DESIGN PROFESSIONAL'S SERVICES. A. Pre-Design/Schematic Design Phase Design Professional shall: 1. identify applicable building codes, administrative, and permit processing requirements as relevant; 2. verify, by on-site inspection unless specifically stated otherwise by the Owner, existing conditions and systems, including but not necessarily limited to architectural, structural, mechanical and electrical systems, to confirm that these conditions and systems are of adequate condition and capacity to support the Work to be executed on the Project; 3. in consultation with Consultant team, Owner representatives, and other designated persons, use all available information to evaluate the program requirements, and with appropriate data and graphics propose a series of improvements deemed necessary and desirable to satisfy the program requirements, including; space needs, budget, availability of utilities, effect of codes and ordinances, safety and energy requirements, access to all spaces for all people, historical character of the building, and any other factors and design criteria identified by Owner, Consultant team or Design Professional.; 4. based on the most recent Owner approved program requirements, develop schematic design studies consisting of drawings, and other documents for the Owner's approval; 5. provide documents suitable for submission to the City of Corvallis for the Oregon State University Pre-Development Plan Review, as required the Owner; 6. provide to the Owner the required documents for the approval of various governmental agencies having jurisdiction over the Project; Owner shall pay for all required appeals and plan review fees; 7. submit to the Owner an estimate, consistent with the requirements of Section I.G.4 above and prepared by an independent cost estimator, of the probable Construction Budget of the Project based upon current area, volume or other appropriate unit costs, and compare and reconcile this independent cost estimate with a separate, independent cost estimate obtained by the Owner;

DESIGN PROFESSIONAL'S SERVICES. 1.1.1 The Design Professional's services consist of those services performed by the , Design Professional's employees and the Design Professional's consultants as enumerated in Articles 2 and 3 of this Agreement. 1.1.2 The Design Professional's services shall be performed as expeditiously as is consistent with professional skill and care and the orderly progress of the Work. The Design Professional has prepared the attached Exhibit “C“, “Design Schedule” which includes a minimum of two (2) weeks for review by the Owner and the CM after each submission by the Design Professional. Time limits established by this schedule shall not, except for reasonable cause, be exceeded by the Design Professional. 1.1.3 The Design Professional shall comply with the Florida Building Code and the Construction Procedures Guidelines as promulgated by the Construction Services Department which are accessible at http://.xxx.xxxxxxxx.x00.xx.xx/xxxxxxxxxxxx. The requirements and documents required by the Florida Building Code and the Construction Procedures Guidelines, unless otherwise stated in this Agreement, shall be considered as basic services to be provided by the Design Professional. 1.1.4 Design Professional hereby represents to the Owner that the Design Professional possesses sufficient experience, licenses, authority, personnel and working capital to complete the services required hereunder; that Design Professional has visited the site for the Project and thoroughly familiarized itself with the local conditions under which services required hereunder are to be performed; and that the Design Professional shall correlate its observations of the same with all of the requirements of this Agreement and of the Construction Contract Documents.
DESIGN PROFESSIONAL'S SERVICES. All of the services in Article Two of the Agreement, the Design Professional will be compensated per the terms set forth in Exhibit B, Section I of this Agreement, except for those items specifically identified as reimbursables or Special Services. Reimbursables will be compensated pursuant to the terms set forth in Exhibit B, Section II of this Agreement. Special Services will be compensated per the terms set forth in Exhibit B, Section III of this Agreement. All Services are considered Basic Services (See Article II, Section 3) unless otherwise indicated or agreed too.

  • Design Professional The architect or engineer or architectural or engineering firm selected by Owner (i) for the design and preparation of Contract Documents governing the construction of a Project, or (ii) for construction contract administration under the Contract Documents, or (iii) for both, all such services and the scope thereof to be set forth in the Design Professional Contract. The Design Professional is not an employee of the Owner but is engaged or retained by it for the purpose of performing design and construction administration services for the project. The term “Design Professional” includes architects, engineers, surveyors, designers, and other consultants retained by the Design Professional.

  • Professional Engineering and Architect’s Services Professional Engineering and Architect’s Services are not permitted to be provided under this Agreement. Texas statutes prohibit the procurement of Professional Engineering and Architect’s Services through a cooperative agreement.

