Compensatory Time Employees may accumulate compensatory time off in lieu of overtime. An employee who wishes to request compensatory time in lieu of overtime pay shall designate this request in writing to the Employer prior to the end of the pay period in which the overtime is worked. Employees may split overtime pay between compensatory time and paid overtime. The employee may designate how many hours of overtime worked will be compensatory time and how many hours will be paid overtime. Compensatory time shall accumulate at the rate of one and one-half (1-1/2) hours per hour of overtime worked. Employees may bank up to forty (40) hours of compensatory time, after which hours of overtime work will be paid as overtime until such time as the employee’s compensatory time bank falls below forty (40) hours. During any time period, the Employer may deny the accumulation of compensatory time for all employees and require employees to take pay for overtime worked. Employees may earn a maximum of 80 hours in a calendar year. An employee wishing to use compensatory time shall request such time a minimum of three (3) workdays in advance. The three (3) workdays notice maybe waived by the supervisor. The use of compensatory time may be denied due to work scheduled and insufficient staffing, but otherwise shall not be unreasonable denied. Employees may cash in accumulated compensatory time once per calendar year in December. This request must be made by December 1st. Should an employee cash out compensatory time the payment shall be at the rate at the time the compensatory time is converted.

Compensatory time off must be taken at a time agreeable to the Department and the Bargaining Unit member. Approval for compensatory time off shall not be unreasonably withheld. Compensatory time off should be requested as far in advance as possible but no later than forty eight (48) hours in advance. When Bargaining Unit members request compensatory time off at least 45 calendar days in advance, the employer will, within five (5) working days of the request being made, notify the member whether or not his/her request has been approved. Approval for compensatory time shall not be unreasonably withheld. As soon as the employer notifies the member that his/her request has been approved, and if the employer determines that the shift will be filled, the employer will post the overtime assignment to cover the member’s request. If there are no volunteers to cover this need for overtime, and if the employer determines that the shift will be filled, a mandate to cover the shift will occur no less than seven (7) calendar days in advance of the beginning of the shift that needs to be covered. The employee being mandated will have the lowest number of overtime hours worked and will be notified by a supervisor. Unpaid meal periods for employees working more than five (5) consecutive hours, if entitled, will be a minimum of thirty (30) minutes and will be scheduled as close to the middle of the work shift as possible, taking into account the Employer’s work requirements and the employee’s wishes. Employees working three (3) or more hours longer than a normal workday will be allowed an additional thirty (30) minute unpaid meal period. When an employee’s unpaid meal period is interrupted by work duties, the employee will be allowed to resume their unpaid meal period following the interruption, if possible, to complete the unpaid meal period. In the event an employee is unable to complete the unpaid meal period due to operational necessity, the employee will be entitled to compensation, which will be computed based on the actual number of minutes worked within the unpaid meal period. Meal periods may not be used for late arrival or early departure from work and meal and rest periods will not be combined.
