Handling Congestion. If the Transfer Capacity of a Point of Entry or a Point of Exit that is to be committed following: a) an application by a User for signing a Transfer Contract in accordance with the provisions of article 1.7 hereof, on condition that this is an existing Point of Exit or b) the application lodged by a User for signing a Preliminary Contract for Committing ESFA Transfer Capacity, in accordance with the provisions of article 1.5 hereof, exceeds 2/3 of the Transfer Capacity to be Delivered or Received at this particular Point of Entry or Exit respectively, the Operator shall announce the existence of congestion in respect of that Point and shall immediately notify RAE of the possibility of congestion at this particular Point of Entry or Exit. In order to make the matter immediately known, details concerning the capacity of the Point of Entry or Exit that may be congested shall be posted on the Operator’s Electronic Information System, as well as the actions that must be taken concerning additional Maintenance or investment in order to increase the Transfer Capacity to be Delivered or Received at the respective Point of Entry or Exit accordingly, in the context of ESFA Development Project as described in Chapter 12 hereof. If there is congestion after two or more Users / Third Parties express their interest for signing a Contract of Preliminary Commitment of ESFA Transfer Capacity (see article 1.5) or for signing a Transfer Contract (see article 1.7), the Operator shall be able to offer the Users the option of entering into Contracts for the commitment of Intermittent Transfer Capacity in addition to the options included in article 1.6 hereof concerning Contracts of Voluntary Cut. In particular, if the Operator is not able to satisfy the request of the User / Third Party for commitment of Transfer Capacity at a Point of Exit in order to service a new customer and the Operator’s inability to do so is not due to the Transfer Capacity that is available at that Point of Exit but is the result of other reasons that are concerned with the upstream capacity of the Transfer System at the Point of Entry that was stated by the User /Third Party, the Operator may propose to the User /Third Party to commit Transfer Capacity at the relevant Point of Exit by also committing Transfer Capacity at particular Points of Entry in order to combat congestion.   • Access Toll Connecting Trunk Group Architecture 9.2.1 If CSTC chooses to subtend a Verizon access Tandem, CSTC’s NPA/NXX must be assigned by CSTC to subtend the same Verizon access Tandem that a Verizon NPA/NXX serving the same Rate Center Area subtends as identified in the LERG. 9.2.2 CSTC shall establish Access Toll Connecting Trunks pursuant to applicable access Tariffs by which it will provide Switched Exchange Access Services to Interexchange Carriers to enable such Interexchange Carriers to originate and terminate traffic to and from CSTC’s Customers. 9.2.3 The Access Toll Connecting Trunks shall be two-way trunks. Such trunks shall connect the End Office CSTC utilizes to provide Telephone Exchange Service and Switched Exchange Access to its Customers in a given LATA to the access Tandem(s) Verizon utilizes to provide Exchange Access in such LATA. 9.2.4 Access Toll Connecting Trunks shall be used solely for the transmission and routing of Exchange Access to allow CSTC’s Customers to connect to or be connected to the interexchange trunks of any Interexchange Carrier which is connected to a Verizon access Tandem.

  • Handling In order to protect such Confidential Information from improper disclosure, each Party agrees: (a) That all Confidential Information shall be and shall remain the exclusive property of the source; (b) To limit access to such Confidential Information to authorized employees who have a need to know the Confidential Information for performance of this Agreement; (c) To keep such Confidential Information confidential and to use the same level of care to prevent disclosure or unauthorized use of the received Confidential Information as it exercises in protecting its own Confidential Information of a similar nature; (d) Not to copy, publish, or disclose such Confidential Information to others or authorize anyone else to copy, publish, or disclose such Confidential Information to others without the prior written approval of the source; (e) To return promptly any copies of such Confidential Information to the source at its request; and (f) To use such Confidential Information only for purposes of fulfilling work or services performed hereunder and for other purposes only upon such terms as may be agreed upon between the Parties in writing.

  • Loading RPMG shall schedule the loading and shipping of all outbound corn oil purchased hereunder, but all labor and equipment necessary to load trucks and rail cars and other associated costs shall be supplied and borne by Producer without charge to RPMG. Producer shall handle the corn oil in a good and workmanlike manner in accordance with RPMG’s written requirements and normal industry practice. Producer shall maintain the truck and rail loading facilities in safe operating condition in accordance with normal industry standards and shall visually inspect all trucks and rail cars to assure (i) cleanliness so as to avoid contamination, and (ii) that such trucks and railcars are in a condition suitable for transporting the corn oil. RPMG and RPMG’s agents shall have adequate access to the Ethanol Facility to load Producer’s corn oil on an industry standard basis that allows RPMG to economically market Producer’s corn oil. RPMG’s employees shall follow all reasonable safety rules and procedures promulgated by Producer and provided to RPMG reasonably in advance and in writing. Producer shall supply product description tags, certificates of analysis, bills of lading and/or material safety data sheets that are applicable to all shipments. In the event that Producer fails to provide the labor, equipment and facilities necessary to meet RPMG’s loading schedule, Producer shall be responsible for all costs and expenses, including without limitation actual demurrage and wait time, incurred by RPMG resulting from or arising in connection with Producer’s failure to do so.

  • DELIVERY, STORAGE, AND HANDLING The Contractor shall be responsible to inspect all components on delivery to ensure that no damage occurred during shipping or handling for furnish and installation projects. For equipment only purchases, the ordering entity shall be responsible to inspect all components on delivery. Materials must be stored in original undamaged packaging in such a manner to ensure proper ventilation and drainage, and to protect against damage, weather, vandalism, and theft until ready for installation.

  • Metering The Interconnection Customer shall be responsible for the Connecting Transmission Owner’s reasonable and necessary cost for the purchase, installation, operation, maintenance, testing, repair, and replacement of metering and data acquisition equipment specified in Attachments 2 and 3 of this Agreement. The Interconnection Customer’s metering (and data acquisition, as required) equipment shall conform to applicable industry rules and Operating Requirements.

  • Transportation Transportation expenses include, but are not limited to, airplane, train, bus, taxi fares, rental cars, parking, mileage reimbursement, and tolls that are reasonably and necessarily incurred as a result of conducting State business. Each State agency shall determine the necessity for travel, and the mode of travel to be reimbursed.

  • System Logging The system must maintain an automated audit trail which can 20 identify the user or system process which initiates a request for PHI COUNTY discloses to 21 CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY, 22 or which alters such PHI. The audit trail must be date and time stamped, must log both successful and 23 failed accesses, must be read only, and must be restricted to authorized users.
