be identified by Broker to FACo prior to FACo engaging in services with Broker.

Whether or not a property is listed in the MLS, Xxxxxx will remain responsible for providing the minimum services required by law to the Owner.

BROKER DUTIES. Broker hereby agrees that it will: (a) verify proper wording on all insurance policies written to be acknowledged by the state; (b) submit notification and necessary forms in a timely manner to Filing Agent within thirty days (30 days) after the binding of a policy. (c) collect tax money and remit to Filing Agent; and (d) be responsible for all fines and penalties issued by State regulatory authorities for any late filings.
BROKER DUTIES. In consideration of the terms of this agreement, Xxxxxx will assume the following responsibilities: X. Xxxxxx shall protect and promote the interests of Owner and shall provide Owner with services consistent with the standards of practice and competence that are reasonable expected of licensees engaged in the business of real estate brokerage. Xxxxxx shall use reasonable efforts and act diligently to seek tenants for Premises at the price and terms stated herein or otherwise acceptable to Owner, to negotiate on behalf of Owner, to establish strategies for accomplishing Owner’s objectives, to assist in satisfying Owner’s contractual obligations and to facilitate the consummation of the lease of Premises. X. Xxxxxx shall market Premises, at Broker’s discretion, including without limitation, description, interior and exterior photographs in appropriate advertising media, such as publications, mailings, brochures, and internet sites; provided, however, Broker shall not be obligated to continue to market Premises after Owner has accepted an application. X. Xxxxxx shall present all written applications or counteroffers to and from Owner, in a timely manner, even if Premises is already subject to an approved application, unless otherwise instructed by Owner in writing. Owner acknowledges that the Broker cannot and will not provide to the Owner copies of the application, credit report or any other attached documentation to the application per Broker responsibilities as described in 8.A. E. Broker shall account, in a timely manner, for all money and property received in trust by Xxxxxx, in which Owner has or may have an interest. F. Owner authorizes Broker to conduct pre-marketing activities and market the premises including and not limited to installing “For Rent” signs on Premises as permitted. Owner is responsible for clearly marking the location of underground utilities, equipment or other items that may be damaged by the placement of the sign. BROKER DUTIES. Mortgage Broker will, at Mortgage Broker's sole cost and expense, prepare, process and submit Loan Application Packages to Iron Oak for funding consideration, and facilitate the closing of Loan Application Packages approved for funding by Iron Oak. Mortgage Broker's services and facilities shall include, but are not limited to those services and facilities required by the Iron Oak Requirements, as amended from time to time by Iron Oak, in its sole discretion. The specified loan origination services and facilities performed by Mortgage Broker pursuant to this Section 7.1 shall be referred to in this Agreement as the “Loan Services.” Mortgage Broker’s Loan Services shall include, but not be limited to, the following: 7.1.1 Taking information from the Consumer and assisting the Consumer in the completion of a FNMA 1003 credit application; 7.1.2 Performing a preliminary analysis of the Consumer’s income and debt and pre- qualifying the Consumer to determine the Consumer’s maximum loan amount; 7.1.3 Educating the Consumer in the home buying and financing process, advising the Consumer about the different types of mortgage loan products available, and demonstrating how closing costs and monthly payments could vary under each product; 7.1.4 Obtaining a Certification and Authorization from Consumer; 7.1.5 Collecting financial information (tax returns, bank statements) and other related documents necessary to complete the Loan Application Package; 7.1.6 Initiating/ordering verification(s) of employment (VOE) and verification(s) of deposit (VOD), 7.1.7 Initiating/ordering requests for mortgage and other loan verifications; 7.1.8 Initiating/ordering preliminary report of title, 7.1.9 Initiating/ordering appraisals, and any other reports and/or inspections required; 7.1.10 Initiating/ordering a flood zone determination; 7.1.11 Within three business days of receipt of a complete Loan Application, prepare and deliver to Consumer the Mortgage Loan Disclosure Statement, the Loan Estimate, ECOA Appraisal Report Disclosure, the List of HUD-Approved Homeowners Counseling Organizations, and all other disclosures as required by State and federal laws and regulations; 7.1.12 Maintain contact with all parties, advise of status, and obtain and deliver necessary documents and/or information to Iron Oak, as required; 7.1.13 Review and assess information and documentation provided by Consumer to ensure the Loan Application Package complies with State and federal law and Iron Oak Req...
