Contract Violations. In the event of any of the provisions of this Contract are violated by the Contractor or by any of Contractor’s subcontractors, the Owner may serve written notice upon the Contractor and the Surety of its intention to terminate such Contract (the “Notice to Terminate”). The Contract shall terminate within five (5) days of the date Contractor receives the Notice to Terminate, unless the violation ceases and Contractor makes arrangements for correction satisfactory to the Owner. In the event of any such termination, the Owner shall immediately serve notice of the termination upon the Surety by registered mail, return receipt requested. The Surety shall have the right to take over and perform the Contract. If the Surety does not commence performance within ten (10) days from the date of receipt of the Owner’s notice of termination, the Owner may complete the work at the expense of the Contractor, and the Contractor and his or her Surety shall be liable to the Owner for any excess cost incurred by the Owner to complete the work. If the Owner completes the work, the Owner may take possession of and utilize such materials, appliances and plants as may be on the worksite site and necessary for completion of the work.
Contract Violations. The Contractor acknowledges that any violation of Chapter 2, or any other chaptered provision of the Public Contract Code (PCC), is subject to the remedies and penalties contained in PCC Sections 10420 through 10425.
Contract Violations. If EXHIBITOR violates any terms of this Agreement, SPONSOR reserves the right to terminate this Agreement with cause.
Contract Violations. CGCERT may impose sanctions according to the CGCERT’s scale of sanctions, in case of violation of this contract or the regulations indicated. The scale of sanctions is an integral part of this contract. The agency reserves the right to amend the scale of sanctions. The agency shall inform the operator of the amendment one month before it will be valid.
Contract Violations. 1. LOSS OF PAYMENT SECURITY: If the payment security for delivered logs is canceled or otherwise becomes ineffective, the State will cease log delivery. Delivery may resume only upon receipt of written notice from the State that acknowledges adequate security.
Contract Violations. The waiver by either party of a breach or violation of any provision of this Contract shall not be construed to be a waiver of any subsequent breach thereof.
Contract Violations. In cases where the Administration is not notified by the agreed time, teachers guilty of first and second offenses per semester, shall receive written warnings. The third and subsequent offenses per semester may result in the employee being denied the use of sick leave for the day(s) in questions.
Contract Violations a. The APSOCPA may impose sanctions according to the APSOPCA’s scale of sanctions, in case of violation of this contract or the regulations.
b. If a violation of the regulations results in financial damage to the APSOPCA or a third party, the operator will be held accountable for the payment of said damages, independent of any sanctions already carried out.
Contract Violations. The Agency may impose sanctions according to the Agency’s scale of sanctions, in case of violation of this contract or the regulations indicated under paragraph 2. The Agency reserves the right to amend the scale of sanctions. Contract Violations. Violations of any of the provisions in this Contract, the Code of Student Conduct or other official University policies will be considered a violation of this Contract and may be referred to appropriate University personnel for disciplinary action. Students in violation of local, state or federal law may face criminal investigation and prosecution by local law enforcement as well as University disciplinary sanctions.
