Designated Holidays. (a) Every member shall be entitled to the following statutory holidays during the term of this Collective Agreement: New Year's Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day. 9:02 When any of the above-above named holidays falls fall on a Saturday or Sunday, the Friday preceding or the Monday succeeding such holiday (except Remembrance Day), TCHC shall be designated by the Board designate an alternative day as the day of observance of such holiday (alternate day), and it is agreed that the any premium payable for working on a designated holiday (alternate day) shall not apply to such Saturday or Sunday. It is understood and agreed that the alternative day(s) so designated may fall immediately before and/or after such Saturday or Sunday, at TCHC’s discretion.
9:03 Every member (c) In the case of Divisions with seven (7) day operations, when an employee is scheduled to work a shift, the majority of the hours of which fall within the twenty-four (24) hour period of the actual holiday with respect to Christmas Day, Boxing Day, New Year’s Day and Canada Day, the holiday premium will apply only to the actual holiday and not to the designated day of observance of the holiday, it being understood and agreed that in no circumstances will employees working on a seven (7) day operation be paid the holiday premium for both the actual holiday and the designated day of observance of that holiday.
9.02 Subject to sub-clause (ii) hereof, each employee,
(a) who is not required to work on a day so designated as a holiday holiday, shall be entitled to and shall be paid by TCHC his/her regular rate of pay for each designated holiday not so worked.;
9:04 Every member (b) who is required to work on a day so designated as a holiday holiday, shall be paid by TCHC at the rate of time and one-half two (2) times for the time so worked and, and in addition, addition shall either;
(i) be granted the option of being paid for a full day at his/her regular rate of pay or receiving pay, or
(ii) subject to there being mutual agreement between the employee and the Division Head take a subsequent lieu day off with pay at his/her regular rate, provided that total lieu
9.03 Employees in lieu thereof the "Temporary Service" shall be entitled to payment for the designated holidays for which employees in the "Permanent Service" are paid, provided they are employed, or report for work on both the regular working day immediately prior to and the regular working day immediately following the designated holiday concerned, unless the employee is absent with reasonable cause.
(a) Subject to clause 9.04(c) hereof in addition to the designated holidays set out in clause 9.01, each employee coming within the Local 79 Unit shall be granted two (2) floating holidays in each calendar year which will be taken at a time agreed upon between that is compatible with the member and operational requirements of the Division in which the employee works.
(b) Subject to 9.04(c), each employee coming within the Local 79 unit shall be granted one (1) day each calendar year to be utilized as a “wellness day”. This day must be used within the calendar year in which it is earned otherwise at year end it will be forfeited.
(c) A new employee must complete his/her Unit Commanderprobationary period with TCHC as set out in clause
9.05 An appropriate recognition of Remembrance Day will occur in the workplace.
(a) Each employee in the "Permanent Service" of TCHC, and each employee in the "Temporary Service" of TCHC who is entitled to benefits in accordance with Article 19 of this Agreement shall be eligible for vacation with pay on the following basis:
(i) following the completion of one (1) year of service – three (3) weeks’ vacation; provided that upon completion of the first six (6) months of the employee's first year of service, such employee may, if he/she so requests and the Division Head concerned consents, be granted one (1) weeks’ vacation prior to his/her anniversary date and the second and third week at a time after the anniversary date. Lieu If the week of vacation is granted and the employee's service terminates prior to completing one (1) year of service, the value of vacation granted shall be recovered from vacation pay due upon termination;
(ii) following completion of nine (9) years of service – four (4) weeks’ vacation;
(iii) following completion of seventeen (17) years of service – five (5) weeks’ vacation;
(iv) following completion of twenty-two (22) years of service – six (6) weeks’ vacation,
(v) following completion of thirty (30) years of service – seven (7) weeks’ vacation in the thirtieth (30th) year only.
(b) An employee who has qualified for the three (3) weeks’ vacation entitlement under clause 10.01(a) (i) shall thereafter be eligible for the annual vacation entitlement after January 1st of each calendar year. Other than what is set out in clause 10.01(c) below, January 1st shall be an employee’s anniversary date for vacation purposes in respect of this Article.
(c) Employees shall be eligible to receive vacation at any time may after January 1st in the year in which increased vacation entitlement occurs provided that TCHC shall be entitled to recover the value of the increased portion of the vacation taken as prior to entitlement where the employee leaves the service other than by death or retirement.
