Construction Administration Phase. Upon District’s acceptance of Architect’s work in the previous Phase and assuming District has not delayed or terminated the Agreement, the Architect shall perform Construction Administration Phase services for the District as follows: 1. The Architect’s responsibility to provide basic services for the Construction Phase under the Agreement commences with the award of the contract for construction and terminates upon satisfactory performance and completion of all tasks in this phase and commencement of the Closeout Phase or upon the District’s terminating the Agreement, whichever is earlier.
Construction Administration Phase. Commencing with the Owner’s issuance of a notice-to-proceed for construction of the Project, the Architect shall: 1. attend the pre-construction conference at the Project site; 2. provide general administration of the Work as contemplated by the provisions of the Construction Contract including assisting the Owner with evaluation of the feasibility of the Contractor-provided project time schedule; 3. make periodic visits to the Project site with such frequency as to ascertain the progress and quality of the Work, attend progress meetings with the Contractor, determine in general if the Work is proceeding in accordance with the Construction Documents, and submit a written report to the Owner within five (5) business days after each visit, with copies of each report to the Contractor; 4. arrange for periodic visits of Consultants to make similar determinations with respect to mechanical and other Work, as applicable; 5. review and approve or take appropriate action, with reasonable promptness to cause no delay in the Work, regarding shop drawings and samples submitted by the Contractor; 6. prepare any supplemental drawings or large-scale details needed to clarify the Construction Documents; 7. respond promptly to requests from the Contractor for assistance with unforeseen problems so as to minimize the Owner's exposure to claims for delay; 8. advise and consult with the Owner, issuing appropriate instructions to the Contractor; 9. check proposed costs of any modifications to the Construction Contract and recommend acceptance or rejection to the Owner (Owner will prepare written change orders); 10. endeavor to guard the Owner against defects and deficiencies in the Work of the Contractor; 11. notify the Owner of any Work which does not conform to the Construction Documents and recommend to the Owner that the Contractor stop the Work whenever, in the Architect's opinion, it may be necessary for the proper performance of the Construction Contract. 12. issue certification to the Owner and the Contractor when all terms of the Construction Contract have been fulfilled to the Architect's satisfaction; 13. conduct on-site observations to determine the date of final completion, receive written guarantees and related documents assembled by the Contractor and issue recommendation for final acceptance and payment; 14. assist the Owner in the implementation of the State of Oregon's “1% For Art Program”, as applicable; 15. upon completion of the Work, the Architect shall,...

Construction Administration Phase. A.3.1 If the scope of work calls for construction administration services, the following shall apply: A.3.2 The Consultant shall visit the site at scheduled intervals appropriate to the stage of construction of the Project to become generally familiar with the quality and progress of the construction work that has been completed and to determine, in general, if the construction work is being performed in a manner indicating that, when completed, the work will be in accordance with the contract documents. The Consultant shall not be required to make continuous and/or exhaustive on-site inspections to check the quality or the quantity of the construction work. On the basis of the on- site observations, the Consultant shall keep the Owner informed of the progress and quality of the construction work in order to endeavor to guard the Owner against defects and deficiencies in the work. A.3.3 At all times the Consultant shall have access to the work to determine if it is proceeding in accordance with the Contract documents. However, neither the Consultant nor its sub-consultants shall have control over or be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the work; these are solely the Construction Contractor’s obligations under the contracts for construction. The Consultant shall not be responsible for Construction Contractor’s schedules or failure to carry out the work in accordance with the contract documents. Except as otherwise provided in this AGREEMENT, the Consultant shall not have control over or charge of acts and omissions of the contractor’s, construction subcontractors, or their agents or employees, or any other persons performing the work. A.3.4 Based on the Consultant’s observations and evaluations of the construction contractor’s Applications for Payment, the Consultant shall certify the amounts due to the construction contractor’s. The Consultant’s certification of payment shall constitute