Building Siting. 3.4.1 The development on Lot 1 shall comply with the follow:
(a) the gross floor area of the existing shopping centre may be increased by a maximum of ten (10) percent;
(b) the existing shopping centre, including any additions, shall be a minimum of:
(i) 6.1 metres (20 feet) from the front lot line;
(ii) 6.1 metres (20 feet) from the flank lot line;
(iii) 9.1 metres (30 feet) from the rear lot line;
Building Siting. 3.7.1 Single Unit Dwellings shall comply to the following:
(a) Minimum separation distance between dwellings 6.1 metres (20 feet)
(b) Minimum setback from any public street 6.1 metres (20 feet)
(c) Minimum setback from any Common Open Space 2.4 metres (8 feet)
(d) Maximum height 10.7 metres (35 feet)
3.7.2 Senior Citizen Housing in the form of Townhouse Dwellings shall comply to the following:
(a) Minimum separation distance between townhouse blocks 6.1 metres (20 feet)
(b) Minimum setback from any public street 6.1 metres (20 feet)
(c) Minimum setback from any Common Open Space 2.4 metres (8 feet)
(d) Minimum setback from any single unit dwelling 6.1 metres (20 feet)
(e) Maximum height 1 storey plus walkout basement and
9.1 metres (30 feet)
3.7.3 Senior Citizen Housing in the form of Multiple Unit Dwellings shall comply to the following:
(a) Minimum setback from any private shared driveway 6.1 metres (20 feet)
(b) Minimum setback from any Common Open Space 6.1 metres (20 feet)
(c) Maximum height 4 habitable storeys and 20 metres (65.6 feet)
(d) For the purpose of Section 3.7.3 (c), habitable storey means a storey of a multiple unit dwelling that contains a dwelling unit, or which contains overnight accommodations.
(e) Maximum number of buildings 3
Building Siting. 3.4.1 The building’s siting, bulk, and scale shall comply to the following:
(a) lot coverage shall not exceed 15%;
(b) the building shall be a minimum of 7 metres from the front and flanking lot lines;
(c) all portions of the building above grade shall be a minimum of 4.5 metres from the side and rear lot lines; and
(d) the maximum height of the building shall not exceed 10.6 metres;
Building Siting. 3.4.1 Both buildings’ siting, massing, and scale shall generally comply with Schedules B-G. For greater clarity:
(a) the total lot coverage of the two buildings shall not exceed 20%;
(b) Building A shall be a minimum of 23 metres from the rear property line, not including the entrance canopy;
(c) Building B shall be a minimum of 36 metres from the rear property line, not including the entrance canopy;
(d) the maximum height of each building shall not exceed 13.4 metres from the established grade, excluding rooftop mechanical equipment.
Building Siting. 3.4.1 The building’s siting, bulk and scale shall comply with the following:
(a) lot coverage shall not exceed 80% excluding underground parking;
(b) the building shall be setback a minimum at grade of 3 feet 6 inches (1.07 metres) from the Xxxxx Street lot line and 2 feet 6 inches (0.76 metres) from the Gladstone Street lot line;
(c) the maximum building height (not including mechanical penthouse) shall not exceed 85 feet (25.91 metres); and
(d) the Development Officer may permit a 5 % increase to the provisions identified in Section 3.4.1(a) to
Building Siting. 3.4.1 The building’s siting, bulk and scale shall generally conform to Schedule B and the requirements of the R-2 zone, with the exception of the following:
(a) The additions shall be located no closer to the southeastern side lot line than the existing building.
Building Siting. 3.4.1 The building’s siting, height, exterior design, materials and massing shall be in general conformance with Schedules B through F, and subject to Section 3.4 of this Agreement.
3.4.2 The building’s siting, bulk, and scale shall comply with the following:
(a) The building shall be setback a minimum of 3 metres from the Waverley Road Streetline to allow for future road expansion;
(b) Minimum side, rear, and flank yards shall be as shown on Schedules B through F;
(c) The maximum height of the building shall be as shown on the Schedules inclusive of the penthouse level; and
(d) Stepbacks and the size and location of the penthouse level shall be as shown on Schedules B through F.
Building Siting. 3.4.1 The siting of the Single Unit Dwelling and Accessory Uses shall be in conformance with the Holding Zone (H Zone), as amended from time to time with the exception of the following:
a) The minimum required lot frontage shall be reduced to zero metres.
b) Section 5 of the Halifax Mainland Land Use By-law shall be waived.
c) The Single Unit Dwelling shall be a minimum of 2.44 metres (8 feet) from the lot line facing Bellarosa Way. A maximum of 33% of the yard between the main building and the lot line facing Bellarosa Way shall be used for vehicular access, manoeuvring, and parking.
d) A minimum of 67% of the yard between the main building and lot line facing Bellarosa Way shall be landscaped.
Building Siting. 3.4.1 The siting of the dwellings shall comply with the provisions of the HCR (Xxxxxxx Cove Residential) zone contained within the applicable Land Use By-law, as amended from time to time. The following zone requirements shall be permitted by this Agreement and apply to the Lands identified on Schedule B:
(a) The minimum lot frontage shall be 18.39 metres (60 feet);
(b) The minimum lot area shall be 557.42 square metres (6000 square feet); and
(c) No development shall be permitted within the non-disturbance areas as shown on Schedule B.
3.4.2 The existing dwellings at 000 Xxxxxxx Xxxx Road and 874/000 Xxxxxxx Xxxx Road shall continue to comply with the provisions of the HCR (Xxxxxxx Cove Residential) zone contained within the applicable Land Use By-Law.
Building Siting. 3.5.1 In addition to the meeting the requirements of the RMU zone, the building’s siting, bulk and scale shall comply to the following:
(a) the building shall be located on the Lands as generally shown on Schedule B;
(b) the massing of the building shall be as generally shown on Schedule D;
(c) Height shall be calculated as per the Land Use By-law for Bedford and exemptions are permitted as per Part 5, Subsection 25.