(i) Employees shall be entitled to vacation in accordance with the provisions of this Article, provided that where an employee is not in receipt of salary or wages because of sickness or injury for a part period of a day time which exceeds twenty-six (26) consecutive full pay periods, his/her vacation entitlement shall be reduced by 1/26th for each such consecutive full pay period in excess of twenty-six (26).
(ii) There shall be no reduction of the vacation entitlement of an employee who takes or a whole dayis granted pregnancy and/or parental leave pursuant to clauses 17.03(a) or 17.03(b) for the duration of such leave.
(e) It is understood and agreed that an employee’s vacation entitlement in the current year shall be based on his/her service in the previous year.

Designated Holidays. (a) Every member 7.01 A holiday is deemed to begin at the start of the first shift on the day of the holiday. When a holiday occurs it may be necessary for some employees to work after the start of the first shift to complete work in progress or to close down properly for the holiday. In the Mechanical Service Section, the minimum number of employees necessary to keep the factory in operating condition shall work on the holiday. From time to time emergencies may arise which will make it necessary for certain employees to work on a holiday in order that other employees will not suffer loss of time.
7.02 Employees who qualify will be entitled paid an amount equal to their regular rate of pay for one standard shift for each of the following statutory holidays during the term of this Collective Agreementholidays: New Year's Day, Civic Holiday, Last working day Good Friday, Easter MondayLabour Day, before Christmas, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day, Canada Day, Boxing Day and Boxing Daytwo (2) additional holidays which will be floating holidays, the date of which will be selected by the Employer. 7.04 Only the employee who worked the full scheduled shift the day before and the full scheduled shift the day after the holiday shall receive holiday pay. In a case where there are circumstances beyond the employee's control and the employee could have worked if the factory had operated, payment for a holiday may be made upon recommendation of the employee's Department Xxxxxxx. Subject to the above, an employee who is absent because of sickness or accident evidenced by a doctor's certificate and limited to a thirty day period exclusive of Saturday and Sunday which period includes such designated holiday, shall receive holiday pay. 9:03 Every member who is not 7.05 An employee required to work on a day so designated as holiday shall be paid double time for time worked, in addition to holiday pay.
7.06 An employee shall receive holiday pay for a holiday that occurs either during his/her regular vacation or the day before or the day after his/her regular vacation period provided that the said employee actually works his/her last regular scheduled shift before and his/her first regular scheduled shift following his/her vacation period and such holiday. In a case where an employee is absent on his/her regular scheduled shift before or his/her first regular scheduled shift after such holiday and vacation and such absence is excused, payment for the holiday may be made upon a recommendation as outlined in Section 7.04. Subject to the above, an employee who is absent because of sickness or accident evidenced by a doctor's certificate and limited to a thirty day period exclusive of Saturday and Sunday, which period includes such designated holiday, shall receive holiday pay for a holiday that occurs either during his/her regular vacation or on the day before or the day after his/her regular vacation period. 7.07 An employee who is laid off within a period of five working days immediately preceding a holiday, and who is actually at work on the day of layoff, shall be entitled to and shall be paid his/her regular rate of receive holiday pay for each designated holiday not so workedsuch holiday.

9:03 Every Day vi Day Unnamed When a member who is not i s required to work on a designated holiday, the member w i l l be granted another day so from work in lieu thereof, at a time approved by the Chief of Police or designate. If a designated as holiday occurs during a holiday member's vacation period, the member w i l l be granted another day from in lieu thereof, at a time approved by the Chief of Police or designate. A member shall be entitled to have the option of working these days from-duty provided they notify the Chief of Police, in writing of their intention prior January of the calendar year. The member who exercises the option and works the days shall be paid his/her regular rate of twelve days pay in addition to their normal pay for each designated holiday not so worked.
9:04 Every member who is required to work on a day so designated as a holiday working these days which shall be paid on the first pay in December. (a) Every member shall be entitled to 20.01 In each calendar year the following statutory holidays during the term of this Collective Agreementwill be observed as holidays: New Year's Day, Good Friday, Day Labour Day Easter Monday, Victoria Day, Canada Day, Monday Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day.
