(a) A vacancy means The Employer shall continue its current practice of providing written notice of continuing and term job va- cancies. Continuing part-time positions that are twenty- four (24) hours a teaching assignment covered week or less shall be posted in accord- ance with this article; casual positions are not required to be posted. Such vacancies shall be posted for a per- iod of not less than six (6) working days. Employees desiring consideration in the filling of these continuing and term job vacancies shall signify their desire by sub- mitting a written application during the Teachers’ Collective Agreement that period in which it is unoccupied because:
i) the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred posted. The Employer may advertise externally as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedwell as posting internally. Qualified internal applicants will be interviewed prior to external applicants.
(b) Prior to external advertisingIn all cases of filling permanent vacancies, promotions/ demotions, transfers, layoffs, and recall after layoff, the Board shall attempt University will select the qualified candidate, if any, who the University can demonstrate is the most quali- fied candidate for the position taking into account skill, ability, qualifications, and relevant experience. Where these factors are relatively equal between two or more candidates, the candidate with more seniority will be selected. The University agrees that the onus lies with the employer to fill elementary teaching vacancies subject demonstrate that the successful xxxxx- date was the most qualified. Where an external appli- cant is selected, when requested to do so, the following procedures:

iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on it until they have filled a job vacancy or until December 31 of each school year when the Preferred Hiring List is collapsedexternal candidates.
(c) Only after Occasional Teachers have been short listed When an employee applies, is found to be qualified, but is not given the position, the employee may ask for interviews (as through 11.01(b)(i) above) shall the Board advertise externallyand will be given advice on how to improve their qualifi- cations, and assistance in developing a career develop- ment plan and/or job search skills.
i(d) Occasional Teachers In the event that a successful applicant proves unsatis- factory during or at the end of a familiarization period of thirty (30) calendar days or feels dissatisfied and chooses not to continue in the position within a seven (7) calendar day period, they shall be interviewed in conjunction with external applicantsreturned to their former job.

i9.2 The notice referred to in Article 9.1(a) Occasional Teachers above will contain the following information: classification, term of employment, if applicable, qualifications, job duties, hours of work, starting date and salary range.
(a) The governing factors for appointments to positions with-in the bargaining unit are qualifications, seniority and ability. If, in consideration of these factors, the University judges two (2) or more candidates to be satisfactory and equal in regard to qualifications and ability, the candidate with the most seniority will be given preference.
(b) The University agrees that, for appointments to positions within the bargaining unit, a reasonable familiarization period to learn the activities of a new position shall not be grounds to deny a person on lay-off a vacancy.
9.4 All applicants within the Union for any such position shall be interviewed in conjunction with external applicantsnotified of the successful applicant as soon as possible after the filling of the position. In the case of cancellation of the position, such applicants will also be notified.
ii) The parties may agree to alter 9.5 If the process by mutual consentsuccessful applicant is presently a regular employee, in the event she proves unsatisfactory during the probationary period in the position, she shall be re-employed in a comparable vacancy without loss of seniority at her previous salary at the earliest availability of a comparable vacancy.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS(a) When any vacancy occurs, permanent or temporary (exceeding 16 working weeks) or a new position is created within the bargaining unit, and the Board proposes to fill such vacancy, the Board shall post a notice of the position on the Board intranet for a period of five (5) working days. A copy of the notice shall be sent to the Local. The Board will advise the President of the Local within seven (7) working days of the names of the successful applicant(s).
11.01 Elementary Teacher Vacancies(b) The notice shall contain the department, school or family of schools, and program, if applicable, nature of the position, qualifications, posting number, salary and the name of the official to whose attention the applications are to be directed.
(c) Permanent vacancies not declared redundant by the Employer shall be posted within fifteen (15) working days of the vacancy.
(d) When the posting procedure has been exhausted, the Board may assign the duties in reverse order of departmental seniority.
11:02 An employee who wished to apply for a posted vacancy shall make application in writing to the said official during the period of seven (7) working days mentioned in Article 11:01. In the event electronic mail (E-mail) becomes available at all posting locations, the parties agree to discuss the feasibility of reducing the number of posting days.
11:03 Departmental seniority shall be the determining factor is cases of assignment within the bargaining unit; provided the employee or employees who are affected have the skill, ability, and qualifications to do the work in question. If there is no applicant or no successful applicant, the Employer shall give consideration to applicants from CUPE 1358.1 Bargaining Unit prior to going outside the bargaining unit to fill the vacancy.
(a) If there is a successful applicant, he/she will then be placed in the vacancy for a trial period not exceeding twenty-five (25) working days, and if he/she proves satisfactory he/she will then be confirmed in his/her new classification. If the employee proves unsatisfactory during that time, or if he/she prefers to revert to his/her previous position, or if he/she is unable to perform his/her new duties he/she will be returned to his/her former position at his/her former salary or rate of pay, as will any other employee in the bargaining unit who was promoted or transferred by reason of such placing. The time limit may be extended by written mutual consent of the Union and the Board.
(b) If an applicant is returned to his/her former position under this clause, the Employer will give consideration to those employees who were unsuccessful applicants for the initial vacancy and should the Employer place any such employee in the vacant position, paragraph (a) of this clause shall apply.
11:05 The job left vacant by the successful applicant for the initial posting shall be posted in conformity with Article 11 and the subsequent vacancy so created shall also be posted. The Employer may but shall not be required to post any notice of vacancy until the first successful applicant under Article 11:03 has successfully passed his/her trial period.
11:06 The Secretary and President of the Union will be notified monthly, in writing, of all appointments, hirings, transfers, lay-offs, recalls and terminations of employment. The address of each new employee shall be supplied to the Union with the notification of hire, unless the employee requests such information be withheld.
11:07 Whenever the Employer designates a new occupational classification covered by this agreement or a new permanent position is created, it will prepare and send to the Union a description thereof ten (10) days prior to posting the position under Article 11. This clause is subject to the exception contained in Article 10:03. At the request of either party a meeting shall be called to discuss such changes.
11:08 When a vacancy or new position is created inside the bargaining unit the employer will notify the union in writing and post the position as required by Article 11:01 (a). If there is a vacancy or a new position in a job outside of the bargaining unit which is similar to the work of the bargaining unit, the employer shall notify the union in writing and post a notice of the position for informational purposes only.
(a) Where two (2) employees working in different schools or assignment of school, in the same job classification wish to exchange assignments on a permanent or temporary basis, they shall make application to the appropriate Superintendent in writing between May 1st and July 31st of any year. The Superintendent shall not unreasonably withhold approval. The exchange shall be granted commencing with the September term if possible. It is further understood and agreed that the “term” temporary as used in this clause shall be for a period of one (1) year.
(b) The Employer will maintain a voluntary exchange list. All Employees will have access to the exchange list

