General Sign Up. The Company shall hold a general sign up in the months of June, September and either January or February of each year. a. m. with the next operator entitled to bid and the same procedure carried out. The bidding shall stop at 7:00 p.m. For the Fall bid, operators will be allowed twelve (12) minutes each to bid. For all other bids, operators will be allowed eight (8) minutes to bid. At the regular bids, the Company will post, in addition to regular runs, charter board positions and extra board positions, all vacation hold-down positions. The hold-down will include the regular run and tripper (if any) held by a regular operator. Each operator will choose in his/her seniority order at the time of the regular bid among the available regular runs, charter board positions, extra board positions and vacation hold-down positions. All vacation hold-down positions must be bid. After all the posted vacation hold-down positions have been selected, the operators on the vacation hold-down list will select in seniority order the vacation regular runs they will work during the period of the bid. A vacation hold-down operator will have the days off in each week which go with the vacation runs they bid for each week. All vacation hold- downs will be posted for full weeks only. The number of vacation hold-down positions may vary during the period of the bid. This will be designated when the vacation hold-down positions are posted for bid. When the number of vacation hold-downs is reduced for a portion of the bid period, the operators not needed for vacation hold- downs shall, on the basis of seniority choice, revert to the extra board and will take their positions on the extra board. When a vacation hold-down operator reverts to the extra board, he/she shall have Saturday and Sunday as his/her days off. The procedure may be changed by mutual agreement between the Company and the Union.
General Sign Up. The RTA shall hold a general sign up one or more times each year. At a time seven (7) calendar days before a general sign up, the RTA shall make available to the Bus Operators all runs to be bid. An individual page for each posted run shall show the start time of the run, end time, pay time, posting date, run and route designations, schedule hours, days of the week and whether it is full-time or part-time run. The actual bidding shall start on the eighth (8th) day after posting and shall continue each day thereafter, excluding holidays, in the manner described below until the bidding is completed. A full-time employee seniority list and a part-time employee seniority list shall be posted showing the order in which operators shall choose their run. It shall be the responsibility of each operator to bid at the designated time he/she is to bid or to leave a proxy statement with the employee’s most desirable as the number one proxy and so on. The RTA-designated Bid Administrator shall ensure that each operator turn in a bid slip, dated and signed. The employee shall receive a copy of their bid slip upon completion of their bid. As explained in Section 5 of Article 16 Seniority, if other transit agencies consolidate with RTA, both a “Primary RTA Seniority” list and a “Secondary RTA Consolidation Seniority” list will be developed for the first year of consolidation. In addition, a separate set of full time and part time bids for the newly consolidated services will be posted seven (7) calendar days before bidding begins for the runs that are exclusively dedicated to the newly consolidated service. Only Bus Operators on the “Secondary RTA Consolidation Seniority” list may bid on runs in the newly consolidated services. If a newly consolidated run is vacated during a bid, employees on the “Secondary RTA Consolidation Seniority” list will have the first opportunity to fill the vacated run. The procedure may be changed by mutual agreement between the RTA and the Union.
General Sign Up. (a) There shall be 3 general sign-ups each year at each site: ● Winter (beginning in January) ● Summer (beginning in May) ● Fall (beginning in September) Sign-up dates will be set for the upcoming year, in consultation with the Union, prior to posting of the next year’s vacation. One (1) additional general sign-up may be created by mutual agreement of the parties. (b) A sign-up in the signing process shall be referred to as the approaching sign-up. A sign-up that is in service shall be referred to as the current sign-up. (c) The regular sign up shall be posted eight (8) weeks in advance of the effective date, unless otherwise agreed by the Commission and the Union. Employees shall begin signing Monday of the seventh (7th) week preceding the effective date of the schedule. (d) Each employee shall be allotted thirty (30) minutes to sign. The first employee listed to sign on a specific date shall be allowed 7:00am-7:30am, second 7:30am-8:00am, and then in half-hour intervals until 6:30pm-7:00pm, to a maximum of twenty-four (24) employees per day. Signing will take place Monday to Friday, excluding statutory holidays. (e) Should an employee be working during their signing slot time, the Commission will send another employee to have the signing employee relieved so they can review the sign-up and sign their choice of assignment. (f) Should an employee fail to sign in their allotted time, their name shall be bypassed and a selection shall be made from the remaining unsigned work when they report to sign. (g) If an employee is to be absent during the signing of the sign-up, they shall leave a written choice of assignments with the on-duty or dispatch supervisor on a form provided by the Commission. When it becomes their turn to sign, their selection shall be made by a Commission representative, in accordance with assignments open and choice of assignments made. (h) An employee who signs an assignment, unless displaced in the application of seniority rules, shall remain on such assignment until the next regular sign-up, unless mutually agreed upon between the Commission and the Union. (i) There shall be no reduction in the number of assignments or hours of assignments during any current sign-up or after the approaching sign-up has been posted. Changes in assignments shall be discussed with the Union prior to going into effect.
General Sign Up. (a) There shall be two (2) general sign-ups per year for all maintenance employees. The first sign-up will commence on the first Sunday in April, and the second will commence on the first Sunday in October. (b) A shift sign-up for each job classification will be posted at each Maintenance site six (6) weeks prior to the sign-up start date, and signing will begin five (5) weeks prior to the sign-up start date. (c) One (1) day, excluding Saturday, Sunday, and statutory holidays will be allotted to each employee for the purpose of signing, according to seniority. An employee may call in their selections if they are on vacation, floater or lieu day, or off due to unforeseen circumstances, to their immediate supervisor or Union representative. An employee may be bypassed if they have not made their selection by 11:59pm on their assigned day. A bypassed employee may make their selection any time after being bypassed.

