Delimitation. Export Certificates and Manufacturing Certificates are issued solely for products that are defined as medical devices under the terms of the Swiss legislation and for which a certificate of conformity is available, making them marketable in Switzerland and in the Treaty countries. The marketability of DEVIT products (devices derived from devitalised human tissue, or which incorporate such tissue) is certified only for Switzerland. Swissmedic does not issue Export Certificates or Manufacturing Certificates for veterinary medical devices or products that are defined as medical devices only in the country of destination, e.g. toothbrushes, instruments for dental technicians, general laboratory equipment etc. The Agency does not contact authorities in Third countries in order to perform its services; this is the responsibility of the exporting persons.
Delimitation. Alleged violations of express contract terms may proceed to level four; alleged violations of statutes and rules affecting terms and conditions may proceed to level two; and alleged violations of policies and administrative decisions may proceed to level three.

Delimitation. Since the subject of TP touches upon several different aspects and angles, to narrow the span of the thesis it will focus on Swedish APA legislation. The predominant reason for why the focus lies on the Swedish legislation is that it is a newly implemented legislation and not much examination concerning this legislation has been done. However, a comparison with other countries’ legislations around APA will be done. The reason for this is that, as mentioned, the Swedish legislation is fairly new and might be in need of some adjustments, which can be found by examining the APA legislation in countries which have had their legislation for a sufficient amount of time. Legislations regarding the bookkeeping of what TP method that has been used are found in IAS/IFRS, Swedish GAAP and in Swedish bookkeeping legislation, and therefore these regulations are examined to see if the APA can ease these bookkeeping demands.

Delimitation. Because the Mekong Agreement is fairly new, there is still not a very large bulk of information or analysis available regarding it. The distance to the region has furthermore made it very difficult to meet ‘in person’ with people who might have been able to provide me with additional information. A fully satisfactory study of regional or international agreements, in line with a traditional legal research method, would normally include commentaries and/or explanations of the legal text. Such additional material would have been beneficial for the full understanding of the Mekong Agreement. However it appears that this kind of material does not exist regarding the Mekong Agreement (or if it does it has not been made public).9 Neither have I come across any legal cases where the Mekong Agreement has actually been put into practice, why such inputs have also been excluded from the thesis. The Mekong Agreement is still in its first phases, and the Mekong River Commission (MRC), governing the Agreement, is presently working on developing more specific rules under the Agreement. New rules on water quantity and quality are under progress by the MRC but as the content of these rules has not yet been made public they will be discussed to a very limited extent and focus will be on the situation today. Implementation of the Mekong Agreement into national legislation of the member countries has only very briefly been included in this thesis. The Mekong Agreement has been given the form of a framework instrument with only general requirements which cannot be enacted into national law in their present form. The rules which have been agreed upon to complement the Agreement are fairly new and have not yet reached the stage of implementation in the member countries. To some extent the prevailing situation in the region has however been studied in the analysis of the Mekong Agreement (chapter 5). This has been done especially in regard to public participation and environmental impact assessments. The section on international principles does not aspire to be all- embracing. The aim of the chapter is merely to give an overview of relevant principles in order to use them as a base for evaluation of the Mekong Agreement. Delimitation. Any financing under this agreement may in principle be carried out for contracts regarding export of financial instruments within such definitions and rules as are practised at all times by the Guarantee Institute for Expert Credit. The Ministry may either decide that certain deliveries shall not be covered under the 108 Agreement or that the 108 Agreement shall be extended to cover all types of deliveries. The application of the 108 Agreement must be in accordance with the international agreements and understandings to which Norway is a party. If Eksportfinans should doubt whether the agreement is managed in accordance with international agreements and arrangements to which Norway is a party, Eksportfinans shall contact the Ministry in order to clarify whether the transaction can be completed. The decisions regarding lending in this agreement are in accordance with the rules in the OECD Consensus Agreement (the Consensus Agreement), including the rules on minimum interest.
Delimitation. (a) After the execution of the Transfer Contract, Party B, together with Party A and the land administration authority, shall verify the location of the coordinates corners as indicated on the map of land usage scope and verify and confirm the area. (b) Party B shall entrust land administration authority of the government to stake at the corners of the land according to the coordinates of the corners marked on the reap of the land usage scope. Party B shall take efficient measures to ensure the stakes not to be removed or damaged. If the stakes are removed or damaged within the land use tem, Party B shall submit a written report to the Administration Commission of Shanghai Waigaoqiao Free Zone immediately to apply for re-measurement and re-staking. Until delimitation of the Land and obtaining the Project Construction Planning Permission, Party B shall not proceed with any construction on the land. It shall be charged with unlawful occupancy and use of State-owned land for violation of the above provision. (c) Party B shall be liable for the expenses incurred in the re-measurement and re-staking due to loss, damage or removal of the stakes.
