Designated Holidays. 17.01 A nurse who otherwise qualifies under Article 17.02 hereunder shall receive 12 paid holidays as follows: New Year’s Day Family Day – 3rd Monday in February Good Friday Easter Monday Victoria Day Canada Day – July 1 Civic Holiday Labour Day Thanksgiving Day Remembrance Day Christmas Day Boxing Day In the event that the Provincial Government declares an additional holiday during the term of this Agreement, such holiday will be substituted for one of the above- mentioned holidays. The designation of the additional holiday for an existing holiday shall be subject to local determination and such designation shall not add to the present number of holidays. 17.02 In order to qualify for pay for a holiday, a full-time nurse shall complete the nurse’s full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Employer or the nurse was absent due to: (a) legitimate illness or accident which commenced within a month of the date of the holiday; (b) vacation granted by the Employer; (c) the nurse’s regular scheduled day off; (d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay. 17.03 Holiday pay will be computed on the basis of the full-time nurse’s regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a). 17.04 Subject to Article 17.02: (a) where a holiday falls during a full-time nurse’s scheduled vacation period, the nurse’s vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay. 17.03 15.02 Holiday pay will be computed on the basis of the nurse's regular rate of pay.
15.03 A nurse who is required to work on any of the foregoing designated holidays shall be paid for all hours worked at the rate of 1-1/2 times her regular rate of pay. In addition, a full-time nurse’s nurse will receive an additional day off with pay. Such day off will be taken at a mutually agreed upon time prior to the next designated holiday, except for Christmas Day and Boxing Day which are to be taken prior to Good Friday and Good Friday which is to be taken prior to Victoria Day. If such arrangements are not made as herein provided, the nurse shall be paid for the day at her regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a)pay.
17.04 Subject to Article 17.02:
(a) where Where a holiday falls during a full-time nurse’s 's scheduled vacation period, the nurse’s her vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.
(b) where Where a holiday falls on a full-time nurse’s 's scheduled day off off, an additional day off with pay will be scheduled.
(a) A 15.05 In order to qualify for pay for a holiday, a full-time nurse required shall complete her full scheduled shift on each of the working days immediately preceding and following the holiday unless excused by the Employer.
15.06 When a nurse is scheduled to work on any of the foregoing holidays a weekend which precedes a designated holiday set out in Article 15.01, she shall be paid at expected to work the rate of 1½ holiday unless mutually agreed otherwise between the Employer and the nurse’s regular straight time hourly rate of pay for all hours worked .
15.07 Where possible, when a nurse is not scheduled to work the weekend which precedes a designated holiday which falls on such holiday subject to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour Monday as set out in Article 15.01(a)15.01, she will not be scheduled to work the paid holiday.
(b) If a regular or casual part-time nurse works on any of 15.08 The Employer will endeavour to divide the designated holidays listed in Article 17.01 of this Agreement, to be worked equally amongst the nurse shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tournurses.
(c) Full-time nurses on extended tours shall receive 12 lieu days off to consist of 7.5 hours each.
17.06 Where a full-time nurse is entitled to a lieu day under Article 17.04 or 17.05 above, such day must be taken off as set out below, or payment shall be made in accordance with Article 17.

In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 15.01(a)so worked.
(b) If a regular or casual part-time nurse In addition to the payment provided to an employee who works on any of the holidays listed in Article 17.01 of this Agreementholiday, the nurse an employee who is entitled to receive statutory holiday pay shall be paid receive either eight (8) hours or eight point four (8.4) hours statutory holiday pay at the rate of 1½ the nurse’s regular straight time employee's basic hourly rate or the equivalent compensating leave of either eight (as set out in 8) hours or eight point four (8.4) hours, provided the Wage Schedule) employee opts for all hours worked on such compensating leave prior to the holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tour16.04.
(c) Full-time nurses An employee who does not work on extended tours shall receive 12 lieu days off to consist of 7.5 hours each.
17.06 Where a full-time nurse designated holiday but is entitled to holiday pay shall have the option to select the equivalent compensating leave of eight (8) hours or eight point four (8.4) hours in lieu of holiday pay subject to Article 16.04.
16.03 In order to be entitled for payment for a lieu designated holiday, an employee must have worked fully the last scheduled working day immediately preceding the holiday and the first scheduled working day immediately following the holiday unless absent from work through proven illness in which case such employee shall not be disqualified from receiving holiday pay provided he has worked one (1) or more of the working days since the last designated holiday and returns to work prior to the next designated holiday. Where an employee is absent through proven illness on the relevant qualifying days for Good Friday, Easter Monday, Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve and New Year's Day, he shall not be disqualified from receiving holiday pay.
16.04 An employee shall have the option of banking holiday pay to which he is entitled under Article 17.04 or 17.05 above, such day 16.02 (b) and Article 16.02 (c) subject to Article 14.08.

