FEE MODEL. The Work Order will contain fee and payment terms. The following fee models are contemplated: Model Name Definition Fixed Fee ImageTrend shall perform the work outlined in the Work Order for a fixed flat fee, plus Expenses. The Fixed Fee is exclusive of Expenses unless the Work Order outlines the Expenses. The Fixed Fee model may include milestone payments, with such milestone payments outlined in the Work Order. Time and Materials ImageTrend shall perform the work outlined in the Work Order on a Time and Materials basis, at the rate(s) specified in the Work Order. LEGAL EFFECT. Work Orders issued under this Master Services Agreement are incorporated by reference into this Master Services Agreement which collectively is called “the Agreement.” Work Orders do not override the terms of this Master Services Agreement unless specifically stated that they do so. Work Orders may contain their own Fee/Payment Schedules and Payment Terms; those terms are binding insofar as they concern the services or Deliverables contemplated by the Work Order. For Work Orders without their own fee and payment terms, the payment terms in the Price Sheet and Work Order Attachment below control.

FEE MODEL. 6.1 The FRONIUS WeldCube Premium software will be made available to the User in its capacity as the licensee, and transferred for use (licensed), not sold. The User shall receive the non-transferrable, exclusive right to use FRONIUS WeldCube Premium in accordance with these Terms of Use. The licensor shall retain all other rights to FRONIUS WeldCube Premium.

  • License Model The software is licensed under two models: • Perpetual License Model – Under this model, you have licensed the software under perpetual license terms, as code that is installed on your premises or hosted for you by a third party acting as your agent (“Perpetual License Model”).

  • Methodology 1. The price at which the Assuming Institution sells or disposes of Qualified Financial Contracts will be deemed to be the fair market value of such contracts, if such sale or disposition occurs at prevailing market rates within a predefined timetable as agreed upon by the Assuming Institution and the Receiver.

  • Alternate Work Schedule An alternate work schedule is any work schedule where an employee is regularly scheduled to work five (5) days per week, but the employee’s regularly scheduled two (2) days off are NOT Saturday and Sunday.

  • Master Schedule At the start of the schematic design phase, the Construction Administrator will be given a copy of the updated DAS initial schedule as described in the pre-design phase. The Construction Administrator will then create its master schedule based on the DAS’ initial schedule. Utilizing CPM-based software, the Construction Administrator will assign a duration and relationship to each task, add or delete tasks, identify the logic of interrelationships and milestones, and perform schedule management activities to identify the project's critical path and timeline. The master schedule shall include all tasks from the pre-design phase through design, construction, and project closeout. Items to be identified during subsequent refinements include milestones for departmental occupancy, shop drawing and Construction Administrator reviews, special support services, mobilization and demobilization, long lead item purchases, and float times.

  • Flexible Work Schedule A flexible work schedule is any schedule that is not a regular, alternate, 9/80, or 4/10 work schedule and where the employee is not scheduled to work more than 40 hours in the "workweek" as defined in Subsections F. and H., below.