20.02 Each full-time employee:
(bi) In addition to the holidays provided in (a) above, every member who has completed six months service on June 1st of any year shall on that date have credited to his/her lieu time bank one day's credit at straight time and every member who has completed six months service on October 1st of any year shall on that date have credited to his/her lieu time bank one day's credit at straight time similarly calculated, such time in each case to be used in accordance with the lieu time provisions of the Collective Agreement.
(c) A member to qualify for payment of holidays in (a) and (b) above must be in receipt of some salary including sick pay under clause 11:10 in respect to the two clear calendar months immediately preceding such holiday.
9:02 When any of the above-named holidays falls on a Saturday or Sunday, the Friday preceding or the Monday succeeding such holiday shall be designated by the Board as the day of observance of such holiday and it is agreed that the premium payable for working on a designated holiday shall not apply to such Saturday or Sunday.
9:03 Every member who is not required to work on a day so designated holiday as a holiday shall be entitled to and defined in Article 20.01 shall be paid his/her at the employee's regular rate of pay for each designated such holiday not so worked. In order to qualify for this benefit the employee must have worked the employee's last scheduled shift preceding and the employee's first scheduled shift following such holiday unless absence on either or both of these days is on account of:
a) illness or injury. Where the employee is absent on account of illness or injury on the last scheduled shift preceding the holidays, the shift following the holiday, or both shifts, such absence(s) must be substantiated by a doctor's certificate, or
b) with the prior permission of the Employer. If such permission has been obtained the leave of absence must have commenced no more than five (5) days before the holiday.
9:04 Every member (ii) of certified absence with pay through illness or injury, or with the prior permission of the Employer. If such permission has been obtained the leave of absence must have commenced no more than five (5) days before the holiday;
(iii) who is required to work on a day so designated as a any of the above-mentioned holidays listed in Article 20.01 will receive holiday shall be paid pay at the rate of straight time plus time and one-one- half for the time so worked and, in addition, shall be granted the option of being paid for a full day at his/her regular rate for all hours worked on that day provided that such employee meets the condition applicable thereto as set forth in the immediately preceding paragraph.
20.03 A permanent part-time employee shall be entitled to a paid holiday each year on each of pay or receiving the days indicated in Article 20.01 which fall on a day that is a regularly scheduled work day for the employee. Payment will be based on the number of hours that the employee was scheduled to work on that day. It is understood and agreed that permanent part-time employees' work week will not be rescheduled in order to deprive the employee of the payment provided for in this clause.
20.04 When a holiday as defined in Article 20.01 falls within an employee's vacation period the employee shall be entitled to a day off in lieu thereof to be taken at a time agreed upon between the member and his/her Unit Commander. Lieu time may be taken as a part of a day or a whole dayemployee's regular rate.

(ii) in the event that he/she is scheduled to work in the week before and/or the week after the holiday, he/she does in fact report for work as scheduled on his/her last day before the holiday and his/her first scheduled day after the holiday, unless he/she is absent due to illness, injury or on approved leave. This provision does not apply to call-in work.
12.02 Any employee who does not qualify for statutory holiday pay in accordance with clause
12.01 above shall be paid his/her regular rate of holiday pay for each designated holiday not so worked.in accordance with the Employment Standards Act, 2000, S.O. 2000, as amended, as follows:
9:04 Every member (i) An employee who is not required to work on a day so designated holiday as defined in clause 1.03 shall be entitled to payment for the designated holiday provided that he/she works the entirety of his/her shift before and after the designated holiday.
(ii) Notwithstanding clause 12.01, where an employee demonstrates reasonable cause for not attending the shifts before and after the designated holiday as required in clause 12.01, he/she shall qualify for designated holiday pay.
(iii) An employee who is required to and actually works the entirety of his/her shift on a designated holiday shall be paid designated holiday pay, plus time and one half (1 ½) for all hours worked on the designated holiday.
(iv) Notwithstanding clause 12.03, where an employee demonstrates reasonable cause for not attending work as required in clause 12.03, he/she shall qualify for designated holiday pay.
(v) The designated holiday pay referred to in this article shall be calculated in accordance with the Employment Standards Act, 2000, S.O. 2000, as amended, as follows: Add all of the regular wages and vacation pay payable in the four work weeks before the work week in which the designated holiday occurred and divide this sum by twenty (20).
(a) Where such employee works on a designated holiday, he/she shall in addition to the holiday pay outlined above, be paid at the rate of time and one-one half (1 ½) for all hours worked.
