Colbent will maintain a disaster back-up plan whereby the services contemplated by this Agreement can be performed by Colbent on an alternative computer hardware and software system within forty-eight (48) hours if there is a catastrophic event that renders Colbent’s computer hardware and software system upon which the services are then being performed inoperable.

CONTRACTOR shall keep on file a detailed disaster plan containing complete written emergency procedures and operations in the event of a catastrophic occurrence such as, but not limited to, an earthquake, attack on Personnel and/or pupil, fire disaster, lockdown, intruder, bomb threat, medical emergencies and/or power outage. CONTRACTOR agrees to maintain and keep available for inspection by XXX or District representative a log containing the date, time, and length of all disaster drills completed between August 1st and July 31st during the current school year, as well as all disaster drills completed during the previous three (3) years.

Disaster Plan. Contractor shall have a plan for the immediate recall of personnel to staff units during multi-casualty situations, or declared disaster situations. This plan shall include the ability of the Contractor to page and alert off-duty personnel. The Contractor shall participate in training programs and exercises designed to upgrade, evaluate, and maintain readiness of the system’s disaster and multi-casualty response system.

1. APPLICABLE LAWS AND REGULATIONS
1.1 Contractor shall provide services in accordance with all applicable state and federal statutes and regulations, and case law, including but not limited to the federal Health Insurance Portability and Accountability Act (HIPAA), Title 42 of the Code of Federal Regulations, Title 9 of the California Code of Regulations as well as all future changes or amendments to each of the preceding, and in accordance with the State of California, Department of Health Care Services’ and County of Marin’s agreement to operate the Mental Health Plan (MHP) for Marin County per Welfare and Institutions Code sections 14680 through 14727.
1.2 Contractor will, in cooperation with County, comply with Section 14705.5 of California Welfare and Institutions Code and obtain a certification of patient's eligibility for mental health services under the California Medical Assistance Program.
1.3 Pursuant to Section 521 of the California Code of Regulations, Title 9, the Local Mental Health Director shall be permitted to supervise and specify the kind, quality, and amount of the services and criteria for determining the persons to be served under this Contract.

Boston Financial will maintain a disaster back-up plan whereby the services contemplated by this Agreement can be performed by Boston Financial on an alternative computer hardware and software system within forty-eight (48) hours if there is a catastrophic event that renders Boston Financial’s computer hardware and software system upon which the services are then being performed inoperable.
Disaster Plan. The parties shall comply with the provisions of the Disaster Plan.
