(a) It is the University’s management right to determine hours of work as the University deems appropriate and the provisions of this article are intended only to pro- vide a twentybasis for calculating time worked. Another "shift" work schedule for Time Category A salaried employees shall be fortythirty-eight five (4835) hours of assigned duty followed by ninety-six (96) hours off; and the workweek for that classification shall consist of an average of fifty-six (56) per week from Labour Day through to June 30. The regular hours of work for Full-Time Category A salaried em- ployees from July 1 through to Labour Day shall be thirty (30) hours per week over a twentyweek, with no afternoon break. The regular hours of work for all Full-eight (28) day period, including paid rest and meal periods. Another "shift" work schedule for Time Category A hourly employees shall be a standard forty (40) hour workweek consisting hours per week. The regular hours of eightwork for Full-hour days over a five-day period. Another "shift" work schedule Time Category B hourly employees shall be between twenty-five (25) and thirty-nine (39) hours per week, inclusive. The regular hours of work for Full-Time Category B salaried employees shall be between twenty-five (25) and thirty-four (34) hours per week, inclusive. The regular hours of work for part-time employees shall be 24 hours or less per week. For clarity an eleven employee may, on occasion, be offered the opportunity to work additional hours beyond their regular hours per week, on a straight time basis, sub- ject to overtime provisions according to Article 25, if applicable. Salaried employees are entitled to one (111) hour lunch break without pay, approximately midway through a work day, and a fifteen (15) minute break at an appro- priate time during the first and second half of a work day. Hourly-paid employees are entitled to a half (1/2) hour lunch break without pay, approximately midway through a work day, and a fifteen (15) minute break at an appropriate time during the first and second half of a work day. Part-time employees will receive a fifteen (15) minute paid break for every three (3) consecutive hours worked, except in cases where the employees work a full day, in which case they shall receive the same lunch and breaks as full-time staff appointed employees. In establishing shift schedules, the University agrees that it will not schedule regular straight time shifts more than five (5) consecutive days per week and will provide for two (2) consecutive days of rest. Variations to this provision may be made by mutual agreement be- tween the employee and the University. The University agrees to maintain the status quo with respect to shift premiums.
(b) The Employer retains the right to develop shift rotation schedules. Actual shift schedules to be worked will be posted one week in advance. Where practicable, em- ployees in the same job function will be assigned shifts in the shift rotation schedule based on the seniority and preference of the employee when the Employer de- velops new shift rotation schedules.
(c) Where possible, the University will provide a minimum of one (1) months’ notice of a change in an employee’s regular hours of work. This notice will not be possible where schedules must be modified in response to the University’s business requirements, for example con- ferences, events, functions and authorized leave cover- age. This article shall not apply to employees in House- keeping and Food Services from May 1st to August 31st inclusive.
25.03 All authorized work performed in excess of eight (8) hours in a day working a total or forty (40) hours per week for hourly employees and all authorized work performed in excess of five days during a seven (7) hours in a day period or thirty-five (Monday through Friday) and the workweek for that classification shall consist of an average of fifty-six (5635) hours of work per week over a twenty- eight (28) day periodfor salaried employ- ees, including will be paid rest and meal periods. (b) time and one half the Employee’s regular rate for all hours worked on any day that is not a twentyregularly scheduled work day, provided the employee has worked all his/her regularly scheduled hours in that work week; or
(c) two times the Employee’s regular rate for all hours worked on Sunday, provided the employee has worked all his/her regularly scheduled hours in that work week.
10.05 To the extent that hours are compensated for at overtime rates under one provision they will not be counted as hours worked in determining overtime under the same or any other provision.
10.06 The Company will set aside and allow two ten-minute rest periods, one in each half shift. These rest periods will start and finish at the respective work stations of employees.
10.07 A three-minute clean-up and wash-up period will be permitted at three minutes before quitting time of each half shift. It is understood and agreed that the work station of each employee will be cleaned up by the employee in the allotted three minutes before the employee washes up.
(a) Overtime work will be equitably distributed among those employees normally performing the work to be done in the department, job classification, and on the shift on which the overtime is required to the degree that it is practicable and efficient to do so.
(b) Overtime will be reviewed quarterly by the supervisor and xxxxxxx of the area. The Company shall provide the overtime report to the Union monthly.
(c) If overtime, as defined in (a) is unequally distributed among the employees at the end of a quarter, then that employee shall receive in the following two (2) quarters overtime opportunity until the imbalance is brought below the allowable difference of 8 hours at some point during those two quarters. Should the imbalance not be corrected at some point during the following two quarters, the employee shall be paid straight time for the overtime hours in excess of the allowable difference of eight (288) hours.
(d) day periodEmployees will have overtime hours counted towards them as follows: the hours worked as defined in (a), including paid rest hours refused; hours offered for the sole purpose of overtime equalization; hours not available because of vacation, leave of absence, sick leave, WSIB leave, medical restrictions. (e) Employees who join a department, job classification and shift during the quarter will have their overtime hours adjusted to equal the average hours of the department, job classification and shift that they are joining for the purposes of Article 10.
(f) If an employee, because of a specialized skill or ability, is offered or performs work in another department because the employees in that department are unavailable or unwilling to perform the work, such overtime shall not be included in overtime equalization calculations. Notwithstanding the above paragraph of this 17.02 (b) a setup, "relief" work schedule for employees shall consist of an average of fifty-six (56) wet/dry prep, or maintenance shift commencing on or after 2200 hours of work per week over on a twenty-eight (28) day period, including paid rest and meal periods, with days and hours to be assigned as needed to cover scheduled and unscheduled absences from assigned shifts, back-up services or other assigned duties. All overtime work must be authorized by the Department Head in advance. Overtime for employees consists of overtime provided for in this MOU ("MOU Overtime") and overtime required by and calculated pursuant to the Federal Fair Labor Standards Act ("FLSA Overtime"). For the purpose of computing MOU Overtime, all hours in paid status Sunday shall be considered as a Monday shift. Shifts commencing at 0300 will be considered day shift for prep operators only. For set-up of the milk room only, a 10 hour shift commencing at or after 2000 hours worked; and MOU Overtime pay at the rate on Sunday will be considered a Monday shift.