(ab) where a holiday falls during a fullA part-time nurse’s scheduled vacation period, the nurse’s vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.

(a) A full-time nurse employee who is not required to work on any the public holiday as listed below, will be paid holiday pay based on the employee's regular wages and vacation pay during the four weeks prior to the holiday and divided by 20. 12.03 Entitlement to designated holiday off with pay Subject to Article 17.04. In addition12.04 below, the nurse will a full-time employee shall be entitled to receive a lieu day designated holiday off with pay in the amount of the nurseemployee’s regular straight time hourly rate of pay times earnings provided the number of hours in a normal daily tour as set out in Article 15.01(a).

17.02 In order to qualify for payment for any of the holidays designated in Article employee must work his last full scheduled shift of his normal week prior to and his first full scheduled shift of his work week following the holiday. Notwithstandingthe foregoing provisions of this Article, when a regularly scheduled shift starts on the night the designated holiday and finishes on the holiday, or starts on the night of the designated such hours of the shift as are worked on the holiday will not be paid for at premium rates but shall be paid for at the employee‘s regular straight time hourly rate. An otherwise eligible employee, who agreed to work on one of the designated holidays but does not report for work and work as scheduled, without reasonablecause, shall forfeit his holiday pay for that particular holiday. All work performed on any of the designated holidays by a seniority employee shall be paid for at the rate of two (2) limes his regular rate of pay in addition to the holiday pay for a holiday, a full-time nurse shall complete qualifying employee. In the nurse’s full scheduled shift on each event one of the working days immediately preceding and following aforesaid holidays falls during the holiday concerned unless excused by the Employer or the nurse was absent due to:
(a) legitimate illness or accident which commenced within vacation period of a month of the date of the holiday;
(b) vacation seniority employee, such employee shall be granted by the Employer;
(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the an extra day of the holiday shall, subject to the above provisions, vacation. Seniority employees shall be entitled to an annual vacation in accordance with the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.
17.03 Holiday pay will be computed following schedule on the basis of the full-time nurse’s regular straight time hourly rate seniority at June in each year. 17.06 Where a full-time nurse is entitled to a lieu day under Article 17.04 or 17.05 above, such day must be taken off as set out below, or payment shall be made vacation pay in accordance with Article 17the regulations of the Ontario Employment Standards Act. NOTE: Percentage payout twenty (20) years or more is The Company reserves the right to either a plant shut down for a vacation or to stagger vacations. In allocating vacation periods, the Company will seniority within the classification where practical in scheduling work during shut down and additional vacation periods beyond the shut down. as long as it does not interferewith the efficient operation of the Company. The Company will give notice to the Union by April of each year as to the time of plant shut down for he purpose of schedulingvacations. Float days must be taken during the calendar year in which they were earned, at a time scheduled by the Hospitaland agreeable to the employee. In the absence of mutual agreement, the float day shall be scheduled by the Hospital. There shall be no carryover of float days. To be eligible for Floating Holidays,an employee must have completed his probationary period. An employee whose employment has been terminated shall qualify for one (1) Float Holiday provided his termination takes place after March of the year in which he is terminated. The float day will be rescheduledto a mutually agreed date. Lieu days to which an employee becomes entitled pursuant to article shall be taken at a time scheduled by the Hospitaland acceptable to the employee within (60) calendar days following the holiday. Ifno agreement is reached on such day of pay within sixty (60) days, the employee shall receive holiday pay. The employee shall take his birthday holiday on his actual birth date, unless he gives thirty days notice to his Department Head or Department Heads' designate that he wishes to reschedule the Provincial Government declares an additional holiday during holiday. Where such written notice is properly given, the term of this Agreement, such employee's birthday holiday will be substituted for arranged by mutual agreement, but in any event such rescheduledholiday must be taken in the period commencingthirty (30)days following the employee's actual birth date. If the Hospitalrequires an employee to work on the day which has been scheduled or mutually agreed as his birthday holiday, the employee will be entitledto premium pay of one and one-half times his regular basic rate of pay. 17.02 In order to qualify for pay for a holiday, a full-time nurse shall complete the nurse’s full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Employer or the nurse was absent due to:
(a) legitimate illness or accident which commenced within a month of the date of the holiday;
(b) vacation granted by the Employer;
(c) the nurse’s regular employee's scheduled day off;
(d) a , the employee will be paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to his holiday pay hereunder shall not and may receive sick leave pay an additional day off, pay, at a time scheduled by the Hospital and agreeable to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that dayemployee. A nurse receiving Workplace Safety and Insurance Board Benefits for the day Where any of the holiday shall, subject to holidays listed in the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.
17.03 Holiday pay will be computed on the basis of the full-time nurse’s regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a).
17.04 Subject to Article 17.02:

