Compensatory Time in Lieu of Overtime Pay. Notwithstanding the foregoing, an employee and his/her supervisor may mutually agree that the employee may accrue compensatory time in lieu of overtime pay. An employee may not accrue compensatory time in excess of forty (40) hours. Compensatory time shall accrue at the rate of one and a half (1.5) hours for every hour of overtime worked. Accrued compensatory time shall be used within ninety (90) days after it is accrued. Employees shall receive pay for any compensatory time not used within the ninety (90) day period. The employee and the supervisor shall mutually agree on when the compensatory time shall be used. All accrued compensatory time in lieu of overtime pay shall be recorded on the overtime lists.

Such compensatory time shall be granted at the rate of one and one-half (11/2) hours for each one (1) hour worked. The compensatory time off option will be exercised by the employee filling out and giving to his supervisor the appropriate form noting his desire. Unless the employee filled out this form, he shall be paid overtime at the applicable rate. No more than 240 hours may be accumulated as compensatory time in a calendar year. All unused compensatory time will be cashed out the last pay period of November of each year. The City has final approval over the scheduling of compensatory time.

USMEPCOM will consider employee requests for compensatory time off in lieu of overtime pay.

Compensatory Time in Lieu of Overtime Pay. Upon agreement of the employer and the employee, the employee may receive compensatory time in lieu of overtime. Compensatory time records will be kept as a part of the usual employee time records. Employees can use their compensatory time on a mutually agreed upon schedule between employee and employer. In case of conflicting requests to use compensatory time, the management of printing services will decide which and how many requests can be accommodated at any time.
Compensatory Time in Lieu of Overtime Pay a. For FLSA non-exempt employees, the Agency shall provide overtime pay for all overtime work performed. After considering mission requirements, the Agency may grant compensatory time off for overtime work performed; however, non- exempt employees shall not be required to accept compensatory time off in lieu of payment for any overtime work performed. The Agency will consider employee initiated requests, in writing, for compensatory time off in lieu of overtime pay. b. Compensatory time off earned must be used by the end of the 26th pay period after such time was earned. c. Upon expiration of twenty-six (26) pay periods or upon separation of the employee from the Agency, the Agency will pay FLSA non-exempt employees for any unused compensatory time off earned in lieu of overtime pay to the employee’s credit, at the overtime rate in effect when the compensatory time off was earned. d. FLSA exempt employeesearned compensatory time off will be forfeited if not used prior to expiration of twenty-six (26) pay periods. However, if an employee is prevented from using compensatory time off due to an exigency of the Agency’s business, the unused compensatory time off will be paid out at the overtime rate in effect when earned. e. For FLSA exempt employees, whose rate of pay does not exceed the rate for GS-10, Step 10, may request, in writing, to receive compensatory time off in lieu of overtime pay for irregular or occasional overtime. Such written requests will normally be granted, subject to mission requirements. If the employee does not make such a written request, or if the Agency does not approve that request, the employee is entitled to compensation in accordance with the overtime requirements.
