Certified. It is intended that as training, upgrading and apprenticeship program develops and becomes implemented by the Joint Apprenticeship & Training Fund Committee that the possession of recognized Certificates of Qualification or Inter-Provincial Red Seal designation will become the norm, in order to receive the rate of pay as outlined in Craft Schedule “A”. To this end, the following Wage & Holiday Pay designation will apply to those employees who are not in possession of a recognized certificate or who are not registered apprentices. - 10% less than full rate Exceptions to the foregoing schedule may be made upon approval of the Trustees of the Training Fund in cases where an individual was prevented by circumstances beyond their own control, the opportunity to obtain necessary certification (present members only). All new members of the Local will receive the applicable rate in accordance with this Article until such time as they are in possession of the necessary certification. Employees in possession of the necessary certification will receive and enjoy preference of employment over a non-certified employee including bumping privileges. Any employee affected by this clause may appeal to the Trustees of the Training Fund for reconsideration. Probationary Worker: Employers may, at the discretion of the union, hire probationary workers.
Certified. With respect to the financial statements of any Person, such statements as audited by a firm of independent auditors, whose report expresses the opinion, without qualification, that such financial statements present fairly the financial position of such Person.
Certified. Certified employees whose contracts have been suspended shall be recalled within his/her certification/license, on the following basis:

Certified. Certified, as used in this Article, means a tenured teacher or specialist who is certified or who is licensed by the State Office of Public Instruction for a position established by the District. In order to protect the integrity of the total educational program, teachers fulfilling unique or specialized services for the District may be retained without regard to the provisions of this Article. A unique and special skill area would be defined as an area where no other teacher, more senior, is qualified. Example: A special education teacher with signing skill (sign language).

Republic agrees to cause the Conveyed Entities and their respective Subsidiaries to continue to provide data, public relations, human resources and marketing services to Certified Tours, Inc., Dancing Bear Group, Inc. and New River Technologies, Inc. on the same terms and conditions contained in the agreements in effect as of the date hereof between such Persons and one or more of the Conveyed Entities and the Subsidiaries thereof. Notwithstanding anything to the contrary contained in any agreement between any one or more of the Conveyed Entities, Certified Tours, Inc., Dancing Bear Group, Inc. and New River Technologies, Inc. (or any affiliate of Certified Tours, Inc., Dancing Bear Group, Inc. or New River Technologies, Inc.), any party thereto shall have the right to terminate such agreement at any time without cost or penalty; provided however, that, the parties agree to cooperate with one another and to provide reasonable assistance to one another for a reasonable period of time, not to exceed in the case of data processing services two (2) years, and in the case of any services other than data processing services one (1) year, in either case, following receipt of a notice of termination, to enable each party to arrange for satisfactory replacement of such services.