17.03 The Company may require employees to perform overtime work in excess of one their regularly assigned hours.
(a) Employees working a four-day work week (10 hour shift) will be paid: One and one-half (1-1/21 ½ ) times the employee's ’s regular base wage basic hourly rate shall be paid pursuant to this MOU for for:
(i) all hours worked in excess of ten (10) hours on a normal work day;
(ii) all hours worked on the abovefifth (5th) shift of the employee’s work week;
(iii) all hours worked on a Saturday unless it is part of the employee’s regular scheduled work week. Double time (2 x) the employee’s regular basic hourly rate for:
(i) the sixth shift of the employee’s work week;
(ii) all hours worked on a Sunday except as indicated under 17.02 (b);
(iii) all hours worked on a paid holiday.
(b) Employees working a five-described fifty-six (56) hour day work week average, excluding voluntary full or partial shift trades. FLSA Overtime shall (8 hour shift) will be computed and paid or accrued as required by law, utilizing the employee's regular base wage hourly rate. Under no circumstance shall employees receive double pay or accrual for overtime which qualifies for both MOU Overtime and FLSA Overtime. Employees may elect to accrue compensatory time at the rate of one paid: One and one-half (1-1/21 ½ ) times the employee’s regular basic hourly rate for:
(i) all hours worked in excess of eight (8) hours on a normal work day;
(ii) all hours worked on the sixth (6th) shift of the employee’s work week;
(iii) all hours worked on a Saturday unless it is part of the employee’s regular scheduled work week. Double time (2 x) the employee’s regular basic hourly rate for:
i) the seventh shift of the employee’s work week;
ii) all hours worked on a Sunday except as indicated under 17.02 (b);
iii) all hours worked on a paid holiday. The above overtime will apply provided the employee works her full assigned work week except where the employee notifies the Company as long in advance as possible and at least prior to the commencement of the shift and provides a reasonable explanation for her absence. The Company will post scheduled overtime requirements as soon as they are known and will make efforts to post daily overtime requirements as soon as they are known.
17.04 To avoid pyramiding or duplication, any overtime hours which are compensated at overtime rates under any provision shall not be counted further for any purpose in determining overtime liability under the same or any other provision.
17.05 It is understood that DAILY overtime shall typically be done by the qualified employees who normally perform the work on the shift in respect of which overtime is required. The Company shall give notice of DAILY overtime as far in advance as possible. If the overtime resulted from the absence of an employee, senior volunteers on the shift will be canvassed, including call back of senior qualified employees as required. It is further agreed that employees may be excused from DAILY overtime if they have a valid reason and if the Company is able to obtain a work force which is qualified to perform the overtime work.
17.06 Where there is a requirement for DAILY overtime, the work shall be assigned in the following manner:
i) The employees who normally perform the work will be canvassed to do the work and the senior volunteers will do the work;
ii) If (i) above fails to provide the required overtime work the junior full-time employees normally performing the work shall be obliged to do the work;
iii) Unforeseen overtime may be assigned to the qualified employee on site before being offered to employees who normally perform the work who are off site. For the purposes of Article 17.06, unforeseen overtime will mean work that becomes available unexpectedly and does not allow the Company sufficient time to implement the normal practice for offering daily overtime in accordance with 17.05.
17.07 Where there is a requirement for WEEKEND overtime, the work shall be assigned in the following manner:
(i) The employees who normally perform the work will be canvassed (volunteer list) to do the work and the senior volunteers who possess the skill and ability will do the work, as judged by the Company. If there is a requirement for line associate overtime work, this will be offered to all factory associates, as this is not a posted position.
(ii) In the event that insufficient employees are obtained for overtime in a particular job posting the opportunity for overtime work within a job posting shall be offered to and equalized among employees normally engaged on the work (includes designated back-ups). Employees required to work through overtime equalization will be scheduled according to shift preference, seniority and skill and ability. Overtime shifts worked by such employees shall be recorded for the purpose of equalization on their overtime record.
(iii) To ensure the health and well-being of all associates, the maximum number of Saturday or Sunday overtime hours worked will be three (3) consecutive weeks, unless the employee volunteers. In the event of Saturday and Sunday shifts required, the associate can work both days for all MOU one
(1) consecutive weekend. The parties agree that the overtime equalization will be reviewed on an annual basis to ensure the limits above allow the necessary coverage for the production demands.
(iv) When an employee is absent from work (W.I., WSIB, L.O.A. and vacation) equalization opportunities will be maintained and charged as though the employee was present.
(v) When an employee transfers to another job posting, she will be charged with the average number of shifts within that job posting, and his/her opportunity for overtime will be based on this average.
(vi) Overtime records will be brought up to date and posted weekly in a consistent manner outside the production office and maintenance shop. Overtime following a regular shift or call-in will not form part of the associates overtime equalization totals.
(vii) Any errors in overtime allocation will be adjusted on the employee record and the next available opportunity will be allocated as per their corrected shift(s). If there is not a subsequent opportunity for such FLSA overtime within five (5) weeks, the error will be paid out. The purpose of the five (5) week tolerance is to allow for correction of mistakes and is not to allow for intentional overtime by-pass.
(viii) Overtime as equalization does not give an employee the right to double shifts or cause the overtime shift to be split. Employees who indicate they wish to work overtime will be assigned to their posted position and shift. However, when their posted job and shift is unavailable due to a lack of work, they will be assigned to their alternate shift preference by seniority and skill and ability. It is recognized that for the purpose of overtime equalization, employees may be allowed by lawasked to work on any of the shifts; however, where possible, employees who indicate they wish to work overtime, will be assigned to their normal shift.
(ix) The overtime equalization will start January 1 and end December 31 of each year. Any At December 31, all employees overtime will be zeroed out.
17.08 When an employee who reports for work on a regularly scheduled working day and upon her arrival at the plant finds no work is separated from CITY service available for her, unless she has been notified at least one (1) hour prior to the start of the shift not to report, she shall be entitled to payment paid four (4) hours for accrued compensatory time 8-hour shifts and five (5) hours for 10-hour shifts or more at the employee's her regular hourly base wage rate rate. If she is offered other work for which she is physically fit, for four (4) hours for 8-hour shifts and five (5) hours for 10-hour shifts or more at her regular hourly rate, and she refuses such work, she shall not be eligible to receive the reporting pay provided for above. The provisions of this section shall not apply if the failure of the Company to provide work is due to fire, flood, power or equipment failure, labour dispute, or other interference with Company operations beyond the reasonable control of the Company.
