Compliance with State Water Board Policy. Contractor agrees that, to the extent applicable, it will comply with the State Water Board's "Policy for Implementing the Drinking Water State Revolving Fund” and all other SRF requirements set forth in the Contract Documents. Segregated Facilities (41 CFR 60-1.8) The contractor must ensure that facilities provided for employees are provided in such a manner that segregation on the basis of race, color, religion, sex, sexual orientation, gender identity, or national origin cannot result. The contractor may neither require such segregated use by written or oral policies nor tolerate such use by employee custom. The contractor's obligation extends further to ensuring that its employees are not assigned to perform their services at any location, under the contractor's control, where the facilities are segregated. This obligation extends to all contracts containing the equal opportunity clause regardless of the amount of the contract. The term “facilities,” as used in this section, means waiting rooms, work areas, restaurants and other eating areas, time clocks, restrooms, wash rooms, locker rooms, and other storage or dressing areas, parking lots, drinking fountains, recreation or entertainment areas, transportation, and housing provided for employees; Provided, That separate or single-user restrooms and necessary dressing or sleeping areas shall be provided to assure privacy between the sexes. Trafficking The Contractor, its employees, contractors and subcontractors and their employees may not engage in severe forms of trafficking in persons, procure a commercial sex act during the term of this agreement, or use forced labor in the performance of this agreement. The Contractor must include this provision in its contracts and subcontracts under this agreement. the Contractor must inform the state water board immediately of any information regarding a violation of the foregoing. The Contractor understands that failure to comply with this provision may subject the state water board to loss of federal funds. The Contractor agrees to compensate the state water board for any such funds lost due to its failure to comply with this condition, or the failure of its contractors or subcontractors to comply with this condition.