  • Construction of Tenant Improvements Promptly following approval of the Final TI Working Drawings, Landlord shall apply for and use reasonable efforts to obtain the necessary permits and approvals to allow construction of Landlord’s TI Work. Upon receipt of such permits and approvals, Landlord shall, at Tenant’s expense (subject to the application of the Tenant Improvement Allowance provided in this Workletter, and subject to any other applicable provisions of the Lease or of this Workletter expressly making any specific item of expense or cost the responsibility of Landlord), diligently construct and complete Landlord’s TI Work substantially in accordance with the Approved TI Plans, subject to Unavoidable Delays and Tenant Delays (if any). Such construction shall be performed in a good and workmanlike manner and shall conform to all applicable governmental codes, laws and regulations in force at the time such work is completed. Without limiting the generality of the foregoing, Landlord shall be responsible for compliance of Landlord’s TI Work with the requirements of the Americans with Disabilities Act and all similar or related requirements pertaining to access by persons with disabilities, but nothing in this sentence shall be construed to make Landlord responsible for bearing the cost of any such compliance, to the extent the compliance work is reasonably attributable to or related to the particular nature or design of the Tenant Improvements or is for any other reason expressly made Tenant’s cost or responsibility under any applicable provision of the Lease or of this Workletter. Landlord shall have the right, in its sole discretion, to decide whether and to what extent to use union labor on or in connection with Landlord’s Work, and shall use the TI General Contractor to construct all of Landlord’s TI Work. Landlord and Tenant shall each have a right to approve all subcontractors engaged in connection with the construction of the Tenant Improvements and to review and approve all competitive bids for any elements of the Tenant Improvements, such approval in each instance not to be unreasonably withheld, conditioned or delayed by either party.

  • Exclusive Use (A) After the Occupancy Date, Lessee expressly agrees and warrants that the Leased Premises will be used exclusively as a Champps Restaurant or other casual dining sit-down restaurant. In any other such case, after obtaining Lessor's prior written consent, such consent not to be unreasonably withheld or delayed, Lessee may conduct any lawful business from the Leased Premises. Lessee acknowledges and agrees that any other use without the prior written consent of Lessor will constitute a default under and a violation and breach of this Lease. Lessee agrees: To open for business within a reasonable period of time after completion of construction of the contemplated Improvements; to operate all of the Leased Premises during the Term or Renewal Terms during regular and customary hours for businesses similar to the permitted exclusive use stated herein, unless prevented from doing so by causes beyond Lessee's control or due to remodeling; and to conduct its business in a professional and reputable manner. (B) If the Leased Premises are not operated as a Champps Restaurant or other casual dining sit-down restaurant or other permitted use hereunder, or remain closed for thirty (30) consecutive days (unless such closure results from reasons beyond Lessee's reasonable control) and in the event Lessee fails to pay Rent when due or fulfill any other obligation hereunder, then Lessee shall be in default hereunder and Lessor may, at its option, cancel this Lease by giving written notice to Lessee or exercise any other right or remedy that Lessor may have; provided, however, that closings shall be reasonably permitted for replacement of trade fixtures or during periods of repair after destruction or due to remodeling.

  • NO HARDSTOP/PASSIVE LICENSE MONITORING Unless an Authorized User is otherwise specifically advised to the contrary in writing at the time of order and prior to purchase, Contractor hereby warrants and represents that the Product and all Upgrades do not and will not contain any computer code that would disable the Product or Upgrades or impair in any way its operation based on the elapsing of a period of time, exceeding an authorized number of copies, advancement to a particular date or other numeral, or other similar self-destruct mechanisms (sometimes referred to as “time bombs,” “time locks,” or “drop dead” devices) or that would permit Contractor to access the Product to cause such disablement or impairment (sometimes referred to as a “trap door” device). Contractor agrees that in the event of a breach or alleged breach of this provision that Authorized User shall not have an adequate remedy at law, including monetary damages, and that Authorized User shall consequently be entitled to seek a temporary restraining order, injunction, or other form of equitable relief against the continuance of such breach, in addition to any and all remedies to which Authorized User shall be entitled.

  • THE ACADEMY The Academy is a Mainstream Academy as defined in clause 1.4 of the Master Agreement.

Tenant agrees to keep the premises clean, sanitary and in good order, and agrees not to hamper, disturb or interfere with other tenants in the building or apartment, not to create or suffer any nuisances in the premises affecting the rights of others, and agrees to comply with all laws, ordinances, rules, regulations and directions of governmental authorities. Upon termination of this Lease, Tenant agrees to surrender possession in as good condition and repair as when received, ordinary wear and tear accepted.