17.09 Where an employee’s scheduled starting time is changed but the employee is not notified of the change prior to reporting to work, the employee shall be treated as if her shift was to commence at the time she considered she was to report to work. The Company will post the daily production schedule for the following work day by 1:00 p.m. In the event an employee departs earlier than 1:00 p.m. they shall be responsible to contact the factory to obtain their work schedule for the following day.
17.10 Where a line breaks down or line production is completed prior to the end of shift, the senior volunteers from that line shall have the option of going home or remaining at work to perform any work which the Company determines to be available provided they have the skill and ability and also provided that no other employees are displaced from their jobs.
17.11 Call-Back - Where an employee is called back to work after having left the premises she will be given a guaranteed minimum pay equal to four (4) hours at time and one-half the straight time hourly rate for such call-back. If the call-back is within four (4) hours of the employee's separationcommencement of her scheduled shift, less she will be paid at the rate of time and one-half for all normal deductionshours prior to the commencement of the shift, provided she works her scheduled shift unless no additional costs would be incurred by leaving the shift early.

C. The following procedures apply to overtime situations:
1. The “no overtime” list must be signed in order for such FLSA Overtime as may an employee to be allowed by lawineligible for overtime. Any employee who is separated not signing the “no overtime” list will be considered eligible. An overtime accumulation list will be kept year round by the payroll clerk. For purposes of calling in employees for overtime work, the work year shall run from CITY service November 1 to October 31 (all employees shall be entitled considered to payment for accrued compensatory time have zero overtime on November 1). The first call-ins after the November 1 date will be made as needed at the employee's regular hourly base wage rate at superintendent’s discretion. Thereafter, throughout the time year, call-ins will be based on the superintendent’s attempt to equally distribute overtime for all work units of the employee's separationhighway department. The procedure will be as follows:
(a) If an employee is called for overtime and works, less all normal deductionshe will be credited for hours worked.
(b) If an employee is called for overtime and refuses, he will be charged “red time” hours averaged that he would have received for that call in.
(c) If an employee is called for overtime and is not reached, for any reason, (no answer, answering machine, busy signal, not home, etc...) he will be charged “red time” hours averaged that he would have received for that call-in.
(d) If an employee signs the no-overtime list he will be given red time hours for any shift not worked.
(e) If an employee is on disciplinary suspension he will be given red time hours for any shift not worked.

HOURS OF WORK AND OVERTIME. 9.1. The following shifts are available regular day shift for all employees in the bargaining unit. Shifts will be assigned at the discretion of the Fire Chief. b) Employees who have scheduled vacation or scheduled sick leave usage, and whose total hours for the work period including such leave exceed 40 hours, shall only be charged the appropriate hours of vacation or sick time such that they achieve pay for a regular 40-hour week. For example, if by the 4th day of the typical work week, an employee has already worked 36 hours, and the employee already has the 5th day scheduled for vacation, the employee would only be required to use 4 hours of vacation on the 5th day, but would have the entire day as an excused absence. c) By mutual agreement between the employee and the District, and subject to operational needs, an employee who has not scheduled leave as referenced in 9.3(b), but who has worked more than 40 hours prior to the end of the typical work week, may take the remainder of the work week (or portion of it) as excused time off without the absence being charged against the employee's ’s vacation leave or sick leave balance. 9.4. In addition to receiving regular base wage hourly rate holiday pay (eight (8) hours at the straight-time rate), employees shall be paid pursuant to this MOU for all hours worked in excess of the above-described fifty-six two (56) hour work week average, excluding voluntary full or partial shift trades. FLSA Overtime shall be computed and paid or accrued as required by law, utilizing the employee's regular base wage hourly rate. Under no circumstance shall employees receive double pay or accrual for overtime which qualifies for both MOU Overtime and FLSA Overtime. 9.5. Employees called out for overtime duty shall receive at least two (2) hours pay at the applicable overtime rate. Each employee shall receive travel time in the amount of fifteen (15) minutes each way for all MOU Overtime each call-out, at the applicable overtime rate, except that if such call-out extends into scheduled hours of work, travel time one way in the amount of fifteen (15) minutes shall be allowed. If overtime is an extension of regular scheduled hours of work, or prearranged, no travel time shall be allowed. All work performed on overtime call-outs shall be limited to emergency work and for such FLSA Overtime as may be allowed by lawservice calls. a) An employee who has completed a normal work shift and is separated from CITY service ordered back to work shall be entitled to payment credited with a minimum of two (2) hours work time.
b) When such an employee is called back under these conditions within two (2) hours of the beginning of a previous call or an additional call back is received while still working on an earlier call back, the employee shall not receive an additional two (2) hours credit for accrued compensatory time at the employee's regular hourly base wage rate at new call back.
c) When such an employee is called back within two (2) hours of the time beginning of the employee's separationnext shift, less all normal deductionsthe employee shall be compensated only for the hours remaining before the beginning of the employee's next shift.
9.6. a) Except as provided for in Section 9.6(b), it is understood no employee is required to "stand-by" for emergency or service call-outs after the regular work day or work week; provided it is further understood employees shall be willing to respond to emergency or service call-outs, provided such employees are available when called. HOURS OF WORK AND OVERTIME. 21.1 The following shifts are available for employees in the bargaining unit. Shifts work days(s) and shift(s) will be assigned at determined by the discretion Sheriff. The Sheriff shall have the right to implement, if deemed in the best interest of the Employer, an eight (8), nine (9), ten (10) or twelve (12) hour work shift. If the Sheriff implements a seven (7) day work period with an eight (8), nine (9), or ten (10) hour work shift, the overtime threshold shall be forty (40) hours. If the Sheriff implements a fourteen (14) day work period with an eight (8), nine (9), ten (10) or twelve (12) hour shift, the overtime threshold shall be eighty (80) hours. The purpose of this Section is to permit the Sheriff to implement work periods and overtime thresholds in accordance with the provisions of the Fair Labor Standards Act (FLSA) and in order to protect the best interests of the Employer.
21.4 Daily work shift hours offwill be established by the Sheriff. Employees assigned to work an eight (8), nine (9), or ten (10) hour work shift will be allowed a thirty (30) minute paid lunch. Employees assigned to work a twelve (12) hour work shift will be allowed a forty- five (45) minute paid lunch. Employees are subject to call and remain on duty during lunch time.