In addition to the event that the Provincial Government declares an additional holiday during the term of this Agreementabove, such paramedic who works on the holiday will be substituted shall receive either equivalent statutory holiday pay at the paramedics basic hourly rate or equivalent compensating leave, provided the paramedic opts for one compensating leave prior to the holiday.
18.03 A paramedic who does not work on a designated holiday is entitled to holiday pay in accordance with the Employment Standards Act. For part time paramedics the entitlement to pay on any of the above- mentioned holidays. The designation of the additional holiday for an existing holiday aforementioned recognized holidays shall be subject to local determination and such designation shall not add to the present number of holidays.
17.02 In order to qualify for pay for a holiday, a full-time nurse shall complete the nurse’s full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Employer or the nurse was absent due toqualifying conditions:
(a) legitimate the paramedic must work twelve (12) days of the twenty-eight (28) days which preceded the week of the holiday and their scheduled day before and after the holiday, unless absence is the result of personal illness or accident in which commenced within case the Employer may require verification by a month of medical doctor’s certificate as to the date of the holidayillness or accident;
(b) vacation granted by a paramedic who has not worked twelve (12) days of the Employer;
twenty-eight (c28) days which preceded the nurse’s regular holiday, (but who has worked their scheduled day off;
(dbefore and after the holiday, unless absence is the result of personal illness or accident in which case the Employer may require verification by a medical doctor’s certificate as to the illness or accident) a paid leave of absence provided the nurse is not otherwise compensated shall have payment for the holiday. 17.04 Subject to Article 17.02:

1.5.1 Requests for taking the Christmas Holiday off will be granted pursuant to 14.1.2. Requests for Thanksgiving will be granted by random drawing.* Requests for New Year’s Day will be granted by random drawing, separate from the random drawing conducted for the Thanksgiving Holiday. The designation process used for the Random Drawings is as follows: All employees desiring to have Thanksgiving and/or New Year’s Holiday off will indicate so to their Department Head by April 12 for Thanksgiving and September 30 for New Year’s Day of that calendar year. One week after these deadlines the additional holiday for an existing holiday shall Departments Head(s) and one or more Union representatives will meet and requests will be subject randomly drawn. The first request will be drawn by a Union representative, the second by a Department Head and so on. The Department Head reserves the right to local determination and such designation shall not add modify the Holiday requests granted in order to meet staffing requirements. Any change that is made will be communicated to the present number of holidays.

