Environmental and Social Performance. Unless MCC and the Government agree otherwise in writing, the Government agrees to ensure that all Projects and Activities undertaken, funded or otherwise supported in whole or in part (directly or indirectly) by MCC Funding under the Compact comply with the MCC Environmental Guidelines, including the environmental and social performance standards set forth in the Performance Standards on Environmental and Social Sustainability of the International Finance Corporation (as in effect from time to time, the “IFC Performance Standards”) that have been incorporated by reference into the MCC Environmental Guidelines. The Government also agrees to ensure that the Projects and Activities comply with all national environmental laws and regulations, licenses and permits, except to the extent such compliance would be inconsistent with the Compact. Unless MCC agrees otherwise in writing, the Government agrees to fund all necessary costs of environmental and social mitigation measures (including, without limitation, costs of resettlement) not specifically provided for, or that exceed the MCC Funding specifically allocated for such costs, in the Detailed Financial Plan for any Project or Activity.

Appropriate environmental and social assessment and mitigation measures and proper due diligence will be implemented in accordance with MCC Environmental Guidelines in order to ensure that these programs are well designed and will not result in adverse environmental health and safety impacts. Proposed investments should be assessed in broad terms to ensure that technical and environmental supporting infrastructure is in place for the investments, such as sufficient structural capacity and adequate electrical, gas, water supply and sanitation facilities. Based on the assessments, participating universities and Government agencies, as necessary, will develop and implement an environmental and social operations manual to ensure use of best practices regarding waste management, emergency preparedness, and occupational health and safety.

Environmental and Social Performance. According to MCC Environmental Guidelines, the ECG Financial and Operational Turnaround Project is likely to be considered a “Category B” project. The most likely environmental impacts arising from the ECG Financial and Operational Turnaround Project are (i) risks to worker health and safety in the construction and operation of distribution infrastructure and (ii) risks to community health and safety from construction and operation of distribution infrastructure. The social impacts that may be the most important are (i) involuntary resettlement (including economic or physical displacement, temporary or permanent) along rights of way for distribution lines or in the acquisition of new or expanded sites for bulk supply points or substations, and (ii) removal of unauthorized connections causing loss of access to electricity by paying customers with illegal connections. A Framework Environmental and Social Impact Assessment (“FESIA”) and an Environmental and Social Management Framework (“ESMF”) have been developed as part of the 609(g) Agreement to address the overall environmental and social issues associated with the rehabilitation of the distribution system; identify, screen and assess key risks; and propose appropriate measures to manage such risks and impacts. The ESMF focuses on qualitative impacts and general rules, regulations, and management and mitigation measures rather than on quantifying the impacts of site-specific interventions. In addition to the FESIA and ESMF, site specific ESIAs and/or ESMPs will be developed (as needed) when the precise project locations become known in order to assess and mitigate risks specific to those sites. A RPF has been undertaken as part of the 609(g) Agreement to lay the groundwork for later development of region and site-specific RAP to be developed under the Compact.

Belize also shall ensure that the Projects and Activities comply with all national environmental laws, regulations, licenses, and permits, except to the extent such compliance would be inconsistent with the Compact. Where there is a difference between national environmental laws and regulations and the standards required by the Compact, Belize shall ensure that the stricter standard is followed. Unless MCC approves otherwise in writing, Belize shall fund all costs of environmental and social mitigation measures necessary for the Program (including, without limitation, costs of resettlement) that are not specifically provided for in the Compact, or that exceed the amount of MCC Funding and/or Country Contribution specifically allocated for such costs for any Project or Activity.

Zambia shall also ensure that the Projects and Activities comply with all national environmental laws, regulations, licenses, and permits, except to the extent such compliance would be inconsistent with the Compact. Where there is a difference between national environmental laws and regulations and the standards required by the Compact, Zambia shall ensure that the stricter standard is followed. Unless MCC approves otherwise in writing, Zambia shall fund all costs of environmental and social mitigation measures necessary for the Program (including, without limitation, costs of resettlement) that are not specifically provided for in the Compact, or that exceed the amount of MCC Funding and/or the Country Contribution specifically allocated for such costs for any Project or Activity.
Environmental and Social Performance. In accordance with the MCC Environmental Guidelines, the Downstream Xxxxx Activity is categorized as a “Category A” activity in accordance with MCC Environmental Guidelines because it has the potential to have significant adverse environmental and social impacts that are sensitive and diverse, and may affect an area broader than the sites or facilities subject to physical works. The Wastewater Recycling Activity is categorized as a “Category B” activity because potential environmental and social impacts are generally site-specific, few if any of them are irreversible, and mitigation measures are more readily available. The Water Sector Sustainability Activity is categorized as a “Category C” activity because it is unlikely to have adverse environmental and social impacts.
Environmental and Social Performance. According to the MCC Environmental Guidelines, the Regulatory Strengthening and Capacity Building Project is considered a “Category C” project as the proposed activities are unlikely to have adverse environmental and social impacts.
