Construction by Licensee. (i) Licensee shall perform at Licensee’s sole cost and expense all construction and demolition work required to complete the License Area in accordance with the Licensee’s plans and specifications as approved by Licensor and the Shopping Center’s Licensee construction requirements. Licensee is responsible for all removals, modifications, and upgrades to any existing construction or equipment to accommodate Licensee’s work and occupancy of the License Area. No construction shall be commenced by Licensee prior to Licensee’s compliance with the requirements of this Exhibit and Licensor’s written authorization and consent to the commencement of work in the License Area. All construction work shall comply with applicable building, fire, health and underwriter’s codes and shall be performed in a workmanlike manner. If Licensee elects or the Licensor does not permit the reuse of existing improvements and equipment, the Licensee shall remove such improvements and repair the remaining construction to its original condition, or as may be required by the Licensor.
Construction by Licensee. All work performed by or on behalf of Licensee pursuant to an Attachment License shall be done in a good and workmanlike manner. Licensee shall also comply with the provisions of Exhibit B, which SMEU may change upon sixty (60) days written notice to Licensee. Licensee’s acceptance of an Attachment License constitutes Licensee’s agreement to be bound by its terms and conditions. All Attachments, Contacts, Make-Ready work, and other work performed or maintained by Licensee on a Pole shall strictly comply with the Electrical Code, the Design Documents, and other laws and standards as provided by Article 5. Any deviation shall constitute a material default under this Agreement and shall afford SMEU all lawful remedies it may have available to it, including without limitation the right to suspend Licensee’s Make-Ready and installation operations, deem the violation an Unauthorized Attachment, and to seek specific performance of this Agreement in accordance with the Design Documents.