(b) Where an employee has agreed to or is scheduled to work on a designated holiday and fails to do so for reasons other than illness, such employee shall forfeit the time so worked andpay for that designated holiday.
12.04 An appropriate recognition of Remembrance Day will occur in the workplace. Following completion of two thousand and eighty (2,080) hours of seniority, in addition, employees shall be granted eligible for one (1) floating holiday each calendar year or equivalent pay in lieu, at the option employee’s choice. Such time off or pay in lieu shall be pro-rated in accordance with an employee’s average number of being paid for hours per day, averaged over the last calendar year. The floating holidays will be taken within the calendar year in which he/she qualifies and will be taken in a full day at manner that is compatible with the operational requirements of the Home concerned. Notwithstanding the above, where an employee is unable to take his/her regular rate floating holidays within the calendar year in which they were earned because the employee became eligible in December of pay or receiving a day off that year and if the employer is unable to schedule the employee’s floating holiday(s) prior to the end of the year due to operational needs, he/she shall have until March 31 of the next year in lieu thereof which to be taken at a time agreed upon between the member and his/her Unit Commander. Lieu time may be taken as a part of a day or a whole daytake their floating holiday(s), subject to operational needs.

(b) paid one day's credit at straight time and every member who has completed six months service on October 1st of any year shall on that date have credited to one-half (1½) times his/her lieu regular hourly rate of pay for the hours worked and be given a day off with pay at some other time bank one day's credit at straight time similarly calculated, such time in each case convenient to be used in accordance with him/her and the lieu time provisions of the Collective AgreementEmployer.
(c) A member to qualify for payment of holidays in An employee working more than eight (a) and (b) above must be in receipt of some salary including sick pay under clause 11:10 in respect to the two clear calendar months immediately preceding such holiday.
9:02 When any of the above-named holidays falls on a Saturday or Sunday, the Friday preceding or the Monday succeeding such holiday shall be designated by the Board as the day of observance of such holiday and it is agreed that the premium payable for working 8) hours on a designated holiday shall not apply to such Saturday or Sundaywill be paid double-time (2x) for all hours worked beyond eight (8) hours.
9:03 Every member who is not required to work 14.04 When a designated holiday falls on a day so designated as that is a holiday shall be non-working day for a full-time employee, the employee is entitled to and shall be granted a day off with pay.
14.05 If a full-time employee is not entitled to a paid his/her regular rate of pay for each designated holiday not so worked.
9:04 Every member who and he/she is required to work on a designated holiday he/she must be paid at one and one-half (1-1/2) times his/her regular hourly rate of pay.
14.06 A full-time employee is not entitled to pay for a designated holiday unless he/she works his/her scheduled day so before and his/her scheduled day after the holiday, unless the absence is due to provable personal injury or illness.
14.07 A full-time employee is not entitled to pay for a designated as a holiday that occurs in his/her first thirty (30) calendar days of employment with the Employer if the employee does not work on that day, but if he/she is required to work on the designated holiday he/she shall be paid at the a rate of time at least equal to one and one-half for the time so worked and, in addition, shall be granted the option of being paid for a full day at (1½) times his/her regular hourly rate of pay or receiving for the time worked by him/her on that day, unless he/she is employed in a day off continuous operation in lieu thereof which case he/she is entitled to be taken at a time agreed upon between the member and his/her Unit Commander. Lieu regular hourly rate of pay for the time may be taken as a part of a day or a whole worked by him/her on that day.
14.08 No full-time employee is entitled to be paid for a designated holiday when he/she is not entitled to pay for at least ten (10) days during the thirty (30) calendar days immediately preceding the designated holiday.
14.09 Effective November 15, 2004, upon completion of thirty (30) days of employment, part- time employees shall be paid four point two five percent (4.25%) of gross regular earnings as designated holiday pay every pay period. If a part-time employee works on a designated holiday, the employee will be paid at a rate of one and one half (1-1/2) times their rate of pay for the hours worked on that day.
14.10 Subject to operational requirements the Employer shall not require an employee to work two consecutive designated holidays. Notwithstanding the preceding this condition does not preclude the employee from requesting to work two consecutive designated holidays should the schedule allow.

9:04 Every member (b) The holiday pay in accordance with clause 10.02
(a) shall be equal to the employee’s average days’ earnings in the eight (8) pay periods preceding the date of the designated holiday.