a representation to the Owner, based on the Consultant’s observations at the site as provided above, and the data contained in the construction contractor’s Applications for Payment, that the construction contractor’s work on the project has progressed to the point indicated and the quality of the construction work is generally in accordance with the contract documents. Construction Administration Phase i - Upon written authorization from the DISTRICT to proceed with the Construction Administration Phase, the ARCHITECT shall perform Construction Administration Phase services for the DISTRICT as follows: ii - The ARCHITECT'S responsibility to provide basic services for the Construction Phase under this Agreement commences with the award of the Contract for Construction and terminates upon satisfactory performance and completion of all tasks in this phase, or upon the DISTRICT’S terminating this Agreement, whichever is earlier. iii - During construction, the ARCHITECT shall furnish all necessary additional drawings for supplementing, clarifying and/or correcting purposes and for change orders required. These drawings shall be requested in writing from the ARCHITECT by the DISTRICT and shall be at no additional cost unless designated as extra work or services by the DISTRICT. The original tracing(s) of the drawings and contract wording for change orders shall be submitted to the DISTRICT for duplication and distribution. iv - ARCHITECT shall review and approve or take other appropriate action upon contractor's submittals such as: shop drawings, project data, samples and change orders, but only for the limited purpose of checking for conformance with information given and the design concept expressed in the Contract Documents. v - The ARCHITECT'S action upon contractor’s submittals shall be taken as expeditiously as possible so as to cause no unreasonable delay in the Project or in the work of separate contractors, while allowing sufficient time in the ARCHITECT'S professional judgment to permit adequate review. In no case shall the review period associated with a single, particular submittal exceed fourteen (14) calendar days from its receipt by the ARCHITECT. vi - During the course of construction, all Requests for Information (“RFI”) must be responded to as expeditiously as possible so as not to impact and delay the construction progress. In no case shall the review period associated with an RFI exceed five (5) business days from the receipt by the ARCHITECT. vii - ARCHITECT shall visit the Project site as necessary or when requested, and in no case less than once a week, sufficient to determine that the Project is being constructed in accordance with the plans and specifications, and to resolve discrepancies in the Contract Documents and to monitor the progress of the Project. Construction Administration Phase. 2.9.1 The Construction Administration phase shall commence with the award of the construction contract and shall end upon the Trustee’s filing of the Notice of Completion for the project. 2.9.2 The construction duration, jointly estimated by the Architect/Engineer and Trustees during the Bidding Phase, plus granted weather days, plus thirty (30) additional calendar days, shall for the purposes of this Agreement, be the base duration for the Construction Administration phase. Work required beyond this period due to contractor or owner delay shall be compensable to the Architect/Engineer upon request as an Extra Service. 2.9.3 During the Construction Administration phase the Architect/Engineer shall: a.) Keep the Trustees informed of the observed progress of construction b.) Report via email to the Trustees observed deficiencies in the work of construction c.) Evaluate schedules, shop drawings, materials, equipment, and laboratory reports for compliance with design d.) Prepare documentation for change proposals and change orders for written approval of Trustees e.) Examine Contractor's applications for payment; recommend by signature partial payments to Contractor in accordance with the Contract Documents. 2.9.4 The Architect/Engineer shall advise and consult with the Trustees, in all matters identified in the Contract Documents. The Architect/Engineer shall provide technical advice to the Project Manager/Inspector of Record and as requested prepare written responses and instructions to the Contractor relative to the construction of the project. The Architect/Engineer shall advise the Trustees’ Project Manager/IOR who acts as the Trustees’ primary conduit of formal correspondence and direction to the contractor. 2.9.5 The Architect/Engineer shall provide timely response to Contractor submittals and requests for information (RFI’s) to the Trustee’s Project Manager. 2.9.6 In the event of an error or omission in the Construction Documents due to the Architect/Engineer, the Architect/Engineer shall prepare revised documents to correct the error or address the omission without additional cost to the Trustees. 2.9.7 The Architect/Engineer shall review and by signature recommend approval or rejection of the Contractor’s payment requests to the Trustees.