  • Note to Design Professional Please insert the number of additional Days allowed and the new Material Completion and Occupancy Date, or, if no additional time is allowed, insert “0” for the Days and “No Change” for the date.

  • Contractor’s Services shall be performed in accordance with generally accepted professional practices and principles and in a manner consistent with the level of care and skill ordinarily exercised by members of Contractor’s profession currently practicing under similar conditions. Contractor shall comply with the profession’s standard of performance, applicable laws, regulations, and industry standards. By delivery of completed work, Contractor certifies that the work conforms to the requirements of this Agreement and all applicable federal, state and local laws. If Contractor is retained to perform services requiring a license, certification, registration or other similar requirement under California law, Contractor shall maintain that license, certification, registration or other similar requirement throughout the term of this Agreement.

  • Professional Services Bodily injury" or "property damage" arising out of the rendering of or failure to render profes- sional services;

  • Hospice Services Services are available for a Member whose Attending Physician has determined the Member's illness will result in a remaining life span of six months or less.

  • Chiropractic Services This plan covers chiropractic visits up to the benefit limit shown in the Summary of Medical Benefits. The benefit limit applies to any visit for the purposes of chiropractic treatment or diagnosis.

  • Contract for Professional Services of Physicians Optometrists, and Registered Nurses

  • Professional Services Fees You agree to pay us the professional services fees in the amounts set forth in the Investment Summary. Those amounts are payable in accordance with our Invoicing and Payment Policy. You acknowledge that the fees stated in the Investment Summary are good-faith estimates of the amount of time and materials required for your implementation. We will bill you the actual fees incurred based on the in-scope services provided to you. Any discrepancies in the total values set forth in the Investment Summary will be resolved by multiplying the applicable hourly rate by the quoted hours.

  • Professional Services Warranty 5.1 Oracle warrants that Professional Services will be provided in a professional manner consistent with industry standards. Customer must notify Oracle of any warranty deficiencies within 60 days from performance of the deficient Professional Services. 5.2 ORACLE DOES NOT WARRANT THAT THE PROFESSIONAL SERVICES WILL BE PERFORMED ERROR- FREE OR UNINTERRUPTED, THAT ORACLE WILL CORRECT ALL PROFESSIONAL SERVICES ERRORS, OR THAT THE PROFESSIONAL SERVICES WILL MEET CUSTOMER’S REQUIREMENTS OR EXPECTATIONS. ORACLE IS NOT RESPONSIBLE FOR ANY ISSUES RELATED TO THE PERFORMANCE, OPERATION OR SECURITY OF THE PROFESSIONAL SERVICES THAT ARISE FROM CUSTOMER DATA OR THIRD PARTY APPLICATIONS OR PROFESSIONAL SERVICES PROVIDED BY THIRD PARTIES. 5.3 FOR ANY BREACH OF THE PROFESSIONAL SERVICES WARRANTY, CUSTOMER’S EXCLUSIVE REMEDY AND ORACLE’S ENTIRE LIABILITY SHALL BE THE CORRECTION OF THE DEFICIENT PROFESSIONAL SERVICES THAT CAUSED THE BREACH OF WARRANTY, OR, IF ORACLE CANNOT SUBSTANTIONALLY CORRECT THE DEFICIENCY IN A COMMERCIALLY REASONABLE MANNER, CUSTOMER MAY END THE DEFICIENT PROFESSIONAL SERVICES AND ORACLE WILL REFUND TO THE CUSTOMER THE FEES FOR THE TERMINATED PROFESSIONAL SERVICES THAT CUSTOMER PRE-PAID TO ORACLE FOR THE PERIOD FOLLOWING THE EFFECTIVE DATE OF TERMINATION. 5.4 TO THE EXTENT NOT PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND THERE ARE NO OTHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING FOR SOFTWARE, HARDWARE, SYSTEMS, NETWORKS OR ENVIRONMENTS OR FOR MERCHANTABILITY, SATISFACTORY QUALITY AND FITNESS FOR A PARTICULAR PURPOSE.
