Contractor Submission of Change Request. Contractor may also submit a Change Request to the Department to propose changes that should be made within the scope of this Contract. Any such Change Request must include a price summary and Schedule impacts. The Department will attempt to respond to such Change Requests from Contractor within 20 days of receipt. If the parties reach an agreement on a Change Order in writing, and the Change Order is executed by authorized representatives of the Parties, the terms of this Contract will be modified accordingly through an amendment as provided for in Section 24.21. If the parties are unable to reach an agreement in writing on a Change Request submitted by Contractor, the Department’s Project Manager will be deemed to have rejected the requested Change Request. Upon rejection by the Department of a Contractor request for a change order, Contractor is obligated to continue performance in accordance with this Contract.

If the parties reach an agreement on a Change Order in writing, and the Change Order is executed by authorized representatives of the Parties, the terms of this Contract shall be modified accordingly. If the parties are unable to reach an agreement in writing on a Change Request submitted by Contractor, the ODHH TRS Contract Administrator will be deemed to have rejected the requested Change Request.

Any such CR must include proposed Charges and Schedule impacts, including a breakdown of the number of Contractor’s Staff hours by level needed and an itemization of other costs to effect the requested changes. HCA will respond to such CRs from Contractor within twenty (20) days of receipt. If the parties reach agreement on the proposed changes, authorized representatives of the parties will execute a CO and the terms of this Agreement will be modified accordingly. If the parties are unable to reach agreement on a CR submitted by Contractor, the HCA Project or Program Director will be deemed to have rejected the requested CR.

Any such Change Request shall include proposed costs and a proposed schedule, including a breakdown of the number of Staff hours by level of Contractor and the CalSAWS Consortium’s and/or Counties’ personnel needed to effect this change. The CalSAWS Consortium shall respond to such Change Requests from Contractor within 20 Days of receipt. If the parties reach an agreement on a Change Request in writing, and the Change Request is executed by authorized representatives of the Parties, the terms of this Agreement shall be modified accordingly. If the parties are unable to reach an agreement in writing on a Change Request submitted by Contractor, the CalSAWS Consortium Executive Director will be deemed to have rejected the requested Change Request.