21.5 The Sheriff has the right to assign employees to particular shifts.
A. Road Deputies assigned twelve (12) hour work shifts will have a normal work schedule consisting of working thirteen (13) twelve-(12)-hour work shifts per twenty eight (28) day work period; and the workweek for that classification shall consist equivalent of an average of fifty-six (566) eight-(8)-hour or five (5) ten-(10)-hour days of training which will take place throughout the calendar year. These training days are scheduled and conducted on a squad’s regular day off in a specified work period. The employees receive a Xxxxx xxx off at their regular rate of pay in exchange for scheduled hours on these training days (see Section 21.6 below).
B. Employees assigned eight (8)-hour work shifts will have a normal work schedule of five (5) consecutive work shifts per week over seven (7) day work period.
C. Employees assigned ten (10)-hour work shifts will have a normal work schedule of four (4) consecutive work shifts per seven (7) day work period.

D. For the purposes of computation of overtime, hours worked in excess of the above-described fifty-six (56) hour work week averageworked, excluding voluntary full or partial shift trades. FLSA Overtime reporting pay hours, regular holidays, floating holiday, vacation, administrative leave, personal time, and jury duty shall be computed counted.
E. Insofar as practicable, the Authority will distribute overtime work as equitably as possible, first within classification and paid location to employees qualified and available.

When a full-time employee who works extended hours reports for duty on their regular scheduled work day they shall be guaranteed a minimum of ten (10) hours work and/or pay unless the employee leaves of their own volition.
8:04 When full-time employees report for duty on a call back basis inconsistent with their regular scheduled work day or shift they shall be guaranteed a minimum of four (4) hours work. HOURS OF WORK AND OVERTIME. The following paragraphs and sections are intended to define the normal hours of work and shall not be construed as a guarantee of hours of work per day or per week, or of days of work per week. The normal assigned work week for all classifications cov- ered by this Agreement shall average point three, three, three (37.333)hours per week. 6.04 A day shift shall be considered any shift commencing between the hours of 6:00 AM and 9:00 AM; an afternoon shift will be any shift commencing between the hours of 9:01 AM and 5:00 PM. The ratio of day shift versus afternoon shift worked shall be no less than 1 to 1, respectively, wherever possible.
6.05 The hours of work shall be consecutive with the exception of a ten (10) minute rest break during the first four (4) hours of the shift, an unpaid lunch break not to exceed one (1) hour, and a ten (10) minute rest break during the last four (4) hours of the shift. Lunch breaks are paid when on twelve (12) hour continuous shifts.
6.06 When overtime work of more than one (1) hour but less than two (2) hours is to be performed, immediately before or after a regular shift, the Employee shall be given a ten (10) minute rest break adjacent to the shift.
6.07 When overtime work of two (2) hours or more is to be performed, immediately before or after a regular shift, the Employee shall be given a ten (10) minute rest break adjacent to the shift.
6.08 When overtime work of four (4) hours is to be performed, immediately before or after a regular shift, the Employee shall be given a thirty (30) minute unpaid rest break adjacent to the shift. Where practical the Employee will be provided a meal and beverage without charge and if not practical or possible the Employee will be eligible to claim $15.00. 12:09 Time schedules shall contain a period of at least four (4) weeks and, except in cases of emergency, time schedules shall be posted two (2) weeks prior to the time start of the employee's separation, less all normal deductionssuch schedule.

c) All hours worked on a Statutory Holiday will be paid at the a rate of one and one-half (1-1/21.5) times the number employee’s straight time hourly rate. All hours worked on a Statutory Holiday will be considered regular hours worked during the shift cycle for the purposes of determining when overtime would apply within the two week period.
d) Employees who work on a scheduled day off will be paid at a rate of one and one-half (1.5) times the employee’s straight time hourly rate of pay for all hours worked on such days, unless an employee was not available for work or did not work their full regular scheduled fourteen (14) days (i.e. employee calls in sick for one (1) or more regularly scheduled shifts). In this circumstance, the employee will not be eligible for overtime pay on the following scheduled days off that are worked, for hour’s equivalent to missed hours.
11.03 The Employer will attempt to distribute overtime work as evenly as possible among employees who normally perform the work and who indicate they wish to work overtime.
11.04 Hours of work, overtime and additional shift cycles set out in this Article may be modified through a Letter of Understanding between the Employer and the Union for selected projects.
11.05 It is agreed that the provisions of this Article are for the purpose of computing overtime and shall not be construed to be a guarantee of or a limitation on the hours of work to be worked per day or per week other than those stipulated in Articles 10.04 and 10.05.
11.06 There will be two (2) fifteen minute (15) minute coffee breaks which will be combined to one (1) coffee break of thirty (30) minutes duration per shift. Such coffee break will be considered time worked. Additionally, there will be one (1) meal period of thirty (30) minutes duration per shift. Such meal period will not be considered time worked. Additional paid fifteen minute (15) coffee breaks will be given for each additional two (2) hours of overtime hours worked for all MOU Overtime and for such FLSA Overtime as may be allowed by law. Employees may elect to accrue compensatory at time at the rate of one and one-half (11 1/2x) the Classification base hourly rate of pay for the first eight (8) hours worked and two times (2x) the Classification base hourly rate of pay for all hours after eight (8) hours. Sundays and Statutory holidays shall be paid at two-1/2times (2x) times the number Classification rate.
7:03 An employee shall be given two (2) hours notice before beginning overtime. All overtime will be evenly distributed between all employees working on the job. The Job Xxxxxxx will keep a record of overtime hours worked.
7:04 Notwithstanding 7:01, 7:02, if mutually agreed upon by the Employer and the Local Union forty (40) hours may be worked in any four (4) consecutive days Monday to Thursday or Tuesday to Friday at the straight time rate, provided however, that no more than ten (10) hours may be worked at the straight time rates in any one (1) day. Hereafter referred to as a compressed work week. On a Compressed Work Week, all hours worked beyond ten (10) hours per day shall be paid at time and one-half (1 1/2 x) the Classification base hourly rate of pay for the first two (2) hours worked and then two times (2x) the Classification base hourly rate of pay for all MOU Overtime overtime beyond two (2) hours worked. Any week in which a holiday or day in lieu thereof falls, would have a balance of a thirty (30) hour work week, i.e. three (3) ten (10) hour days.
7:05 Employees must take a minimum rest period of eight (8) hours between shifts. Where employees are specifically requested to return to work before the expiration of eight (8) hours, all additional hours performed shall be paid for at the prevailing overtime rate of pay for that type of project. The overtime rate(s) of pay shall continue until a full eight (8) hour rest period has been observed.
