2. During the transitional phase referred to in Article 8, Switzerland also undertakes, in accordance with Title II of the 1992 Agreement, to establish an accompanied combined transport (“truck on train”) capability which is competitive in quality and price terms with road transport.
3. The Contracting Parties shall do everything necessary to promote combined transport. In particular, they shall take steps to ensure that the following provisions are applied: - compliance with the regulations governing technical and social standards for road transport, notably as regards driving time and rest periods, speed limits and maximum weight and dimension standards; - reduction of rail transport frontier controls and transfer of these controls to the point of embarkation or disembarkation in accordance with the Convention of 20 May 1987 between the Community and Switzerland and between the EFTA countries on a common transit procedure; - facilitation of the organisation of the combined transport chain by simplifying the regulatory and administrative conditions governing each of the Contracting Parties; - provision of incentives to combined transport operators and railway operators to improve the quality of their service. A list of railway parameters is set out in Annex 9. These parameters shall be taken into consideration when invoking Article 46.
4. Within the scope of their powers, the Contracting Parties shall ensure that appropriate measures are taken to permit the swift creation of rail freight corridors. They shall keep each other regularly informed of any measures they propose to take in relation to these rail corridors.
5. The Joint Committee shall prepare a report every two years on the implementation of the measures referred to in this Article.
Quality parameters. 3.1 The SUPPLIER at its expense, shall supply Products in accordance with good manufacturing practices aand in compliance with BUYER specifications and drawings and quality assurance requirements as provided by the Buyer to the Supplier. The Produts shall be accepted by the Buyer are subject to inspection and acceptanc at BUYER’s location not withstanding any prior payment made by the Buyer for the the Products. The Rejected Products shall be held or returned at Supplier’s risk and expenses. The Supplier specifically agrees to pay the BUYER all such costs related to rejection of Products restricted to Products supplied by SUPPLER. The SUPPLIER agrees to provide the Buyer with advance written notice of any product or process change or of any change in production site and shall not implement such change untill approved in writing by BUYER. The SUPPLIER shall also inform the Buyer of any deviations in the product and shall not deliver such product before prior written approval from the Buyer The Buyer or its affiliates may, from time to time inspect and audit the operations of SUPPLIER or its subcontractors.
3.2 Test certificate/inspection approval report is to be furnished by the SUPPLIER for each Product / lot as well as with initial sample.

Quality parameters. (A) SUPPLIER, at its own expense and cost, shall supply products in accordance with good manufacturing / industry practice and in compliance with BUYER specifications and drawings and quality assurance requirements. Products are subject to inspection and acceptance at BUYER’s location notwithstanding any prior payment. Non-confirming products will be held or returned at supplier’s risk and expense. SUPPLIER specifically agrees to pay buyer all costs related to rejection of products restricted to components supplied by Supplier. Supplier agrees to provide the Buyer with advance written notice of any product and shall not deliver such product before obtaining written approval from the Buyer. The Buyer or its representative , may from time to time, audit the operation of supplier or its subcontractors.
(B) Test certificate/inspection approval report shall be furnished by the Supplier for each lot as well as for the initial sample.
(C) Wherever, necessary, the Buyer’s representative shall be afforded the right to verify at source, that the purchased product confirms the specified requirements. Verification by the Buyer shall not absolve the Supplier of its responsibility to provide acceptable product as specified in this Purchase Order or any other document nor shall it preclude its subsequent rejection by the Buyer. The Buyer’s representative to carryout verification at the supplier plant, shall not be used by the supplier as evidence of effective control of quality.
(D) If the material supplied is not as per the buyers specification and due to urgency, the material is rectified in the works as covered under our inspection report, rectification charges incurred by the buyer shall be recovered from the supplier. The Buyer shall be the sole judge for deciding the rectification charges to be borne by the Seller. However the Buyer shall be free to reject the goods, if not rectified to meet its own specifications. The material used by the supplier for the manufacture must confirm to the chemical composition of the specification and be capable of giving the required mechanized properties.