(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled There may be instances where, due to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled scheduling, a Department Head must assign additional employees to work that dayafter the random drawing has been conducted and leave requests granted. A nurse receiving Workplace Safety In this situation the first employee assigned to work will be the last name drawn in the random drawing, the next employee assigned to work will be the second to last name drawn in the random drawing, and Insurance Board Benefits so forth. In those cases where, due to scheduling, an employee’s leave request for Thanksgiving and/or New Year’s Day selected by random drawing is assigned to work on the day of Holiday by their Department Head. These employees will be granted the same holiday shall, subject off the following year prior to the above provisions, random drawing. Following the random drawings conducted for Thanksgiving 2008 and New Year’s Day 2009 the process will be entitled to reviewed by the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday payLabor-Management Committee. 17.04 Subject 14.1.1.3 Once the scheduling has been completed the schedule will be posted accompanied by a Seniority List.
14.1.2 Because the Nursing Home operates every day of the year and it is not possible for all employees to Article 17.02:
(a) where a holiday falls during a full-time nurse’s scheduled vacation periodbe off duty on the same day, the nurse’s vacation shall be extended by one day unless Administrator has the nurse and the Employer agree right at his sole discretion to schedule a different day off with pay.
(b) where a holiday falls on a full-time nurse’s scheduled day off an additional day off with pay will be scheduled.
(a) A full-time nurse required require any employee to work on any of the foregoing holidays shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate of pay for all hours worked on such holiday subject to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 15.01(a).

This day off shall be selected by the employee subject to approval by the Administrator and shall be taken within the period of the (10) days preceding or following the holiday. Preference in the selection of a day off in lieu of a holiday or holiday pay shall be on the basis of seniority among employees performing similar work.
14.1.3 If a designated holiday falls within an employee's scheduled vacation, such employee if otherwise eligible, shall, at the option of the Administrator, be paid two days pay at the employee's regular rate of pay for the holiday, or granted an additional day of vacation, to be taken at a later date.
14.1.4 An employee scheduled to work on a designated holiday, but who fails to report, shall not be eligible for a day off in lieu of the holiday, or paid holiday pay, unless excused by the Administrator for good cause.
14.1.5 Employees who opt for holiday pay shall be paid for the designated holiday as follows:
14.1.5.1 Thanksgiving, Christmas, and New Year’s Day: Employees shall receive seven and one half (7.5) hours pay at the premium rate of 1½ 2 ½ times their base rate of pay, plus shift differential. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.

When a holiday occurs it may be necessary for some employees to work after 11:00 p.m. to complete work in progress or to close down properly for the holiday. 12.02 Where a designated holiday for an existing holiday falls on a Saturday or Sunday, it shall be subject to local determination and such designation observed on the preceding Friday or the following Monday.
12.03 Effective the date of ratification, statutory holiday pay for Live Haul Drivers shall not add be increased to the present number of holidays600 trailer rate.
17.02 12.04 Where a Live Haul Driver works on a statutory holi- day, he shall be paid two (2) times the live haul statutory holiday rate as outlined in 12.03 above, in addition to his statutory holiday pay.
12.05 An employee shall only be considered to have worked on a designated holiday if he is required to work during the period he would have worked had the designated holiday been a normal work day for the plant.
12.06 In order to qualify for pay for a holidaypayment of any of the holi- days designated in Article 12.01, a full-time nurse shall complete the nurse’s employee must work the full scheduled shift on each of the working days declared work day immedi- ately prior to the holiday and the full scheduled shift on the declared work day immediately preceding and following the holiday. An employee who is otherwise eligible but fails to work the shift before or the shift following the holiday concerned unless excused due to an absence authorized in advance by the Employer Company shall not be disqualified from receiving holiday pay. An employee who is otherwise eligible but fails to work the shift before or the nurse was absent shift following the holiday due to:
(a) legitimate illness to an injury for which Workers’ Compensation is received, hos- pitalization or accident which commenced within a month of the date of the holiday;
(b) vacation granted an absence authorized by the Employer;
(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder Company shall not receive be disqualified from receiving holiday pay.
12.07 The Company agrees to pay an employee who would otherwise qualify for designated holiday pay, but who is receiving sick leave pay to which or workers’ compensation the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference dif- xxxxxxx between the amount of the Workplace Safety and Insurance Board Benefits sick leave pay or workers compensation and the holiday pay, as the case may be. This provision, will only apply when the employee is receiving weekly sick leave benefits, or if on workers’ compensation, for a pe- riod not to exceed the maximum stipulated by the sick leave benefits insurance plan.
17.03 Holiday pay will be computed on the basis of the full-time nurse’s regular straight time hourly rate of pay times the number of hours for 12.08 Where a normal daily tour as set out in Article 15.01(a).
17.04 Subject to Article 17.02:
(a) where a holiday falls during a full-time nurse’s scheduled vacation period, the nurse’s vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.
(b) where a holiday falls Delivery Driver works on a full-time nurse’s scheduled designated holi- day off an additional day off with pay will be scheduled.
(a) A full-time nurse required to work on any of the foregoing holidays shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate of pay for all hours worked on such holiday subject to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours and is engaged in a normal daily tour as set out in Article 15.01(a).
(b) If a regular or casual part-time nurse works on any of the holidays listed in Article 17.01 of this Agreementmileage run, the nurse shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tour.
(c) Full-time nurses on extended tours he shall receive 12 lieu days off to consist of 7.5 hours each.
17.06 Where a full-time nurse is entitled to a lieu day under Article 17.04 or 17.05 above, such day must be taken off as set out below, or payment shall be made in accordance with Article 17.two