7:06 Two (2) coffee breaks will be allowed per shift provided employees do not leave the job and the breaks do not exceed fifteen (15) minutes each, abuse of this privilege will be sufficient cause for such FLSA Overtime cancellation of this Article. Times for coffee breaks shall be at the quarter (1/4) and three quarter (3/4) point of each shift, or as may be allowed by lawmutually agreed upon. Any employee who is separated from CITY service Should the coffee break jeopardize the normal progress of work (i.e. concrete pour in hand) the time shall be entitled mutually adjusted for the employees affected. A coffee break of fifteen (15) minutes without any loss of time shall be allowed to payment for accrued compensatory employees upon commencement of unscheduled overtime and every two (2) hours alternately with the above mentioned meal breaks. On camp jobs, the Employer will cooperate with employees as to the method of making refreshments available. Extra coffee breaks shall not be unreasonably denied where overtime is worked.
7:07 As per Local 2085’s Code of Excellence, all Electrical employees will be on the job at regular starting time and shall remain until regular quitting time except as otherwise specifically provided in this Agreement.
7:08 If more than ten (10) hours are worked the Employer shall supply either a hot meal at no cost to the employee or a $20.00 cash allowance after the ten (10) hours have been worked and the same provided every four (4) hours thereafter without any loss of time.
7:09 If conditions are such that work on any particular job cannot be done within the said hours (7:00 a.m. till 4:30 p.m.), then shift work may be instituted. Shift work shall be defined as work assignments lasting two (2) or more days all or part of the working time being outside the normal working hours, Monday to Friday inclusive. All shift work shall be paid at the employee's regular hourly base wage rate of time plus ten (10%) percent. Overtime outside the regularly scheduled shift shall be paid at the time base classification hourly rate of pay plus ten (10%) percent multiplied by the applicable overtime premium as described in Article 7:02 (i)(ii)(iii).
(A) Scheduled overtime shall be defined as work performed outside the normal working hours for a period of more than two (2) consecutive work days.
(B) The Employer will make every reasonable attempt to contact the Business Manager and/or the Job Xxxxxxx if overtime is to be worked.
7:11 The normal “work day” or “days of work” may be altered on any project by mutual consent of the employee's separationLocal Union and the Employer, less subject always to all normal deductionsother terms of this Agreement, and such agreement will not be unreasonably withheld.

HOURS OF WORK AND OVERTIME. The following shifts are available for employees in 6.01 This Article, where it defines the bargaining unit. Shifts will be assigned at the discretion of the Fire Chief. One "shift" work schedule for employees shall be twenty-four (24) normal hours of assigned duty followed by forty-eight (48) hours off; work and the workweek for that classification workweek, shall consist not be construed as a guarantee of an average of fifty-six (56) hours of work per week over day or per week, but merely provides the basis for the calculation of overtime. Neither shall it serve as a twenty-eight (28) restriction on the scheduling of a longer or shorter day period, including paid rest or workweek.
6.02 The Employer agrees to notify and meal periods. Another "shift" work schedule for employees shall be forty-eight (48) hours of assigned duty followed by ninety-six (96) hours off; and meet with the workweek for that classification shall consist of an average of fifty-six (56) Union before making a change in the normal hours of work per week over or shift rotation schedules, and further agrees that seven (7) days notice shall precede the effective date of any changes. Establishment of a twentynew or different shift, which requires modification or signing-off of any provision in this Agreement, shall be subject to mutual agreement between the Union and the Employer. The Union will reasonably consider all requests by the Employer to add new or different shifts.
6.03 The normal workday consists of eight (28) day period8) hours, including paid rest and meal periods. Another "shift" work schedule for employees shall be a standard the normal workweek consists of forty (40) hour workweek consisting of eight-hour days over a five-day period. Another "shift" work schedule shall be an eleven (11) hour day working a total of five days during a seven (7) day period (hours, Monday through Friday. Hours worked in excess of eight (8) hours per day or forty (40) hours per week will be paid at the overtime rate of one and a half (1.5) times the workweek for that classification regular hourly rate, unless the Employee is working on an approved shift in excess of those hours. Overtime hours worked on Sunday and General Holidays will be paid at two (2) times the regular hourly rate, unless the Employee is working on an approved shift on those days. (For Employees working on a continuous shift see Letter of Understanding).
6.04 A day shift shall consist be considered any shift commencing between the hours of 6:00 AM and 9:00 AM; an average afternoon shift will be any shift commencing between the hours of fifty-six 9:01 AM and 5:00 PM. The ratio of day shift versus afternoon shift worked shall be no less than 1 to 1, respectively, wherever possible.
6.05 The hours of work shall be consecutive with the exception of a ten (5610) minute rest break during the first four (4) hours of work per week over the shift, an unpaid lunch break not to exceed one (1) hour, and a twenty- eight ten (2810) day period, including paid minute rest and meal periods. The normal, "relief" work schedule for employees shall consist of an average of fifty-six break during the last four (564) hours of the shift. Lunch breaks are paid when on twelve (12) hour continuous shifts.
6.06 When overtime work per week over of more than one (1) hour but less than two (2) hours is to be performed, immediately before or after a twenty-eight regular shift, the Employee shall be given a ten (2810) day periodminute rest break adjacent to the shift.
6.07 When overtime work of two (2) hours or more is to be performed, including immediately before or after a regular shift, the Employee shall be given a ten (10) minute rest break adjacent to the shift.
6.08 When overtime work of four (4) hours is to be performed, immediately before or after a regular shift, the Employee shall be given a thirty (30) minute unpaid rest break adjacent to the shift. Where practical the Employee will be provided a meal and beverage without charge and if not practical or possible the Employee will be eligible to claim $15.00. The Employee will also be given a fifteen (15) minute paid rest break and meal periodsa beverage after each consecutive two (2) hours of overtime work.
6.09 Overtime shall be distributed as equitably as possible first among all Employees within the department and then amongst Employees capable of performing the work within the Branch or division. If a concern arises in the branch, overtime hours will be reviewed with days the Shop Xxxxxxx.
6.10 Unscheduled call-in at the end of a regularly scheduled workday will be paid at a minimum of three (3) hours overtime pay. When a person is called in on a scheduled day off or a statutory holiday and is required to work, that person will be paid a minimum of four (4) hours at the regular overtime rates in addition to any statutory holiday pay. However, the Employer may require the Employee to work the three (3), or four (4) hour period.
