JOB VACANCIES. 1. When a vacancy occurs or a new job category is created the employer shall: a. publish on the Daily Bulletin, on a weekly basis the title of the open position, the normal hours of work for the open position, and a brief summary of the desired qualifications of applicants. The wage rate will not be published. b. send to the Secretary of the Union, on a weekly basis, a list of all vacancies which might exist at that time. c. For Food Services and Custodial section, Regular Ongoing vacancies will be posted twice per year, and Regular Recurring vacancies will be posted once per year. In the Custodial section, Regular Ongoing vacancies will normally be posted in June and November, and Regular Recurring vacancies will normally be posted in January. In Food Services, Regular Ongoing vacancies will normally be posted in May and November, and Regular Recurring vacancies will normally be posted in May. It is understood that some vacancies may be posted at other times through the year as the need arises. Postings that are not expected to be filled internally may be posted concurrently however the University agrees to review any internal applicants prior to reviewing any external applicants. Any concurrent job posting will apply only to Food Services and Custodial positions. Prior to any permanent vacant position being posted bargaining wide under clause #1, vacant assignments will be offered to interested employees, departmentally, as follows: (i) Food Services employees will submit a written expression of interest indicating that they wish to change their shift and/ or worksite. (ii) Vacancies will be offered within classification to the most senior qualified applicant. After the vacant assignment has been filled and prior to any position being posted bargaining unit wide, employees who had submitted a written expression of interest as per (i) above will be offered available backfill assignments, within their assigned working group (either student village facilities or other than student village facilities), and within classification, to the most senior qualified employee. 2. When a temporary position, which is expected to have a duration of two (2) months or more, becomes available a Regular employee as defined in Article 1, clause 3 (a) and (b), who has completed his/her probationary period will be offered a promotion to the temporary position consistent with the provisions of Article 8, clause 5 and clause 7(a) and 7(b) of the Collective agreement, provided: a. such employee has previously submitted a written expression of interest expressing interest in obtaining a temporary promotion to a higher job classification, and b. the employee possesses the minimum required qualifications for the temporary position. At the conclusion of such temporary position any Regular employee, as defined in Article 1, clause 3(a) and (b), who has accepted the temporary promotion will return to his/her former position with no loss of seniority. 3. Insofar as it is practicable to do so in the Food Services Department, the University agrees to give first consideration to the seniority standing of employees within each working seniority group as indicated in Article 8, clause 6 (a) (c) – student village facilities, and (b)

JOB VACANCIES. 1(a) On or before June 01 of each year, the Employer shall post a notice of vacancy for all Educational Assistant and Instructional Assistant positions which became permanently vacant since the last job posting and which are projected to continue for the following school year as well as all other known positions which will be available on the following September 01. When Such vacancies shall be awarded on or before June 25 to become effective on or before September 01. (b) On or before November 15 of each year, the Employer shall post a notice of vacancy for all Educational Assistant and Instructional Assistant positions which became permanently vacant since the beginning of the then current school year. Such vacancies shall be awarded by December 15 to become effective on the first day back to school after the Christmas Break for elementary and non-semestered schools and on the first day of the second semester for semestered secondary schools. (c) In this Article, the expression “permanent vacancy” means a vacancy occurs caused by such events as resignation, retirement, discharge, death or permanent transfer to another position and which is indefinite or long lasting in nature and does not include a vacancy caused by approved or authorized absence from work of an Employee. (a) Successful applicants shall be placed in their position and shall be subject to the following trial periods: (i) thirty (30) working days if the applicant has posted to a position within the same job classification; (ii) sixty (60) working days if the applicant has posted to a position within a different job classification. (b) If the applicant proves satisfactory, who has completed in the new position, the applicant shall be confirmed in writing. The trial period may be extended by mutual consent of the Employer and the Union. (c) Notwithstanding the provisions in this Article, when a job classification in a specific location is changed from full-time to part-time the Employee affected by such change will be notified and given the opportunity to remain in the position and seek an additional part-time position in order to retain their full- time status. If there is more than one (1) Employee in the same job classification in that specific location the least senior Employee shall be affected. (d) Notwithstanding the provisions in this Article, when a job classification in a specific location is changed from part-time to full-time, part-time Employee(s) in that job classification in that location will be offered the full-time position by order of seniority. Should the Employee(s) not wish to accept the full-time