Eligibility for election. (a) Any of the following shall be eligible for election as an Owners’ Committee member under Clause 12.1(a) if he is resident in Hong Kong: (i) the Owner of a Unit if he is an individual; (ii) where a Unit is co-owned by more than one individual Owner, any one but not the other(s) of them; or (iii) where the Owner of a Unit is a body corporate, any representative appointed by such Owner. (b) The appointment of a representative by a corporate body shall be in writing addressed to the Owners’ Committee and may be revoked at any time on notice served on the Owners’ Committee. (c) If an Owner owns more than one Units he shall be entitled to propose more than one candidate (but limited to one candidate for each Unit) to be eligible for election as Owners’ Committee members. (d) Elected members of the Owners’ Committee are eligible for re-election.

Eligibility for election. 1. The employee must currently have full time employment status and have had full time employment status for the four preceding school terms with the District. 2. An employee must have twelve (12) continuous years of employment within the District. 3. The employee must submit, in writing, to the superintendent or business official on or before March 1 of the current contract year a letter of resignation and notice of intent to elect the benefits under this provision. 4. A staff member who has received notice of the district's intention to non-renew the employee's contract (except in the case of staff reduction) or when termination proceedings have been initiated by the district pursuant to SDCL 13-43-15 is not eligible to receive benefits under this policy. An employee whose position is eliminated due to staff reduction and who elects to receive benefits under this provision waives all recall rights under the recall policy. 5. The earliest age that early retirement can be taken after twelve (12) years of continuous employment is age fifty-five (55) as of March 1, the date by which the employee's notice of intent to elect benefits and letter of resignation is required. A four (4)-member Sick Leave Bank Review Committee, consisting of two (2) members appointed by the President of the Association and two (2) appointed by the Superintendent, shall have the responsibility of receiving requests, verifying the validity of requests and approval or denial of requests. Any approval of a request must have the support of at least three (3) members of the committee Sick Leave Bank Review Committee. The Sick Leave Bank Review Committee shall develop its rules of procedure and shall give wide distribution to said rules upon approval of the President of the Association and the Superintendent.