6.11 Parts Countersales Employees assigned to scheduled standby duty shall receive $5.00 per hour for each hour of standby duty.
(A) If a phone call is received at home and no order is placed, the time is considered covered by the standby pay.
(B) If an order is placed from home via telephone or Personal Computer then the Employee will be compensated at two (2) hours at the applicable overtime rates. Only one call-in shall be paid each two hour (2) period.
(C) If an Employee is required to go to the Employer’s premises as a result of the call, the Employee shall be compensated at four (4) hours at the applicable overtime rates or the actual hours worked, whichever is greater. Only one (1) call-in shall be paid in each four (4) hour period.
(D) Where appropriate and practical, those Employees assigned to scheduled standby duty will rotate.
6.12 No other Employee shall be scheduled or required to be assigned as needed on standby. Where standby may be agreed to cover scheduled and unscheduled absences from assigned shifts, back-up services or other assigned duties. All overtime work must be authorized by the Department Head in advanceEmployee and the Employer, the Employee shall receive standby pay at $5.00 per hour for each hour of standby.
6.13 It is intended that every Employee should have a full shift break between shifts. Section 5 Nothing contained in this Agreement shall be interpreted as a guarantee of hours of work in a day or in a week except as provided in Section 4.
Section 6 Any employee assigned to work in a higher classification for a full shift or more shall receive the rate at of pay for such higher classification for the time hours so worked.
Section 7 Employees shall receive a thirty (30) minute unpaid lunch period.
Section 8 Any overtime which is assigned shall be evenly apportioned within the respective job group.
Section 9 Department Considerations – Buildings and Grounds Staff Apportionment of Activities Overtime Work All activity overtime work in relation to High School activities shall be assigned to high school custodial workers, groundskeepers . . . and all activity overtime work in relation to elementary school activities shall be assigned to elementary school custodial workers, groundskeepers . . . without regard to the physical location of the employee's separationactivity. In the event there is a conflict of commitments between custodial workers, less groundskeepers . . . , the overtime job may be assigned to any custodial workers, groundskeepers . . . interested in the work. The Superintendent of Buildings and Grounds, or that person’s designee, shall determine whether the buildings and areas involved in activities requiring overtime work shall be cleaned and returned to full readiness for normal use immediately after the activity or, on the other hand, whether those buildings and areas may be cleaned and returned to full readiness for normal use at a later time. Supervision and discipline of students, school personnel, and all normal deductionsother persons shall be the sole responsibility of the professional staff or other individual designated by the Superintendent of Schools.

Section 3. If an employee cannot report to work as scheduled, the employee must call the designated supervisor or message telephone number if the supervisor is unavailable, a minimum of ninety minutes before their scheduled shift starts.
Section 4. Any employee required to return to work with less than nine hours from the end of their last shift will be paid pursuant to this MOU for all hours worked in excess of the above-described fifty-six (56) hour work week average, excluding voluntary full or partial shift trades. FLSA Overtime shall be computed and paid or accrued as required by law, utilizing the employee's regular base wage hourly rate. Under no circumstance shall employees receive double pay or accrual for overtime which qualifies for both MOU Overtime and FLSA Overtime. Employees may elect to accrue compensatory time at the a rate of one time and one-half (1-1/2) times for the number of overtime first hours worked for all MOU Overtime and for such FLSA Overtime as may be allowed by law. HOURS OF WORK AND OVERTIME. 12.01 This Article provides the basis for establishing work schedules and for the calculation and payment of overtime, but shall not be read or construed as a guarantee of hours of work per day or week or a guarantee of days of work per week.
12.02 The following shifts are available normal workweek for employees shall be thirty-six-and-a-quarter (36.25) hours per week consisting of five (5) days of seven-and-a-quarter (7.25) hours each. Notwithstanding the above, it is recognized that the normal workweek of the Accountant, IT Analyst (Hardware), IT Analyst (Software) and Residential Energy Representative is forty (40) hours, consisting of five (5) days of eight (8) hours each.
12.03 It is mutually acknowledged that from time to time it will be necessary for employees to perform work outside of the normal schedules.
12.04 For authorized work performed in excess of all normal daily or weekly hours, and on Holidays, the premium rates will be double the regular hourly rate. In lieu of payment for overtime worked, members of the bargaining unit. Shifts unit may elect to bank overtime worked to be taken as paid time off work up to a limit of the equivalent of five (5) days per calendar year under the following conditions:
(a) overtime hours banked will be assigned taken off work as premium time; a minimum call out (Section 12.05 immediately below) will be banked as three (3) hours or one-and-a-half (1.5) hours, as appropriate;
(b) the ability to accumulate banked time for the calendar year commences on January 1 of each year. Each year, members of the bargaining unit must notify the Employer by November 20th regarding any banked hours which either have been duly scheduled to be taken before the end of the calendar year or are to be carried forward to the next year (subject to d) below). On the first pay of December, all unallocated banked time will be paid out. Any additional banked time earned after November 20th for the current calendar year will be carried forward to the following year;
(c) the actual days of banked time taken off will be at the discretion of Management as is provided in Article 25 VACATIONS, to permit the Fire Chiefefficient operation of the Employer's business;
(d) a maximum of five (5) days of unused banked time can be carried forward to the subsequent year.