10.03 Subject to 10.02(a) and (b), each employee who is required to work works on a day so designated as a holiday holiday, shall be paid compensated for all hours worked at the rate of time and one-half for the time so worked and(1 ½), and in addition, shall be granted the option of being paid for a full day at his/her regular rate day’s pay.
10.04 Any employee who does not qualify for designated holiday pay in accordance with clause 10.02(a) above shall be paid designated holiday pay in accordance with the Employment Standards Act, 2000, S.O. 2000, as amended, as follows:
(i) An employee who is not required to work on a designated holiday as defined in clause 10.01 shall be entitled to payment for the designated holiday provided that he/she works the entirety of pay or receiving a day off in lieu thereof to be taken at a time agreed upon between the member and his/her Unit Commandershift before and after the designated holiday.

9:02 When any of the above-named holidays New Years Day falls on a Saturday or SundaySunday than the above two (2) half day (1/2) day entitlements shall be taken on the previous Friday. When any of the aforementioned holidays fall on a Saturday or Sunday or on an employee's scheduled day off, the Friday preceding or the Monday succeeding such holiday following normal working day shall be designated by deemed to be a holiday for the Board as purpose of the day agreement. If any of observance of such holiday and it is agreed that the premium payable for working above paid holidays falls on a designated holiday normal non-working day for an employee, he/she shall not apply receive a lieu day (at regular pay) to such Saturday or Sundaybe taken on the next normal working day which shall be deemed to be the straight time paid holiday.

(b) paid one day's credit at straight time and every member who has completed six months service on October 1st of any year shall on that date have credited to one-half (1½) times his/her lieu regular hourly rate of pay for the hours worked and be given a day off with pay at some other time bank one day's credit at straight time similarly calculated, such time in each case convenient to be used in accordance with him/her and the lieu time provisions of the Collective AgreementEmployer.
(c) A member to qualify for payment of holidays in (a) and (b) above must be in receipt of some salary including sick pay under clause 11:10 in respect to the two clear calendar months immediately preceding such holiday.
9:02 14.04 When any of the above-named holidays a designated holiday falls on a Saturday or Sundayday that is a non-working day for a full-time employee, the Friday preceding or the Monday succeeding such holiday shall be designated by the Board as the day of observance of such holiday and it employee is agreed that the premium payable for working on a designated holiday shall not apply to such Saturday or Sunday.
9:03 Every member who is not required to work on a day so designated as a holiday shall be entitled to and shall be granted a day off with pay.
14.05 If a full-time employee is not entitled to a paid his/her regular rate of pay for each designated holiday not so worked.
9:04 Every member who and he/she is required to work on a designated holiday he/she must be paid at one and one-half (1-1/2) times his/her regular hourly rate of pay.
14.06 A full-time employee is not entitled to pay for a designated holiday unless he/she works his/her scheduled day so before and his/her scheduled day after the holiday, unless the absence is due to provable personal injury or illness.
14.07 A full-time employee is not entitled to pay for a designated as a holiday that occurs in his/her first thirty (30) calendar days of employment with the Employer if the employee does not work on that day, but if he/she is required to work on the designated holiday he/she shall be paid at the a rate of time at least equal to one and one-half for the time so worked and, in addition, shall be granted the option of being paid for a full day at (1½) times his/her regular hourly rate of pay or receiving for the time worked by him/her on that day, unless he/she is employed in a day off continuous operation in lieu thereof which case he/she is entitled to be taken at a time agreed upon between the member and his/her Unit Commander. Lieu regular hourly rate of pay for the time may be taken as a part of a day or a whole worked by him/her on that day.
14.08 No full-time employee is entitled to be paid for a designated holiday when he/she is not entitled to pay for at least ten (10) days during the thirty (30) calendar days immediately preceding the designated holiday.

Designated Holidays. 9:02 When any of the above-named holidays falls on , furnish a Saturday or Sunday, the Friday preceding or the Monday succeeding such holiday shall be designated medicalcertificate issued by the Board as the day of observance of such holiday and it is agreed a qualified medical practitioner certifying that the premium payable for working on a designated holiday shall not apply to such Saturday or Sunday.

9:04 Every member who illness. If an employee is required to work on a designated holiday, he shall receive time and one half ( plus his regular pay. An employee called in on a statutory holiday will be paid for the holiday and in addition will receive double time for the hours worked. (c) absent due to an emergency situation related to the employee or an immediate family member that arose on short notice and could not be addressed outside of working hours and provides such reasonable proof as may be required.
