FIREARMS PROFICIENCY Clause Samples
The FIREARMS PROFICIENCY clause establishes the requirement for individuals to demonstrate a certain level of skill and competence in handling firearms. Typically, this clause applies to employees or contractors in roles where carrying or using firearms is necessary, such as security personnel or law enforcement officers, and may require regular training sessions or certification to maintain proficiency. Its core practical function is to ensure safety and compliance by verifying that only qualified individuals are authorized to use firearms, thereby reducing the risk of accidents or misuse.
FIREARMS PROFICIENCY. 42.01. Every member who is required to carry a firearm will be paid two hundred dollars ($200.00) per year for successful completion of a firearms proficiency program devised by the ▇▇▇▇▇▇▇▇ Heights Chief of Police, which will include qualification on all department weaponry, and attendance through the year at all required sessions at the appropriate shooting range with no more than one (1) excused absence. The qualifications developed by the Chief will exceed the requirements for certification adopted by the attorney general with regard to firearms proficiency as required by O.R.C. §§109.743 and 109.801. 42.02. In order to receive compensation under this Article, all requirements must be complete by December 31st of the qualifying year and the members will be permitted the same number of opportunities to qualify as are permitted by the program developed by the Ohio Peace Officer Training Commission under O.R.C. §109.801. 42.03. Members will be paid for successful completion of the program set forth in Section 42.02 in January following the year all qualifications are met.
FIREARMS PROFICIENCY. Police officers covered under this Agreement shall be required to pass a firearm- qualification-courses determined by MCOLES. Said qualification shall evaluate the officer’s proficiency with firearms authorized for carry by the Employer. Qualifications shall take place annually. The Employer shall supply all required ammunition.
FIREARMS PROFICIENCY. Officers shall meet firearms proficiency and marksmanship standards of the Massachusetts Criminal Justice Training Council. Failure to meet the standards shall constitute just cause under Article IIIA for disciplinary action by the Town; provided, however, all officers shall have an adequate opportunity for prior training or retraining prior to any final firearm proficiency test. If firearms training is scheduled by the Department when officers are off duty, such training shall be subject to Section 5 of Article 16.
FIREARMS PROFICIENCY. Officers shall meet such reasonable firearms proficiency and marksmanship standards as may be established by the Chief of Police. Such standards shall be a condition of employment, and failure to meet the standards shall be just cause under Article 5; provided however, all officers shall have an adequate opportunity for prior training or retraining prior to any final firearm proficiency test. If the Criminal Justice Training Council Fire Arms Proficiency Standards are available, the Chief will apply those Standards under this Article.
FIREARMS PROFICIENCY. A. Officers will be issued Firearms Proficiency Awards in compliance with our Uniform Regulations under 21.473 Firearms Proficiency awards.
B. Based on the overall staffing needs of the department, represented members will be offered 2 hours each month of on duty time and up to 100 rounds of ammunition to practice in order to maintain their firearms proficiency skills. The two hours of duty time shall not apply during months in which the represented members are attending mandatory firearms related training or qualifications.
1. If there is an ammunition shortage, the department can temporarily suspend issuing the 100 rounds of practice ammunition. However, when the department receives a re-supply, they will make the member whole for whatever rounds they did not receive during the suspension.
C. By the first of the month, represented members will notify their immediate supervisor of their desire to be scheduled for 2 hours at the range during the month and to obtain up to 100 rounds of ammunition. The supervisor will notify the represented member at least a week in advance when they are scheduled at the range for their 2 hours of practice.
D. The department will offer all represented members a light that can be mounted on their department issued firearm and include issuing a duty holster that is authorized to work with the firearm with the mounted light.
FIREARMS PROFICIENCY. Section 28.1 All sworn police officers shall be required to comply with the firearms proficiency requirements established by the State of Ohio for a police officer.
Section 28.2 Employees will not be entitled to any additional annual compensation for complying with the firearms proficiency requirements established by the State of Ohio for a police officer for the duration of this agreement.
FIREARMS PROFICIENCY. All bargaining unit members shall meet firearms proficiency and marksmanship standards that are consistent with the Municipal Police Training Committee. Such standards shall be a condition of employment. Officers who fail the firearms testing shall be given 8 hours of training and shall be supplied with ammunition for such training and re-test. If the Officer fails the second testing, he/she shall be placed on administrative leave with pay for five (5) days, at the end of which time he/she shall be re-tested for a final time. If the officer fails the third and final firearms proficiency testing, he shall be subject to discipline, up to and including dismissal.
FIREARMS PROFICIENCY. Employees covered under this Agreement shall be required to pass a firearms qualification course determined by the Employer. FIREARMS PROFICIENCY. The Chief may establish firearms proficiency/marksmanship standards for the Department. It is hereby agreed that prior to establishing such firearms proficiency/marksmanship standard, the Chief of Police will consult with the Union and will post written notices regarding these standards which standards must be reasonable. An officer who fails to qualify in the use of firearms shall take an unpaid leave of absence until such time as he or she is able to qualify.
