Excluded Equipment. Seller may discontinue providing services with respect to any hardware for which it can no longer readily obtain repair parts or technical assistance.
Excluded Equipment. Lessee may install in, and remove from, the Aircraft any Excluded Equipment, and in any such case, Lessor will not acquire or claim any right, title or interest in any such Excluded Equipment as a result of its installation on the Aircraft; provided that in connection with any removal of Excluded Equipment, Lessee shall repair any damage to the Aircraft caused by such removal and shall restore the applicable areas from which such Excluded Equipment was removed to a serviceable condition appropriate for commercial passenger service by Lessee.
Excluded Equipment. The Company (or any Permitted Lessee) may install in, and remove from, the Aircraft any Excluded Equipment, and in any such case, the Security Trustee will not acquire or claim any right, title or interest in any such Excluded Equipment as a result of its installation on the Aircraft; provided that in connection with any removal of Excluded Equipment, the Company (or such Permitted Lessee) shall repair any damage to the Aircraft caused by such removal and shall restore the applicable areas from which such Excluded Equipment was removed to a serviceable condition appropriate for commercial passenger service by the Company (or such Permitted Lessee).
Excluded Equipment. 1. Equipment which is airborne or waterborne, other than equipment permanently located on ferries operated in connection with railways or on public ferries operating on scheduled routes.
2. Equipment used in mining, logging, timber felling and processing or oil or gas exploration or processing, other than equipment located and used in enclosed buildings whose use is incidental to activities in these industries.
3. Liability Insurance - Please note that this Asset Protection Cover does not provide cover for any liability arising out of the ownership or use of the insured equipment.
Excluded Equipment. (a) Customer and Christie shall not have any obligation under Section 9.2 with respect to any 35mm System which, if sold by Customer to Christie for a purchase price of $1.00, would result in a loss to Customer for accounting purposes based upon Customer's then existing book value for such system.
(b) Customer shall have the right to retain three (3) deinstalled 35mm Systems at each Service Site. Customer shall, to the extent reasonably possible, select for such purposes only 35mm Systems which, if sold by Customer to Christie for a purchase price of $1.00, would result in a loss to Customer for accounting purposes, and which at the time of deinstallation have a book value in excess of $2500.
Excluded Equipment. The Assets do not include the following: (a) Leased Equipment. The equipment listed in Schedule 1.2, is leased by the Sellers (the "Leased Equipment"). Sellers will assign to the Buyers, and the Buyers will assume, the leases (the "Equipment Leases") on the Leased Equipment, to the extent such Equipment Leases are not "Excluded Liabilities" as provided in Section 1.8. (b)
Excluded Equipment. The items listed on Exhibit F including, without limitation, all furniture, trade fixtures, satellite communications dish and equipment, racks, servers, routers, computer and other similar moveable equipment in all cases existing at the Premises as of the Lease Commencement Date or brought onto the Premises after the Lease Commencement Date by Lessee, its subtenants and/or Lessee’s customers and any Lessee Owned Alterations installed by Lessee at its cost and all replacements thereof but specifically excluding any Additional Data Center Fixtures.
Excluded Equipment. The assignment, conveyance and transfer described in Section 1 shall not include the following items, and LYNX hereby agrees to remove the following items from the Buses at its sole cost and expense:
(a) all fare boxes and stands; and
(b) all video surveillance system equipment
Excluded Equipment. Unless otherwise agreed by MGPI and the Company, MGPI shall be entitled to store the Excluded Equipment rent-free in its current location at the Plant until the later of (but no event longer than three years from the Closing Date): (i) the first anniversary of this Agreement; and (ii) the Company securing a commercial use of the Plant space where such Excluded Equipment is currently stored. MGPI shall be entitled to enter the Plant during normal business hours and with reasonable prior notice to maintain and remove the Excluded Equipment.
Excluded Equipment. At DataCom's request and after Itron's agreement, which will not be unreasonably withheld, Itron shall make commercially reasonable efforts to provide Services at a commercially reasonable price for any Excluded Equipment.
