Holidays, except. (1) Where, after mutual agreement, the employee is compensated at the employee's regular rate of pay for a holiday which occurs on an employee's day off in lieu of granting paid time off. (2) Where, after mutual agreement, the employee is compensated at the employee's regular rate of pay in lieu of granting paid time off earned as a result of working a holiday.