position, the full-time position will be posted on the following posting date. (e) In all instances, the Employee must indicate his/her probationary period intention to the Employer verbally within two (2) working days of receipt of such notice. (f) If the successful applicant proves unsatisfactory to the Employer during the trial period, or if the Employee is unable to perform the duties or if the Employee finds the position unsuitable in the case of a new classification, the Employee will be offered a promotion returned to the temporary Employee’s former position consistent with or another vacant position for which the provisions Employee is qualified in the same job classification, at the Employee’s former salary or rate of pay as may any other Employee in the bargaining unit, who was promoted or transferred by reason of such placing. (g) If there is no such other vacant position in the same job classification and the former position has been filled, the Employee will displace the individual who was successful in bidding into that position. If there is no other vacant position in the same job classification and in the interim, the former position has been declared permanently surplus, the surplus procedures shall be invoked and the Employee in question shall be considered to be in their former position for purposes of identifying the surplus Employee. (h) If an applicant is returned to the applicant's former position or some other position under Article 815.02 (a), clause 5 the Employer will offer the position to the next qualified, interviewed Employee and clause 7(a) and 7(bshould the Employer place any such Employee in the vacant position, paragraph (a) of the Collective agreementthis Article shall apply. (i) When filling temporary bargaining unit positions during a regularly scheduled lay-off, provided: a. such employee has previously meaning Christmas Break, March Break, Summer Break and/or intercession periods (schools which are on an alternate school year calendar), permanent Employees who have submitted a written expression notice to Human Resource Services of interest expressing their interest in obtaining a temporary promotion to a higher job classificationemployment and who possess the required skill, and b. the employee possesses the minimum required qualifications ability and qualifications for the temporary position, shall be offered the position on the basis of seniority before any temporary Employees, government project Employees, or students are hired. JOB VACANCIES. 131.01 A permanent vacancy shall exist when the employee is promoted, demoted, permanently transferred to another position, dies, resigns, retires or is terminated for just cause. A permanent vacancy shall also exist when a new job is created. A temporary vacancy is normally for a fixed length of time and/or is intended to replace a permanent employee for a pre-determined or unknown length of time. 31.02 Job postings shall normally reflect the job description and contain the following information: nature of position; qualifications; required knowledge and education, hours of work, salary range and location. In addition, postings for a temporary vacancy will normally indicate the start and end date of the vacancy. The Bargaining Unit President will receive a copy of all postings. 31.03 Permanent Vacancies must be filled in accordance with this article within 60 working days of the position becoming vacant. Where there is a vacancy in the bargaining unit that is known to last for not less than six (6) months, it shall be filled as follows: a) In order of seniority, to an employee who is on the recall list, or who has been declared surplus, subject to having the necessary qualifications, ability, knowledge and skills to perform the job; otherwise, b) The vacancy shall be posted for at least seven (7) working days prior to the closing date of the competition. For the purposes of posting positions in the months of July and August, vacancies shall be posted for at least ten (10) days. c) Where a vacancy in the bargaining unit is being filled by a casual employee and where the Employer subsequently becomes aware that the vacancy will continue for an additional period of not less than (6) six months the position will be posted. Vacancies which are not expected to be filled internally exceed sixty (60) calendar days and vacancies caused due to illness, accident, leaves of absence (including maternity) may be filled at the discretion of the Employer. In filling such vacancies, preference shall be given to regular part-time employees in the bargaining unit on the basis of seniority who are qualified to perform the work in question. It is understood, however, that where such vacancies occur on short notice, failure to consider part-time employees shall not result in any claim for pay for time not worked while proper arrangements are made to fill the vacancy. Where part-time employees fill temporary full-time vacancies, such employees shall be considered regular part-time and shall be covered by the terms of this Agreement. Upon completion of the temporary vacancy, such employee shall be reinstated to her former position unless the position has been discontinued, in which case she shall be given a comparable job. Where a temporary position is posted concurrently however in accordance with this article, the University agrees absent employee shall provide the employer with at least one (1) week notice of her intent to review any internal applicants prior return to reviewing any external applicants. JOB VACANCIES. 1. When a vacancy occurs or a new job category is created the employer shall: a. publish A. Vacancies shall be posted for a weekly basis minimum of five (5) working days and shall be posted no later than ten (10) working days following the title authorization of the open Assistant Superintendent for Human Resources to post.