19.04 Employees who agree to, or are otherwise required to work on the paid holiday and fail, without meeting the requirements in paragraph 19.03(b) or (ac) above, every member who has completed six months service to work their entire shift on June 1st of any year shall on that date have credited to his/her lieu time bank one day's credit at straight time and every member who has completed six months service on October 1st of any year shall on that date have credited to his/her lieu time bank one day's credit at straight time similarly calculatedthe paid holiday, such time in each case to will not be used eligible for premium pay or holiday pay.
19.05 Holiday pay will be calculated in accordance with the lieu time provisions Employment Standards Act and its regulations governing continuous operations.
19.06 It is agreed and understood that given the nature of the Collective Agreement.
(c) A member to qualify for payment of holidays in (a) and (b) above must Employer’s operation, employees may be in receipt of some salary including sick pay under clause 11:10 in respect to the two clear calendar months immediately preceding such holiday.

19.07 A full-time employee who was scheduled to work and did work on the holiday may elect, shall in lieu of holiday pay, to be granted the option of being paid for a full day at his/her regular rate of pay or receiving a day compensated by time off in lieu thereof equal to the employee’s regularly scheduled hours if such an agreement is reached between the employee and his Supervisor prior to the holiday. It is agreed that such lieu time must be taken within six (6) months of the holiday and that no more than three (3) lieu days may be carried at any one time. In order to schedule a lieu day, the employee must request the lieu time agreed upon between at least two (2) weeks in advance of the member and his/her Unit Commanderrequested day off. 10.03 When a holiday shall be entitled to and shall be paid his/her regular rate of pay for each designated holiday not so worked.
9:04 Every member who is required to work on a designated holiday, the member will be granted another day so from work in lieu thereof, at a time approved by the Chief of Police or designate.
10.04 If a designated as holiday occurs during a holiday member's vacation period, the member will be granted another day from work in lieu thereof, at a time approved by the Chief of Police or designate.
10.05 A member assigned to rotating shifts shall have the option of working these days from duty, provided they notify the Chief of Police, in writing, of their intentions prior to January 1st of the calendar year.
(i) The Member who exercises the option and works the days shall be paid twelve (12) days pay in addition to their normal pay for working these days which shall be paid on the first pay in December.
(ii) A Member may exercise the option and take six (6) days off as designated holidays with pay in addition to their normal pay, which shall be paid on the first pay in December.
10.06 A Member not assigned to rotating shifts may exercise the option outlined in Article 10.05 and accumulate designated holidays for days off, in a time period not to conflict with summer annual vacation (July 1st to August 31st) or after December 15th. Such accumulation shall not exceed twenty-one (21) hours of designated holiday time in each year.
10.07 A member appointed after January 1st shall be eligible for a proportionate number of days provided in Clause 10.02 related to the number of completed calendar months of service in the year, (in which the member receives pay for at least seventy (70) hours in that month), i.e. one (1) day for each completed month of service in the year.
10.08 Compensation in time or pay for statutory holidays during bereavement leave, annual leave or worker's compensation, may be granted at the rate sole discretion of time and one-half for the time so worked andChief of Police.
10.09 In the event the Government of Canada, the Province of Ontario or Municipal Government proclaims another statutory holiday, it shall replace the “Unnamed Day” contained in addition, shall be granted the option of being paid for a full day at his/her regular rate of pay or receiving a day off in lieu thereof to be taken at a time agreed upon between the member and his/her Unit CommanderArticle 10.02. Designated Holidays. 16.05 All full-time permanent employees who have completed six months of continuous service shall be entitled to one additional "floater day" that shall be recognized as a paid designated holiday.
16.06 All full-time permanent employees who have completed twelve months of continuous service shall be entitled to a second "floater day" that shall be recognized as a paid designated holiday. Where an employee ceases employment with the Corporation for any reason, their “floater day” entitlement – two (2) days will be pro-rated accordingly, except in respect to a deceased employee, or retiring employee in receipt of an OMERS unreduced pension.
16.07 At no time will any full-time permanent employees be entitled to more than two (2) "floater days" in any calendar year.
16.08 Full-time permanent employees may take "floater days" as paid time off or receive the normal pay or receiving for scheduled hours. The employee’s request will be given every consideration and subject to below. Effective January 1, 2006.
