Detention Pond. As a part of Creekside Sub Unit 1 Development, Developer shall improve and alter an existing detention pond within the Creekside Sub Unit 1 Development Area, shown as Detention Area A on the King’s Crossing-Phase I Final Plat recorded as document number 1000551 in Book D of Plats at page 12 in the Office of the Xxxx County Recorder, in accordance with the plans shown on Exhibit B, attached hereto and made a part hereof.
Detention Pond. A shallow bowl-like depression in the land, with an area to collect and temporarily store stormwater. The pond is generally lined with grass and is intended to store stormwater to reduce runoff volumes during storms. Actions to keep detention ponds functioning: • Remove litter, sediment, yard debris, and problem vegetation such as Scotch broom. • Maintain a healthy grass cover to prevent erosion and weed growth. • Repair erosion, and replace rock riprap at pipe ends. • Inspect pond berms for any structural deficiencies Bioretention Cell: A shallow stormwater system with a designed soil mix and plants. Bioretention is a “low-impact development” (LID) practice that is integrated into a site to retain stormwater near its source. Bioretention cells are designed to mimic a forested condition by controlling stormwater through detention, infiltration, and evapotranspiration. They also provide water quality treatment through sedimentation, filtration, adsorption, and phytoremediation. Bioretention cells function by storing stormwater as surface ponding before it filters through the underlying amended soil. Actions to keep bioretention cells functioning: • Remove litter, weeds and fallen leaves. Do not use herbicides or pesticides. • Check inflow and outflow systems, and remove any obstructions. • Repair erosion; cover bare spots with organic mulch. • Perform plant maintenance as needed, such as pruning branches. • Remove dead vegetation and replace dead plants with same varieties. Detention Pond. GPC agrees to construct a Detention Pond at no cost to City that is located on the site identified in the Banner Associates Conceptual Detention Pond – Grant Park, dated September 21, 2022, and the Banner Associates Supplemental Drainage AnalysisXX Xxxxx Park Detention Pond, dated October 20, 2022 (“Banner Detention Pond Report”) or on a location in the area to the North of Bulldog Avenue and to the East of Xxxxxx’x Pond. City understands and agrees that a Detention Pond in the area to the North of Bulldog Avenue and to the East of Xxxxxx’x Pond may be located in part on City property. The City will not charge GPC any amount for the use of City property for the purpose of construction the Detention Pond. The parties acknowledge and agree that the amount of water the Detention Pond is designed to detain need only account for the surface water drainage attributable to the Grant Park Addition, as determined in the Banner Detention Pond Report, which is incorporated into this Agreement by reference for the clear understanding of the parties. In the event the Detention Pond is located in the area to the North of Bulldog Avenue and to the East of Xxxxxx’x Pond and is designed to detain surface water drainage greater than the amount in the Banner Detention Pond Report, City shall not require GPC to incur additional cost or expense for engineering reports or studies to construct this Detention Pond, and City be shall not be required to incur any cost or expense other than the potential for a permanent easement on City property in the event the Detention Pond is located in part on City property. GPC shall provide City with copies of all reports, plans and specifications for the Detention Pond. It is GPC’s intention that the Detention Pond will be completed and operational within one hundred twenty (120) days from the approval of this Agreement by the City Council. GPC will inform City of any delays. Upon completion and construction of the Detention Pond and final inspection, City agrees to be responsible for maintenance of the Detention Pond after acceptance. GPC agrees that the four (4) lots identified in the Grant Park Addition will not be sold until such time as the Detention Pond is completed and operational.

Detention Pond. Provided that Seller does not exercise its right to terminate this Agreement pursuant to Section 2.3, then, provided Purchaser is not in default under this Agreement, promptly following the lapse (or earlier express waiver by Seller) of such termination right Seller shall, at the request of Purchaser, apply to COR for the permits necessary to allow the filling of the detention pond located at the Northeast corner of Lot 2 of the Real Property. Seller shall execute such documents and make such applications as are necessary to obtain approval of such permits, provided that (i) Purchaser shall provide at its expense such plans and other technical documents and such personnel and other assistance as may be required to process such permit applications, (ii) Purchaser shall reimburse Seller for its out of pocket expenses incurred in connection with its making application for and obtaining the approval of such permits within ten (10) business days of Purchaser’s receipt of each invoice therefor. If the necessary permits are obtained, Purchaser may, at its option, at its expense, with contractors selected by and retained by Purchaser, cause the filling of the detention pond in accordance with the permits.
Detention Pond. The Homeowners Association shall be responsible for the upkeep and maintenance of the Detention Pond located in the northeast portion of the subdivision. The original purpose and operational capacities of said pond are required to be maintained at all times.
