Installation, Acceptance. 6.1 If we carry out the erection, installation or commissioning of the Product on the buyer’s premises, the buyer shall be responsible for preparing the future site of the Product at its own expense, in accordance with our instructions for the installation.
6.2 In cases of Clause 6.1, the buyer shall accept the Product immediately on completion of our works, by issuing a written declaration of acceptance. Acceptance shall not be refused for minor defects. The Product shall be deemed accepted if the buyer does not accept it within a reasonable timeline set by us.
6.3 Apart from a test or trial run conducted under our supervision, the buyer shall not commission the Product before acceptance. In case of breach of the afore-mentioned obligation, the Product shall be deemed accepted.
Installation, Acceptance. Clinic shall within 30 calendar days from the completion of the installation of the Software provide RaySearch with a signed Installation Acceptance Form, whereby Clinic confirms that RayStation has been delivered and installed according to the License Agreement. If the Installation Acceptance Form has not been signed within 30 calendar days, the installation shall be deemed completed and accepted unless Clinic, in writing, has raised justified complaint in respect of the installation.
Installation, Acceptance. SUPPORT, TRAINING -------------------------------------------
Installation, Acceptance. 6.4.1. After delivery, the Supplier shall be responsible for the installation of the Products on Site, in full compliance with the Technical Requirements and without any additional consideration than considered in Section 7 below. Upon installation of the Products, the IAA shall verify that it complies with all Technical Requirements and in particular with the compatibility requirements detailed above.
6.4.2. No later than 14 days after installation of the Products, the IAA shall either issue a certificate of acceptance regarding the Products (the “Certificate of Acceptance”) or deny the Products and request the Supplier to promptly correct, modify or replace them and all as further detailed in Section 6 of the Technical Specifications.
6.4.3. In the circumstances of denial of the Products by the IAA, the Supplier shall bear all costs and expenses related to the repair or replacement of the Products and delivery and installation thereof, within 30 days as of receipt of relevant notice from the IAA.
6.4.4. The Supplier may for the purpose of the installation, request from a subcontractor to install the Products on its behalf, provided the Supplier remains liable to the IAA for any damage, cost, loss or expense caused to the IAA as a result of a lack of performance or a deficiency in the installation of the Products.
Installation, Acceptance. Unless otherwise specified herein iBIZ shall install or provide for sale or distribution the Product in accordance with instructions provided by Licensor. iBIZ reserves the right to conduct acceptance testing within sixty (60) days of its receipt thereof, to demonstrate the Products conform to their respective Specifications. If a Product does not pass the acceptance test, iBIZ shall notify Licensor, specifying in reasonable detail in what respects the Product has failed to perform. Licensor shall promptly correct said deficiencies or accept the return of the Products for full refund of all fees paid therefore.
Installation, Acceptance. 8.1 Assembly or installation services are only part of the Deliveries if and to the extent that they are expressly stated in the order confirmation. The following provi- sions apply to assembly and installation services, unless expressly agreed otherwise in writing.
8.2 The Purchaser shall procure the following supplies at its own expense and provide them in good time: • The materials and substances required for as- sembly or installation, in particular lifting equipment and other devices, as well as lub- ricants; • Energy and water at the point of use, including connections, heating and lighting, in accord- ance with the respective assembly or installa- tion instructions of the Supplier; • At the site of installation, sufficiently large, suit- able, dry and lockable rooms for the stor- age of machine parts, appliances, materials, tools, etc. and adequate working and recrea- tion rooms, including appropriate sanitary fa- cilities for the installation personnel; • Necessary permits, work permits and approv- als.
8.3 In good time before the agreed date for the start of assembly or installation, the supplies and objects re- quired for the commencement of the work must be available at the installation or assembly site and any and all necessary preparatory work must have been carried out, including the levelling and clearing of the access routes and the installation or assembly site.
8.4 If installation, assembly or commissioning is delayed due to circumstances for which the Supplier is not responsible, the Purchaser shall bear the reasonable costs for additional expenses, such as travel and waiting time.
8.5 If the parties have agreed to an acceptance or if it is required by law, the following provisions shall ap- ply:
a) Acceptance must take place immediately after notification of completion, also in case of par- tial deliveries.
b) The Purchaser shall bear the costs of ac- ceptance.
c) In particular, an implied acceptance by the Purchaser is to be assumed if and to the extent that the Purchaser has commissioned, tested or otherwise used the Deliveries and has not notified the Supplier of any defects in the De- liveries within four weeks of this first use.
d) Acceptance shall be deemed to have taken place if the Supplier has set the Purchaser a reasonable period for acceptance in writing af- ter completion and the Purchaser has not re- fused acceptance within this period in writing stating a material defect.
Installation, Acceptance. Prior to final acceptance by IG, CIOM will perform a live session for Licensee demonstrating the features and functions of the system which shall materially comply with the functional specifications and related documentation as agreed to by the Parties.
Installation, Acceptance. Acceptance of the Efficiency Measures by Owner pursuant to Section 3.7 (Acceptance of Efficiency Measures).
Installation, Acceptance. Supplier will install any Products for which Purchaser pays the installation fee specified in Schedule 1 or for which installation is covered by the Maintenance Services. Amazon may inspect the Products prior to completion of installation as set forth in Section 9. 4.8
Installation, Acceptance. Customer will have a period of **** after Installation notification hereunder in which to notify Company of service troubles. Failure to notify Company of service troubles within **** after Installation notification constitutes acceptance of the circuit(s) from the first day of notification. Company will use commercially reasonable efforts to rectify service troubles promptly. Charges will not apply pending repair of service troubles associated with Installation. Troubles on such circuits must be reported on a circuit specific basis to Company support center.