(a) Up to five (5) drivers may be scheduled for a combination of designated holidays, floater days, and a days leave of absence on the same day.
(b) The Corporation may allow maintenance personnel to take floater days subject to the operational requirements of the department. The Corporation shall not unreasonably deny such requests.
16.09 If a designated holiday occurs during an employee's vacation period, he/she shall be granted another day with pay in lieu thereof.
16.10 Where an employee selects a day off in lieu thereof to of pay, the selected day will be taken at a time agreed upon between shift of equal value.
16.11 Should the member and his/her Unit Commander. Lieu time may be taken Governor General, the Lieutenant-Governor, or the Council of the Town of Oakville proclaim any other day as a part of a day or a whole daypublic holiday such shall be considered an additional designated holiday.

Designated Holidays. (a) Every member shall be entitled to the following statutory holidays during the term of this Collective Agreement: New Year's ’s Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day.
(b) . In addition to the holidays provided in (a) above, every member who has completed six months service on June 1st of any year shall on that date have credited to his/her lieu time bank one day's ’s credit at straight time and every member who has completed six months service on October 1st of any year shall on that date have credited to his/her lieu time bank one day's ’s credit at straight time similarly calculated, such time in each case to be used in accordance with the lieu time provisions of the Collective Agreement.
(c) . A member to qualify for payment of holidays in (a) and (b) above must be in receipt of some salary including sick pay under clause 11:10 in respect to the two clear calendar months immediately preceding such holiday.
9:02 . When any of the above-named holidays falls on a Saturday or Sunday, the Friday preceding or the Monday succeeding such holiday shall be designated by the Board as the day of observance of such holiday and it is agreed that the premium payable for working on a designated holiday shall not apply to such Saturday or Sunday.
9:03 Every member who is not required to work on a day so designated as a holiday shall be entitled to and shall be paid his/her regular rate of pay for each designated holiday not so worked.
9:04 . Every member who is required to work on a day so designated as a holiday shall be paid at the rate of time and one-half for the time so worked and, in addition, shall be granted the option of being paid for a full day at his/her regular rate of pay or receiving a day off in lieu thereof to be taken at a time agreed upon between the member and his/her Unit Commander. Lieu time may be taken as a part of a day or a whole day. A member in the “temporary service” class of members shall be entitled to payment for the designated holidays for which members in the permanent service class are paid, provided he/she is employed or reports for employment on both the regular working day immediately prior to and the regular working day immediately following the designated holiday concerned.

9:03 Every member who is not required to work four (4) ten (10) hour days per week in order to best meet service provision needs. Employees assigned to this schedule will continue to be eligible for eight (8) hours’ holiday pay on the aforementioned holidays. If they do not work the holiday, they may elect to use two (2) additional hours from their vacation leave accrual, or elect to take two (2) hours LWOP, to complete their 40 hour work week. If the employee is assigned to work two (2) or more additional hours during the holiday work week, then he/she will not be required to supplement the holiday pay with vacation leave. Regardless of the type of schedule regularly worked by a day so designated as a holiday shall be entitled to and shall be paid hisParatransit Dispatcher, if he/her regular rate of pay for each designated holiday not so worked.
9:04 Every member who she is required to work on a day so designated as a holiday shall be holiday, he/she is paid at the rate of time one and one-half (1 1/2) for hours worked (or the time so employee may elect to have the hours worked andbe placed in their vacation bank, subject to any applicable taxes) in addition to the eight (8) hours’ holiday pay. Upon approval by the Paratransit Program Manager, an employee who works on one (1) of the six (6) designated holidays listed above, in additionlieu of eight (8) hours pay, shall eight (8) hours may be granted the option of being paid for a full day at added to his/her regular rate of pay or receiving a day off in lieu thereof to be taken at a time agreed upon between the member and vacation balance. An employee must have worked his/her Unit Commanderscheduled shift or have been on an authorized leave with pay immediately prior to and immediately after a holiday in order to receive a day’s pay for that holiday. Lieu time The holiday bid will take place during the month of December for the ensuing year. Each Paratransit Dispatcher will be required to sign up by seniority for one (1) holiday shift. Any shifts not bid will be posted as extra work and may be taken as a part of a day or a whole daybid by seniority. Any remaining shifts not bid may be assigned by reverse seniority.
