Death or Retirement Sick Leave Buy. Back Option: At the time of separation from 716 District employment due to retirement (as recognized by the Washington State Public 717 Employees' Retirement System, whether or not the employee was a participating member of 718 the system) or death, an employee or his/her estate shall receive pay for accumulated but 719 unused sick leave up to a maximum of one-hundred eighty (180) days at a rate equal to one 720 day per diem pay for each four full days accrued leave for illness or injury. 721 722 The monies paid pursuant to this provision shall not be included for the purpose of 723 computing a retirement allowance under any public retirement system in the State, and shall 724 be in accordance with the rules and regulations of the Superintendent of Public Instruction. 725 726 Section B: Bereavement Leave 727 728 The District shall grant employees up to five (5) days with pay per occurrence for death in the 729 immediate family (as defined above in Section A, Subsection c) of employees. Members may use 730 one (1) day of bereavement leave for the death of a close personal friend. An additional four (4) 731 days maximum will be granted at the employee’s request for this purpose. These additional days 732 will be without pay or the employee may use personal leave or compensatory time. 733 734 Section C: Emergency Leave 735 736 Up to three (3) days of emergency leave with full pay shall be available to employees. For purposes 737 of this leave, an emergency is a situation or adversity of such a nature that preplanning is not 738 possible. Emergency leave could not be used where good judgment would logically dictate that the 739 matter could and should have been dealt with in some other manner. Two (2) additional days of 740 emergency leave may be granted at the discretion of the Superintendent or his/her designee. 741 742 Emergency leave may not be used for vacation periods or extensions thereof, recreational outings, or 743 for business or social appointments, or for matters of personal convenience. 744 745 An employee who finds it necessary to be absent from assigned duties by reason of emergency will 746 notify the appropriate supervisor at the earliest possible moment.   • Death or Disability The Executive's employment shall terminate automatically upon the Executive's death during the Employment Period. If the Company determines in good faith that the Disability of the Executive has occurred during the Employment Period (pursuant to the definition of Disability set forth below), it may give to the Executive written notice in accordance with Section 12(b) of this Agreement of its intention to terminate the Executive's employment. In such event, the Executive's employment with the Company shall terminate effective on the 30th day after receipt of such notice by the Executive (the "Disability Effective Date"), provided that, within the 30 days after such receipt, the Executive shall not have returned to full-time performance of the Executive's duties. For purposes of this Agreement, "Disability" shall mean the absence of the Executive from the Executive's duties with the Company on a full-time basis for 180 consecutive business days as a result of incapacity due to mental or physical illness which is determined to be total and permanent by a physician selected by the Company or its insurers and acceptable to the Executive or the Executive's legal representative.

  • VESTED RETIREMENT GRATUITY VOLUNTARY EARLY PAYOUT a) An Employee eligible for a Sick Leave Credit retirement gratuity as per Appendix A shall have the option of receiving a payout of his/her gratuity on August 31, 2016, or on the employee’s normal retirement date.

  • Vacation Leave on Retirement ‌ An employee scheduled to retire and to receive pension benefits under the Public Service Pension Plan Rules or who has reached the mandatory retiring age, shall be granted full vacation entitlement for the final calendar year of service.

  • Disability Retirement If, as a result of your incapacity due to physical or mental illness, You shall have been absent from the full-time performance of your duties with the Company for 6 consecutive months, and within 30 days after written notice of termination is given You shall not have returned to the full-time performance of your duties, your employment may be terminated for "Disability." Termination of your employment by the Company or You due to your "Retirement" shall mean termination in accordance with the Company's retirement policy, including early retirement, generally applicable to its salaried employees or in accordance with any retirement arrangement established with your consent with respect to You.

  • Pre-Retirement Leave An employee scheduled to retire and to receive a superannuation allowance under the applicable Superannuation Act(s), or who has reached the mandatory retiring age, shall be entitled to:

  • Re-employment After Retirement Employees who have reached retirement age as prescribed under the Pension (Municipal) Act and continue in the Employer's service, or are re-engaged within three (3) calendar months of retirement, shall continue at their former increment step in the pay rate structure of the classification in which they are employed, and the employee's previous anniversary date shall be maintained. All perquisites earned up to the date of retirement shall be continued or reinstated.

  • Post-Retirement Employment Unit members who retire from the University during the term of this Agreement may propose a post-retirement appointment of up to three years duration. During this post-retirement appointment, the total of retirement benefits and post-retirement salary paid by the University shall not exceed the salary paid at the time of retirement. The annual compensation received from the University for the post-retirement appointment shall not exceed fifty (50) percent of the annual salary at the time of retirement. The duties for a post-retirement appointment shall be defined and agreed to in writing by the bargaining unit member and the Employer/University Administration prior to the bargaining unit member's retirement. Such appointments are at the discretion of the Employer/University Administration and are subject to existing law and all rules and regulations of the State Retirement Board. The decision of the Employer/University Administration not to approve a proposal for a post-retirement appointment shall not be grievable under the Grievance and Arbitration Procedure, Article 7.

  • Normal Retirement Date The date on which the Executive attains age sixty-five (65).

  • Deferred Retirement a. An employee who, upon separation from County service, is eligible for paid retirement and elects deferred retirement must defer participation in the Grant until such time as he or she becomes an active retiree.

  • Continuous Service The Parties shall continue providing services to each other during the pendency of any dispute resolution procedure, and the Parties shall continue to perform their obligations (including making payments in accordance with Article IV, Section 4) in accordance with this Agreement.
