Department Rights. All departments, as defined in Article 7, have the following rights and parameters. The District is responsible for ensuring that other District bodies do not assume the roles or subsume the rights of departments, as defined below. A. Each Unit A faculty member in the District must be a member of a department, and only Unit A faculty members may be a member of a department. B. Departments, as defined in Article 7, are distinct from other District entities, and other District entities do not employ Unit A faculty as such. C. All departments are represented at the Department Chairs Council by a department chair or designated faculty coordinator. In departments (e.g. Health Science and Public Safety) that have a designated faculty CE coordinator rather than an elected or appointed department chair, the faculty CE coordinator will be assigned to represent the department. D. Department membership. 1. Contract faculty are members of a single department with the option of performing assignments in other departments. 2. Associate faculty may be members of multiple department associate pools.

Department Rights. The Department hereby retains and reserves unto itself, without limitation, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the Constitution of the United States, the Constitution of California, the laws of the United States, the laws of California and the ordinances and resolutions of the City of Burlingame and Town of Hillsborough and shall be limited only by the express and specific terms of the Memorandum.
Department Rights. In the event that the Contractor fails to comply with any of the requirements set out in this Schedule the Department reserves the right to take such remedial action under this Contract as it considers appropriate in the circumstances, which may include but is not limited to requiring the Contractor to terminate an existing Sub-Contract and/ or prohibiting the Contractor from entering enter into any new Sub-Contract to deliver the Services under this Contract.
Department Rights. On and from the later of: the Date of this Agreement; or where the Department has approved the Participant's acquisition of an interest in a Proposed Property in accordance with clause 7.4, the date the Participant becomes the registered proprietor of an interest in the Property, the Participant irrevocably: charges its rights, title and interest in and to the Property and the Works in favour of the Department; agrees that the Department has the right to register and maintain a caveat against the title of the Property until such time as the conditions imposed under this Agreement have been fully satisfied or discharged; and agrees to sign all consents, as required by the Department to the lodgement of caveats against the title of the Property in the form required by the Department from time to time to prevent the lapsing, or withdrawal, of any caveat. Department Rights. The Department reserves the right to: • Select for agreement or for negotiations a proposal other than that with the lowest costs; • Reject any and all proposals received in response to this RFP; • Make no award; • Issue a new RFP; • Waive any informalities, irregularities, or inconsistency in proposals received; • Request modification to proposals from any or all proposers during the review and negotiation; • Negotiate any aspect of the proposal with any Consultant and negotiate with more than one Consultant at the same time; • Make partial awards; • Increase or decrease quantities; • Reject any request that shows any omission, alterations of forms, additions not called for, conditions, or alternate proposals; • Deny any and all exceptions to the RFP requirements; • Reject any non-responsive or non-conforming proposals; • Make any such award as is deemed to be in the best interest of the State of Delaware.
Department Rights. In the event the Municipality fails to adhere to their obligations described in this Agreement, the Department may, but shall not be obligated to, complete any needed repairs or maintenance to the Detention Pond that the Department determines in its sole and reasonable discretion, are necessary for the proper operation of said Detention Ponds. The Municipality agrees that if the Department incurs costs because of the Municipality’s failure to adhere to the obligations in this Agreement, the Department has the right to set off such amounts from any other amounts owed by the Department to the Municipality.

  • Department Heads Department heads shall normally be tenured and hold the rank of Associate Professor or Professor in one of the departments to be served, unless mutually agreed to by the departmental faculty and administration. 3.1.2.1 When it becomes known that a department head position will become vacant, or if the department head position has already become vacant, or if a new department is created, the xxxx of the college shall meet with the department faculty within two (2) weeks to discuss qualifications and expectations for the position. Specific guidelines will be formulated which may include: a. Whether internal and/or external candidates shall be considered b. Desired qualifications, including rank c. Budgetary considerations d. The target number of recommended candidates that will be submitted to the xxxx for consideration 3.1.2.1.1 Following the discussion described in 3.1.2.1, the department faculty shall communicate their recommendations within two (2) weeks to the xxxx. The xxxx shall promptly confirm or modify the department faculty’s recommendations and communicate the guidelines and procedures in choosing the new department head. 3.1.2.2 The department faculty will formulate its recommendation(s) among all candidates and forward same to the xxxx, with supporting rationale. When the department faculty is able to find more than one (1) acceptable candidate, the department may rank order its list of acceptable candidates and give reasons for its ranking. If the department is able to find only one (1) acceptable candidate, it shall recommend that candidate. If the department faculty does not find an acceptable candidate, the search will be ended. The xxxx will review the departmental recommendation(s) with the PVPAA. If the department’s recommendation(s) is approved by the PVPAA, the PVPAA shall recommend the appointment of the candidate to the President of the University. If the University does not accept the recommended candidate(s), the University has the right to declare the search process has ended. 3.1.2.3 In the event a department head position is not filled in a timely fashion through the preceding procedures, the Board may appoint a department head for a period not to exceed one (1) year. During this year the procedures specified in sections 3.1.2.1 and 3.

  • Department Head A. Within ten (10) business days from his/her receipt of the decision resulting from the previous level, the employee may appeal to the Department Head using the original copy of the grievance. B. Within ten (10) business days from the receipt of the employee's grievance, the Department Head or his/her designated representative who has not been involved in the grievance in prior levels shall make a thorough review of the grievance, meet with the parties involved and give a written decision and the reasons therefore to the employee and the Union representative. However, the Department Head or designate is not limited to denying a grievance for the reasons stated at any previous level in the procedure. Upon request, a copy of the decision will be given to the Union representative. C. If the Department Head or his/her designated representative fails to give a decision within the specified time limit, the Union shall have the option of referring a grievance alleging a violation of the negotiated agreement between the parties to arbitration. D. On matters that are not subject to arbitration pursuant to Section 8 hereafter, the written decision of the Department Head or his/her designated representative shall be final.

Teachers shall have the right to refuse such appointment. Team leaders will have coordinating and planning functions for their teams and shall serve as liaison between their teams and the principal.