15.2 When any of the Workplace Safety above-noted holidays fall on a Saturday or Sunday and Insurance Board Benefits and are not proclaimed as being observed on some other day, the following Monday shall be deemed to be the holiday payfor the purposes of this Agreement.
17.03 15.3 Holiday pay will be computed on the basis of the full-time nurse’s regular straight time hours the employee would otherwise work had there been no holiday at their regular hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a).
17.04 Subject to Article 17.02:
(a) where a holiday falls during a full-time nurse’s scheduled vacation period, the nurse’s vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.
15.4 In order to qualify for holiday pay, the employee must work the last full scheduled shift within five (b5) where a days immediately preceding the holiday falls on a full-time nurse’s and the first full scheduled day off an additional day off with pay will be scheduledshift within five (5) days immediately following the holiday.
(a) A full-time nurse required 15.5 Where an employee is scheduled to work on any of the foregoing holidays a holiday, he shall be paid at the overtime rate as outlined in Schedule "A" for all hours so worked in addition to their holiday pay entitlement as outlined in this Article. 15.6 Any of the statutory holidays as listed falling within an employee’s annual vacation shall be paid in addition to the employee's annual vacation pay.
15.7 In addition to the above recognized holidays, full-time employees who have completed their first (1) year of full time continuous service, but less than three (3) years of service shall receive one (1) float day per calendar year. Employees with three (3) years' service but less than five (5) years of service shall receive two (2) float days and Employees with five (5) or more years of service shall receive (3) float days per calendar year Float days are scheduled in advance with the approval of the immediate supervisor and may not be carried forward to the next calendar year and are not paid out except when used. Float days are paid at the regular straight time hourly rate of pay plus one call per hour for the regularly scheduled shift and may not be added to vacation or any other paid holiday. The benefit currently held by all hours worked on such holiday subject to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 15.01(a).
(b) If a regular or casual part-time nurse works on any of the holidays listed in Article 17.01 of employees under this Agreement, the nurse collective agreement shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tourgrandfathered.

In the absence of mutual agreement, the float day shall be scheduled by the Hospital. There shall be no carryover of float days. To be eligible for Floating Holidays, an employee must have completed his probationary period. An employee whose employment has been terminated shall qualify for one Holiday provided his termination takes place after March the year in which he is terminated. If the termination occurs after September in the year in question he will qualify for two (2) Floating Holidays. (a) where a general holiday falls during a full-time nurse’s scheduled vacation periodthe period of an employee's vacation, the nurse’s period of vacation shall be extended lengthened by one working day unless to include the nurse and the Employer agree to schedule a different day off with pay.
(b) where a holiday falls on a fullgeneral holiday. Full-time nurse’s scheduled day off an additional day off with pay will be scheduled.
(a) A full-time nurse employees who are required to work on any of the foregoing holidays above days will be paid one and one-half (1%) times their regular salary for hours worked, plus one (1) regular day's pay. Time off, at regular pay, shall be offered as an alternative to the day's pay. Such time off shall be mutually agreed on between the employee and the department head and taken within forty-two (42) calendar days before or after the general holiday. If the designated holiday falls on a day on which an employee is receiving sick leave credits, it shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate of pay for all hours worked on such as a holiday subject to Article 17.04and not deducted from sick leave credits. (b) If a regular or casual part-time nurse works on any of the holidays listed in Article 17.01 of this Agreement, the nurse shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject period December 15th to the application provisions of Article 16.04 regarding hours worked in addition to the nurse’s full tour.