12.05 When an employee a) is required to attend to a telephone call at home about a prepaid power problem, and b) is able to solve the problem from their residence, the employee will receive a minimum of one-and-a-half (1.5) hours' pay at the basic hourly rate. One "shift" If the employee determines without leaving their residence that the prepaid power problem is equipment-related such that a member of the outside bargaining unit is called to solve the problem, there will be no overtime pay for the inside bargaining unit employee involved. c) By mutual agreement between the employee and the District, and subject to operational needs, an employee who has not scheduled leave as referenced in 9.3(b), but who has worked more than forty (40) hours prior to the end of the typical work per week, may take the remainder of the work week over a twenty- (or portion of it) as excused time off without the absence being charged against the employee's vacation leave or sick leave balance.(Xxxxxxx 2023)
9.4. In addition to receiving regular holiday pay (eight (288) hours at the straight-time rate), employees shall be paid two (2) day periodtimes the regular straight time rate for time worked on the holiday.(Amended 2010)
9.5. Employees called out for overtime duty shall receive at least two (2) hours pay at the applicable overtime rate. Overtime work extending into or beyond scheduled hours of work on a workday shall be paid at applicable overtime rate for actual hours worked. Each employee shall receive travel time in the amount of fifteen (15) minutes each way for each call-out, including paid rest at the applicable overtime rate, except that if such call-out extends into scheduled hours of work, travel time one (1) way in the amount of fifteen (15) minutes shall be allowed. If overtime is an extension of regular scheduled hours of work, or prearranged, no travel time shall be allowed. All work performed on overtime call-outs shall be limited to emergency work and meal periodsservice calls. 14.5.1 An employee assigned to a fifty-six (56) hour work week averagerequired to work overtime for work regularly assigned to forty (40) hour work week employees, excluding voluntary full or partial shift trades. FLSA Overtime for the purpose of back filling an absence created by an employee assigned to a forty (40) hour work week shall be computed and paid or accrued as required by law, utilizing the employee's regular base wage hourly rate. Under no circumstance shall employees receive double pay or accrual for overtime which qualifies for both MOU Overtime and FLSA Overtime. Employees may elect to accrue compensatory time compensated at the overtime rate of one and one-half (1-1/21.5) times the number employee’s 1.4 rate for each overtime hour worked in the forty (40) hour position. In all other instances an employee assigned to a fifty-six (56) hour work week shall not be eligible for overtime at the 1.4 rate. An employee assigned to a fifty-six (56) hour work week shall not be eligible for overtime pay based on conversion to the forty (40) hour work week pay rate when assigned work which is part of the suppression line job function for their rank e.g., QAB’s promotional interview boards, suppression line training, EMT proctoring, and special projects or committees.
14.6 Overtime worked shall be compensated, at the one and one-half (1.5) rate, by compensatory time. However, the Department Head may authorize payment in lieu of compensatory time where providing such compensatory time would impair departmental operations or efficiency. Except in extenuating circumstances, once the employee has received approval from the appropriate authority to take compensatory time off, payment for such approved time off shall not be authorized. An employee who transfers from working a forty (40) hour per week assignment to working twenty-four (24) hour shifts, or vice versa, shall have the employee’s unused compensatory time balance converted accordingly by a factor of 1.4.
14.7 Compensatory time credited to an employee, and which is not taken within twenty-six (26) pay periods following the pay period in which the overtime hours worked is worked, shall be paid to the employee at the appropriate rate.
14.7.1 Compensatory time earned while on a forty (40) hour week assignment shall be converted to reflect a fifty-six (56) hour work schedule whenever employee is transferred to a fifty-six (56) hour work schedule. Compensatory time earned while on a fifty-six (56) hour week assignment shall be converted to reflect a forty (40) hour work schedule whenever an employee is transferred to a forty (40) hour work schedule.
14.8 Notwithstanding any other provision of this Article 14 to the contrary, the Fire Department may announce its intent to pay employees for accrued compensatory time that is not used as of a date specified by the department. The announcement will also specify a date by which time each affected employee must elect to either:
14.8.1 Be paid for all MOU Overtime and accrued, unused compensatory time, OR
14.8.2 Be paid for all but twenty-four (24) hours of such FLSA Overtime as may be allowed by lawaccrued, unused compensatory time, OR
14.8.3 Retain all accrued, unused compensatory time, subject to other applicable provisions of this Article 14. Any employee not making an election will retain their compensatory time, subject to other provisions of this Article.
14.9 Time spent on paid sick leave, disability leave, holiday leave, vacation leave, military leave, compensatory time off duty, or other authorized paid leave shall be deemed as time worked for purposes of this article.
14.10 An employee who is separated from CITY service terminated by reason of resignation, discharge or retirement and who upon the effective date of such termination has accrued unused compensatory time earned, shall be entitled to payment paid for accrued such hours of unused compensatory time at the employee's regular straight time hourly base wage rate at rate. In the time event the termination results from the death of the employee's separation, less all normal deductionsthe payment, if any, shall be made to the executor of the will or the administrator of the estate.
14.11 The present fifty-six (56) hour work week and shift schedule shall continue during the term of this Agreement unless mutually changed by the parties.

These can be combined as one meal period, as needed on an individual basis, provided they work the full scheduled shift. All employees shall have at least two (2) consecutive days off, unless emergencies require them to work. At all times, including meals and breaks on their regular shift, Deputies will be responsible for handling complaints and responding to calls without any overtime involved.
E. All overtime shall be paid pursuant to this MOU for all at the rate of time and one-half (1½). No overtime shall be paid until after 40 hours has been worked. Paid vacation, sick, and/or holiday time does not constitute hours worked in excess when calculating hours worked and/or overtime.
F. Any full-time employee, who is called out to work outside of the abovetheir normally scheduled shift shall constitute a call-described fifty-six (56) hour work week average, excluding voluntary full or partial shift tradesout. FLSA Overtime An employee shall be computed compensated for a minimum of three (3) hours at time and paid or accrued as required by law, utilizing the employee's regular base wage hourly rateone-half (1½) for each call-out. Under no circumstance Time worked over three (3) hours shall employees receive double pay or accrual for overtime which qualifies for both MOU Overtime and FLSA Overtime. Time and one-half has already been paid (or will be paid) for all MOU Overtime call-outs regardless of how many hours worked.
G. Employees required to attend schools, meetings or court during their off-duty time will be paid the overtime rate, if over forty (40) hours has been worked during the week.
H. There will be a Head Control/Dispatch Officer who will oversee the schedule (i.e., make sure all shifts are covered, oversee the training and keep other Control/Dispatch Officers informed of new changes in the office and from CJIN/NCIC). This Control/Dispatch Officer shall receive extra compensation for such FLSA Overtime as may be allowed by law. HOURS OF WORK AND OVERTIME. SECTION 1 The following shifts are available for employees normal working hours shall be eight (8) hours per day and forty (40) hours per week, but this shall not be construed
(a) as a guarantee of any minimum working hours, or
(b) as a limitation of the number of working hours which the Company may arrange or require as conditions warrant or necessitate in the bargaining unitjudgment of the Management.
