Continuing part-time positions that are twenty- four (24) hours a teaching assignment covered week or less shall be posted in accord- ance with this article; casual positions are not required to be posted. (b) The University agrees that, for appointments to positions within the bargaining unit, a reasonable familiarization period to learn the activities of a new position shall not be grounds to deny a person on lay-off a vacancy. 9.4 All applicants within the Union for any such position shall be interviewed in conjunction with external applicantsnotified of the successful applicant as soon as possible after the filling of the position. In the case of cancellation of the position, such applicants will also be notified. ii) The parties may agree to alter 9.5 If the process by mutual consentsuccessful applicant is presently a regular employee, in the event she proves unsatisfactory during the probationary period in the position, she shall be re-employed in a comparable vacancy without loss of seniority at her previous salary at the earliest availability of a comparable vacancy.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS(a) When any vacancy occurs, permanent or temporary (exceeding 16 working weeks) or a new position is created within the bargaining unit, and the Board proposes to fill such vacancy, the Board shall post a notice of the position on the Board intranet for a period of five (5) working days. A copy of the notice shall be sent to the Local. The Board will advise the President of the Local within seven (7) working days of the names of the successful applicant(s). 11.01 Elementary Teacher Vacancies(b) The notice shall contain the department, school or family of schools, and program, if applicable, nature of the position, qualifications, posting number, salary and the name of the official to whose attention the applications are to be directed. (c) Permanent vacancies not declared redundant by the Employer shall be posted within fifteen (15) working days of the vacancy. (d) When the posting procedure has been exhausted, the Board may assign the duties in reverse order of departmental seniority. 11:02 An employee who wished to apply for a posted vacancy shall make application in writing to the said official during the period of seven (7) working days mentioned in Article 11:01. In the event electronic mail (E-mail) becomes available at all posting locations, the parties agree to discuss the feasibility of reducing the number of posting days. 11:03 Departmental seniority shall be the determining factor is cases of assignment within the bargaining unit; provided the employee or employees who are affected have the skill, ability, and qualifications to do the work in question. If the employee proves unsatisfactory during that time, or if he/she prefers to revert to his/her previous position, or if he/she is unable to perform his/her new duties he/she will be returned to his/her former position at his/her former salary or rate of pay, as will any other employee in the bargaining unit who was promoted or transferred by reason of such placing. The time limit may be extended by written mutual consent of the Union and the Board. (b) If an applicant is returned to his/her former position under this clause, the Employer will give consideration to those employees who were unsuccessful applicants for the initial vacancy and should the Employer place any such employee in the vacant position, paragraph (a) of this clause shall apply. 11:05 The job left vacant by the successful applicant for the initial posting shall be posted in conformity with Article 11 and the subsequent vacancy so created shall also be posted. ELEMENTARY TEACHING POSITIONS 11.01 Elementary Teacher Vacancies (a) A vacancy means a teaching assignment covered by the Teachers’ Collective Agreement that is unoccupied because: i) the incumbent has been transferred, promoted or has resigned; ii) a vacancy that has occurred as defined by current legislation; iii) enrollment increase has created a new teaching vacancy; iv) a Teacher is on personal leave of absence for one full year or longer; or v) the incumbent has died. (b) Prior to external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures: (i) The Board shall post elementary vacancies for seven (7) Days prior to the closing date in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure secured website. A copy of all postings shall be forwarded to the Union. (ii) All applications from Occasional Teachers on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon request. (iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List. (iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on it until they have filled a job vacancy or until December 31 of each school year when the Board informs them in writing that they are no longer on the Preferred Hiring List is collapsedList. 11.01 (cb) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(iin 11.01(a)(ii) above) shall the Board advertise externally. (i) Elementary Occasional Teachers shall be interviewed in conjunction with external applicants. (ii) The parties may agree to alter the process by mutual consent. (a) The Board shall provide the Union with a current copy of the Recruiting and Hiring Policy.

(iv) Unsuccessful applicants will be advised that the successful applicant was awarded the job in accordance with the provisions of article 11.08(c)(iii) (d) In the event the employer does not select a candidate internally, then nothing herein interferes with the right of the Company to advertise externally or to fill such vacancy from outside sources if it so decides. Any jobs left vacant as the result of the filling of the original vacancy under the above procedure need not be posted. If such resulting vacancy is to be filled, it shall be filled in accordance with clause 11.07 (c) and 11.07 (d). (e) An employee who successfully bids on a job will not be permitted to bid again on another job for a period of six (6) months from the date of his successful bid. (f) Within the first three (3) months in the new position, the Company may return the successful applicant to his original job without loss of seniority or the employee may choose to return to the original job without loss of seniority. Anyone else affected by this process will be returned to his original job or will be laid off, as the case may be. If the applicant chooses to return to his original job the employee may not apply to the same position during the next eighteen (18) months. An employee who chooses to return to his original position may not do so until the expiry of any notice, which may be necessary in the event, the return to the original position results in a lay-off. Should the applicant return to his previous job within thirty (30) days of filling the position and the Company intends to fill the position, the other applicants from the same posting may be considered and appointed, or the Company may repost at its discretion. (g) Employees who are promoted to a supervisory position outside of the bargaining unit may remain in the supervisory position for a period of up to six (6) months during which time their seniority will continue to accumulate. If the employee is returned or returns to the bargaining unit within this time period then the employee shall lose no seniority. If the employee remains in the supervisory position for more than a period of six (6) months and returns to the bargaining unit thereafter he shall do so as a new employee. (i) The parties may agree to alter name of the process by mutual consentsuccessful applicant will be posted on the bulletin board.

Notification of vacancies and on the Occasional Teachers’ Hotline as well as the Board’s secure website. All other terms and conditions of the job advertisement will apply. d) All internal applicants for vacancies will be assessed on the basis of their qualification, knowledge, experience, attitude, past accomplishments, aptitude and potential. e) Any successful applicant will be advised as to why they were selected. Any unsuccessful internal applicants will be advised why they were not selected. f) After giving due consideration to all internal applicants, if in CEAL’s view, an appropriate internal applicant is not identified, CEAL will seek external applications. g) External applicants will undergo pre-employment checks to ensure suitability to undertake the proposed position. The pre-employment checks will be determined and agreed via the JCC. h) It is accepted that during the life of this agreement resignations and/ or retirements will take place. In such circumstances replacement will not be automatic. The decision whether to replace particular positions will be based on the companies assessment consistent with continuously improving productivity. The company will work to a Preferred Hiring List, they shall stay on timetable where it until they have filled will fill a vacancy within 3 months. Selection between employees in the same classification and department will be based on seniority, provided the employee possess the necessary qualifications to perform the closing date required duties. Where there are no employees within the classification who apply or are able to meet the minimum requirements, the remaining candidates will be considered in all elementary schools and accordance with Article 11.06(c). Applicants will put their signature on the Occasional Teachers’ Hotline postings. All subsequent postings created by filling a posted vacancy will be posted for four (4) consecutive calendar days. Vacancies which are not expected to exceed sixty (60) days may be filled at the discretion of the Employer. The Board agrees that notices of vacancies shall be posted on the district’s website at least ten (10) 7 calendar days before the application deadline. 11.01 Elementary Teacher Vacancies9 B.