Designated Holidays. 17.01 A nurse who otherwise qualifies under Article 17.02 hereunder shall receive 12 paid holidays 15.01 The Employer agrees to recognize the following as followsdesignated holidays: New Year’s Day Family Day – 3rd Monday in February Good Friday Easter Monday Victoria Day Canada Day – July 1 Civic Holiday Labour Day Thanksgiving Day Remembrance Day Christmas Day Boxing Day In addition to the above listed designated holidays, each full-time nurse will receive one float holiday after she has completed twelve (12) months of service. This day will be scheduled by mutual agreement between the employee and the Employer. In the event that the Provincial Government declares an additional Federal or Provincial holiday is proclaimed during the term of this Agreementcollective agreement, such holiday will be substituted for one of the above- mentioned holidays. The designation of the additional holiday for an existing holiday shall be subject to local determination and such designation shall not add to the present number of holidaysreplace a float day(s).
17.02 In order to qualify for pay for a holiday, a full-time nurse shall complete the nurse’s full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Employer or the nurse was absent due to:
(a) legitimate illness or accident which commenced within a month of the date of the holiday;
(b) vacation granted by the Employer;
(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.
17.03 15.02 Holiday pay will be computed on the basis of the nurse's regular rate of pay.
15.03 A nurse who is required to work on any of the foregoing designated holidays shall be paid for all hours worked at the rate of 1-1/2 times her regular rate of pay. In addition, a full-time nurse’s nurse will receive an additional day off with pay. Such day off will be taken at a mutually agreed upon time prior to the next designated holiday, except for Christmas Day and Boxing Day which are to be taken prior to Good Friday and Good Friday which is to be taken prior to Victoria Day. If such arrangements are not made as herein provided, the nurse shall be paid for the day at her regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a)pay.
17.04 Subject to Article 17.02:
(a) where Where a holiday falls during a full-time nurse’s 's scheduled vacation period, the nurse’s her vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.
(b) where Where a holiday falls on a full-time nurse’s 's scheduled day off off, an additional day off with pay will be scheduled.
(a) A 15.05 In order to qualify for pay for a holiday, a full-time nurse required shall complete her full scheduled shift on each of the working days immediately preceding and following the holiday unless excused by the Employer.
15.06 When a nurse is scheduled to work on any of the foregoing holidays a weekend which precedes a designated holiday set out in Article 15.01, she shall be paid at expected to work the rate of 1½ holiday unless mutually agreed otherwise between the Employer and the nurse’s regular straight time hourly rate of pay for all hours worked .
15.07 Where possible, when a nurse is not scheduled to work the weekend which precedes a designated holiday which falls on such holiday subject to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour Monday as set out in Article 15.01(a)15.01, she will not be scheduled to work the paid holiday.
(b) If a regular or casual part-time nurse works on any of 15.08 The Employer will endeavour to divide the designated holidays listed in Article 17.01 of this Agreement, to be worked equally amongst the nurse shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tournurses.
(c) Full-time nurses on extended tours shall receive 12 lieu days off to consist of 7.5 hours each.

17.02 In order to qualify for holiday pay for a holiday, a full-time nurse shall complete the nurse’s employee must work the full scheduled shift hours of work on each of the working days work day immediately preceding and immediately following the holiday concerned unless excused by the Employer Employer, or the nurse an employee was absent due to:
(a) legitimate illness : bereavement leave; court duty leave; Uncontrolled copy of regularly scheduled vacation; confined to a hospital on one or accident which commenced within a month both of the date days verified to the satisfaction of the holiday;
(b) vacation granted by the Employer;
(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.

(b) where a holiday falls on a full-time nurse’s scheduled day off an additional day off with pay will be scheduled.
(a) A full-time nurse required An employee who has undertaken to work on any of the foregoing above holidays and fails to for work shall forfeit all pay for that day unless absence is due to illness verified by a medical certificate as required by the Employer or otherwise provides a reason satisfactory to the Employer. Except as provided in when a holiday specified in falls on a Saturday or a Sunday, or when any two of them fall on a successive Saturday or Sunday, the regular working day or days next following is a holiday or are holidays, as the case may be, in lieu thereof, but when such next following regular working day is also a holiday, the next regular working day thereafter is in lieu thereof a holiday. Vacation credits shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate of pay for all hours worked on such holiday subject awarded to Article 17.04. In addition, the nurse will receive a lieu day off with pay in the amount of the nurse’s regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 15.01(a).