SECTION 2 For the purpose of this Contract a ‘day’ shall be considered as the twenty-four consecutive hours beginning at 12 o’clock midnight, and a ‘week’ shall commence at 12 o’clock midnight Sunday night and end at 12 o’clock midnight the following Sunday night. Shifts SECTION 3
(a) Work performed in excess of eight (8) hours in any one day and/or shift, or forty (40) hours in any one week, shall be deemed overtime, and shall be paid for at the rate of time and one-half provided that both daily and weekly overtime shall not be paid for the same hours.
(b) Two times the employee’s straight time hourly rate will be assigned at paid for all hours worked on the discretion seventh consecutive ‘day worked’ in any week. In determining which days are to be considered ‘days worked’ the rules and definitions set forth in Appendix E attached to the signed copies of the Fire Chief. One "shift" work schedule for employees this Contract and made a part hereof shall be followed. Premium pay provided for in this Section 3(b) shall be paid in lieu of, and not in addition to, premium pay for overtime work.

(e) In the event that an employee is the successful applicant for a classification or bumps into a classification, such employee will be entitled to share in the overtime in his old classification until transferred to his new classification. In the event that an employee is bumped to temporary employee status, such employee will be entitled to share in the overtime in his old classification until his replacement is trained.
(f) An employee who works overtime shall not be required to take time off to offset such overtime.
SECTION 4 In any case where an employee is required to work on his regularly scheduled day or days off or outside his regularly scheduled hours of assigned duty followed by forty-eight (48) hours off; and the workweek for that classification shall consist of an average of fifty-six (56) hours of work per week over a twenty-eight (28) day periodwork, including paid rest and meal periods. In any case where an employee who performs work under this Section is entitled to a rate of earnings under any other Section of this Contract which is equal to the rate of earnings provided for in this Section he shall be paid such rate of earnings under one Section or the other but not both, except that if an employee is required to work on his regularly scheduled day off and such day is one of the statutory holidays listed in Section 1 of Article 6, then the employee will be paid time and one-half for all hours worked plus statutory holiday allowance.
(a) A rate of one and one-quarter times the regular straight time hourly rate will be paid to all employees scheduled to work on Saturday. For the purpose of this section, ‘Saturday’ shall mean the twenty-four hour period beginning at 12 o’clock midnight Friday night and ending 12 o’clock midnight Saturday night.
(b) A rate of one and one-half times the regular straight time hourly rate will be paid to all employees scheduled to work on Sunday. For the purpose of this section, ‘Sunday’ shall mean the twenty-four hour period beginning at 12 o’clock midnight Saturday night and ending 12 o’clock midnight Sunday night. SECTION 6
(a) Schedules of working hours shall be posted in the various departments. Any contemplated change in such schedule will be discussed with the Union before being put into effect.
(b) The Company recognizes the desirability of scheduling time worked from Monday through Friday of each week and agrees to make every effort consistent with production requirements to schedule hours of work during such days for as many employees as is reasonably practicable. It is understood the nature of the Company’s operations is such that many employees cannot be scheduled during such five days and different schedules may be arranged as operating conditions and production requirements demand, but such schedules will be held to a minimum. However, the final determination of work schedules rests with the Management.
SECTION 7 The Company agrees to provide a meal to employees who work two (2) or more hours of overtime continuous with their regular shifts. Employees who are required to work sixteen (16) consecutive hours originating on the 12 - 8 shift will be provided with a meal at the end of the first eight (8) hour shift and a second meal midway through the second eight (8) hour shift. There shall be no banking of overtime meals. Employees will have the option of taking a non-taxable meal allowance of $6.50 in lieu of an overtime meal.
SECTION 8 An employee required by the Company to change his shift schedule, with the change resulting in less than fifteen (15) hours between schedules, will be paid one and one-half (1 1/2) times his basic hourly rate for the number of overtime first eight (8) hours worked for all MOU Overtime and for such FLSA Overtime on his new schedule. This provision shall not apply if the change in shift schedule is the result of a request by an employee or if his last shift worked prior to the change was fully paid as may be allowed by law. Any employee who is separated from CITY service shall be entitled to payment for accrued compensatory time at the employee's regular hourly base wage rate at the time of the employee's separation, less all normal deductionsovertime hours.

HOURS OF WORK AND OVERTIME. Section 1. The following shifts sole purpose of this article is to establish the basis for calculation of overtime.
Section 2. Normal hours of work for part-time employees are available the appointment designated hours for which the employee’s position is authorized. Part-time employees who work a complete eight (8) hours in a day shall receive an unpaid lunch period. Employees will be notified of the appointment designated hours and any change of the appointment designated hours.
Section 3. Management reserves the right to require extra hours. Extra hours not constituting overtime will be compensated at the straight time hourly rate.
Section 4. Overtime will be paid at the rate of time and one-half of the regular straight time hourly rate for all required overtime worked by hourly rated employees in excess of forty (40) hours per week. In eligible facilities, overtime may be paid at the bargaining unitrate of time and one-half the straight time hourly rate for all required overtime worked by hourly rated employees in excess of eight (8) hours per day or eighty (80) hours per bi-weekly pay period.
Section 5. Shifts Overtime premiums shall not be pyramided, compounded or paid twice for the same time worked.
Section 6. Employees who have worked overtime for which they are entitled to pay at the rate of time and one-half may take compensatory time at the rate of time and one-half in lieu of pay at the overtime rate. Employees shall be permitted to take compensatory time within twelve (12) months from the date it was earned. Employees may not earn in excess of thirty (30) hours times one and one-half – forty-five (45) hours of compensatory time in a calendar year. Employees who are appointed to work for seventy-two (72) hours or more in a pay period, may not earn in excess of fifty hours times one and one-half for a total of seventy-five (75) hours of compensatory time in a calendar year. The Employer will pay unused compensatory time more than twelve (12) months old four (4) times each year. The Employer will calculate compensatory time over one (1) year old as of March 15, June 15, September 15, and December 15, and unused compensatory time will be assigned at paid on the discretion first pay check issued in April, July, October, and January of each year. Employees may request to be paid for all accrued compensatory time one time per quarter. The deadline to request a CT payout is March 15, June 15, September 15, and December 15, and the Fire Chiefpayouts will occur on the first pay check issued in April, July, October, and January of each year.
Section 7. One "shift" work schedule for employees Only hours actually worked shall be counted for the purpose of computing entitlement to time and one-half overtime.

Part-time employees may elect straight time compensatory time for non-overtime extra hours worked as follows: part-time employees may earn to a maximum of forty-eight straight-time compensatory hours in a calendar year.
