Crossing of Legal Picket Lines. No employee covered by this Agreement except in emergency conditions will be required to enter any building, property or business where a picket line is in evidence, when such picket line is established under the Statutes of the Province of British Columbia or the Statutes of the Federal Government. Failure to cross such a picket line by the members of this Union shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action. Pay for such loss of time shall be at the discretion of the Employer.

Crossing of Legal Picket Lines. The Employer shall not request a Union member to cross the picket line of a legal strike. The Union will waive this condition to a number of employees required to remedy a specified emergency such as fire, water repairs, sewer repairs, flooding or snow and ice conditions, or emergency declared by senior government. Any employees not wishing to cross a picket line of any legal strike shall inform their Supervisor immediately of their decision, in writing.

In such a case the Union agrees to negotiate each case, so as to allow the Employer to provide such services as may be required to our customers. An employee covered by this Agreement shall have the right to refuse to cross a legal picket line recognized by the Union. Failure to cross such a picket line by a member of the Union shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action providing that the employee notifies the supervisor immediately of the situation which will allow the supervisor and/or Union to negotiate with the striking Union, safe passage through the legal picket line to perform services.

  • Heating of Room Throughout the Term the Manager will provide a heating system sufficient to provide a comfortable temperature in the Room and will operate, maintain and repair that heating system. During any period in which the heating system is not functioning to the standards set out above, the Manager will use commercially reasonable efforts, after receiving notice of the deficiency, to have the system repaired and functioning as soon as may be possible in the circumstances. In no event however, is the Manager liable to the Resident for any consequential illness or discomfort and the Manager shall not be deemed to be in default of its obligations under this Agreement, so long as it is using commercially reasonable efforts to have the system repaired.
