ELIGIBILITY OFFERING. For a period of 90 days from the Effective Date of this Agreement or from the date of approval by the Department of Housing and Community Affairs (DHCA) of other marketing methods, the County has a preferential offering period (Priority Marketing Period) within which to make the MPDUs available to households on the County's MPDU eligibility list (Eligible Purchasers). Those Eligible Purchasers who choose to contract for an MPDU are required to turn in their MPDU eligibility certificates to the Applicant or his/her agent at the time of contracting for the purchase of the Property. The Priority Marketing Period will be automatically extended at the conclusion of the first 90-day Priority Marketing Period if there are MPDUs that have not been sold to Eligible Purchasers, unless DHCA determines that no additional Eligible Purchasers are available to buy the MPDUs. Any MPDU that has not been sold during the Priority Marketing Period, as extended, to an Eligible Purchaser may be offered by the Applicant for sale to non-income-eligible purchasers at the sales prices contained in this Agreement, but only upon prior written approval from DHCA. Prior to permitting the Applicant to sell the MPDUs to non-income eligible purchasers, in an effort to increase the pool of prospective Eligible Purchasers, DHCA in its discretion, may first increase the maximum income levels for prospective, Eligible Purchasers. If MPDUs are sold to non-income-eligible purchasers, those MPDUs, with the exception of the income restrictions for the purchasers, remain subject to the MPDU Covenants and Chapter 25A.

ELIGIBILITY OFFERING. In accordance with Chapter 13.5 of the Rockville City Code, for a period of 90 days from the date of the issuance of the Certificate of Occupancy for each phase, the MPDUs shall be marketed initially to MPDU-qualified persons, without regard to household or family composition, during a priority notification and marketing period conforming to the City's MPDU requirements. Schedule A shows the estimated date when each MPDU will first be made available for rent to eligible renters. The priority offering period may be extended as provided in Chapter 25A and in Paragraph 5, below. The Applicant is responsible for verifying for each prospective eligible renter: 1) the eligible renter’s household size and income; and 2) that the MPDU will be the prospective eligible renter’s primary residence. The Department does not maintain an MPDU renter eligibility list, so Applicant may rent MPDUs to eligible renters on a first-come, first-served basis.

The Priority Marketing Period may be extended as provided in Chapter 25A and in Paragraph 5, below. The Applicant is responsible for marketing the MPDUs, accepting rental applications, and determining that each prospective renter is eligible to rent an MPDU by certifying that: 1) the prospective renter’s household size and household income meet the household size and income requirements to be eligible to rent the MPDU; 2) the MPDU will be the prospective renter’s primary residence; and 3) the prospective renter has not owned residential property during the previous 5 years and has never owned an MPDU. DHCA does not maintain an MPDU renter eligibility list, so Applicant must rent MPDUs to Eligible Renters on a first-come, first-served basis. PHYSICAL DESCRIPTION OF INDIVIDUAL UNITS: The physical description of the MPDUs is provided in Schedule B, attached hereto. Applicant warrants and guarantees that each MPDU will conform, at the time of delivery by Applicant, to the minimum specifications for all MPDUs as required by DHCA. DHCA has the right to inspect the MPDUs to determine whether the Applicant has complied with the minimum specifications.

Those eligible persons who choose to contract for an MPDU are required to turn in their eligibility certificates to the Applicant or his/her agent at the time of contracting for the purchase of the property.