Designated Holidays. 17.01 A nurse who otherwise qualifies under Article 17.02 hereunder shall receive 12 paid holidays 20.01 In each calendar year the following will be observed as followsholidays: New Year’s Day Family Day – 3rd Monday in February Good Friday Easter Monday Victoria Day Canada Day – July 1 Civic Holiday Labour Day Thanksgiving Day Remembrance Day Christmas Day Boxing Day In and any other day proclaimed as a holiday by the event that Federal Government - and/or the Provincial Government declares of the Province of Ontario. When any of the aforementioned holidays fall on a Saturday or Sunday or on an additional employee’s scheduled day off, the following normal working day shall be deemed to be a holiday during for the term purpose of this Agreementthe agreement. 20.02 Each full-time employee::
(i) who is not required to work on a holiday as defined in Article
20.01 shall be paid at the employee’s regular rate for each such holiday will be substituted for one of the above- mentioned holidaysnot so worked. The designation of the additional holiday for an existing holiday shall be subject to local determination and such designation shall not add to the present number of holidays.
17.02 In order to qualify for pay for a this benefit the employee must have worked the employee’s last scheduled shift preceding and the employee’s first scheduled shift following such holiday unless absence on either or both of these days is on account of:
a) illness or injury. Where the employee is absent on account of illness or injury on the last scheduled shift preceding the holiday, the shift following the holiday, or both shifts, such absence(s) must be substantiated by a full-time nurse shall complete doctor’s certificate, or
b) with the nurse’s full scheduled shift on each prior permission of the working days immediately preceding and following Employer. If such permission has been obtained the holiday concerned unless excused by the Employer or the nurse was absent due to:
(a) legitimate illness or accident which commenced within a month of the date of the holiday;
(b) vacation granted by the Employer;
(c) the nurse’s regular scheduled day off;
(d) a paid leave of absence provided the nurse is not otherwise compensated for must have commenced no more than five (5) days before the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which the nurse may otherwise have been entitled unless the nurse was scheduled to work that day. A nurse receiving Workplace Safety and Insurance Board Benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workplace Safety and Insurance Board Benefits and the holiday pay.
17.03 Holiday pay will be computed on the basis of the full-time nurse’s regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 15.01(a).
17.04 Subject to Article 17.02:
(a) where a holiday falls during a full-time nurse’s scheduled vacation period, the nurse’s vacation shall be extended by one day unless the nurse and the Employer agree to schedule a different day off with pay.
(bii) where a holiday falls on a full-time nurse’s scheduled day off an additional day off with pay will be scheduled.
(a) A full-time nurse who is required to work on any of the foregoing above-mentioned holidays shall be paid will receive holiday pay at the rate of 1½ the nurse’s regular straight time hourly plus time and one-half of his/her regular rate of pay for all hours worked on that day provided that such holiday subject to Article 17.04. In addition, employee meets the nurse will receive a lieu day off with pay condition applicable thereto as set forth in the amount immediately preceding paragraph.
20.03 A permanent part-time employee shall be entitled to a paid holiday each year on each of the nurse’s regular straight time hourly rate of pay times days indicated in Article 20.01 which fall on a day that is a regularly scheduled work day for the employee. Payment will be I based on the number of hours in a normal daily tour as set out in Article 15.01(a).
(b) If a regular or casual that the employee was scheduled to work on that day. It is understood and agreed that permanent part-time nurse works on any employees’ work week will not be rescheduled in order to deprive the employee of the holidays listed payment provided for in this clause.
20.04 When a holiday as defined in Article 17.01 of this Agreement, 20.01 falls within an employee’s vacation period the nurse employee shall be paid at the rate of 1½ the nurse’s regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 16.04 regarding hours worked in addition to the nurse’s full tour.
(c) Full-time nurses on extended tours shall receive 12 lieu days off to consist of 7.5 hours each.
17.06 Where a full-time nurse is entitled to a day off in lieu day under Article 17.04 or 17.05 above, such day must be taken off as set out below, or payment shall be made in accordance with Article 17thereof at the employee’s regular rate.