The Executive Director, or designee, shall decide the relative qualifications, skills, abilities, attendance record and discipline record of an applicant for a teaching assignment covered position. First consideration for vacant bargaining unit positions shall be given to bargaining unit employees, provided that such employees have the qualifications, skills, abilities, attendance record, and discipline record, for the position in question. When these factors for two or more applicants for a given position are substantially equal, as determined by the Teachers’ Collective Agreement that is unoccupied because:
i) Employer, seniority shall be the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has dieddetermining factor.
(b) Prior The goal of the job posting policy is to ensure that all employees are made aware of and have the opportunity to apply for open OPEIU positions either before or concurrent with the Employer’s consideration of external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures:
i) The Board shall post elementary vacancies candidates for seven (7) Days prior to the closing date in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure website. A copy of all postings shall be forwarded to the Union.
ii) All applications from Occasional Teachers on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon request.
iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.

The business conditions that could cause this decision include, but are not limited to: organizational restructuring; urgency of filling the position; position requirements that include skills, education, and/or experience that are not known to match any existing employee; critical operational needs; etc. The decision to recruit from the outside at the same time as through 11.01(b)(i) above) shall posting requires approval of a Human Resources representative and the Board advertise externallyDepartment Director.
i(d) Occasional Teachers shall be interviewed in conjunction with external applicantsEmployees who wish to apply for posted positions must apply online through the Employer website at xxx.xxxxxxxxxxxxx.xxx.
ii(e) The parties In the event that an employee promotes or transfers into a new or different position and their performance is unsatisfactory and/or they are unable to meet the essential tasks of the position, the employee shall return to their previous position if it is still vacant but, has no right to bump back to their old position or to any other position.
(f) New hires and personnel in new positions may agree to alter the process by mutual consentnot apply for promotions, transfers, etc. or new positions until they have successfully completed their probationary period and any extensions thereof. Unusual circumstances may be open for discussion.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS10.01 When filling job vacancies (except to positions excluded from the bargaining unit), and in cases of layoff or recall of the working force, the following factors will be considered.

11.01 Elementary Teacher Vacancies
(a) A Where a permanent vacancy means occurs in a teaching assignment covered classification within the bargaining unit, which the Employer has determined to fill or a new position within the bargaining unit is established by the Teachers’ Home, such vacancy shall be posted for a period of ten (10) consecutive calendar days. Employees within the same classification and department will have first opportunity for selection. Selection between Employees in the same classification and department will be based on seniority, provided the Employee possesses the necessary qualifications to perform the required duties. Where there are no Employees within the classification who apply or are able to meet the minimum requirements, the remaining candidates will be considered in accordance with Article 11.06(c). The first subsequent vacancy created by the filling of a posted vacancy will be posted for five (5) consecutive calendar days. All other subsequent vacancies need not be posted. Vacancies which are not expected to exceed ninety (90) days may be filled at the discretion of the Employer. Where Part-Time Employees fill temporary Full-Time vacancies, such Employees will continue to be considered as Part-Time Employees for the purpose of the Collective Agreement that is unoccupied because:
i) Agreement. Upon completion of the incumbent temporary vacancy, all affected Employees will be reinstated to their for- position, unless the position has been transferreddiscontinued, promoted or has resigned;
ii) in which case they shall be placed in a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedcomparable position.
(b) Prior to external advertisingUpon request, a list of vacancies filled in the Board shall attempt to fill elementary teaching vacancies subject to preceding month under Article 11.06(a), and the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days prior to names of the closing date in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure website. A copy of all postings shall successful applicants, will be forwarded provided to the Union. Unsuccessful applicants will be notified prior to successful applicants, where possible. At the request of the Employee, the Employer will discuss with unsuccessful applicants ways in which they can improve their qualifications for future postings.
iic) Employees shall be selected for positions under 11.06(a) on the basis of Seniority, qualifications, skill, ability and work record. Where these are relatively equal, seniority shall be the determining factor.
d) All applications from Occasional Teachers vacancies shall be posted on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon requestEmployee bulletin board.

iv) . Once an Occasional Teachers have has been placed on a Preferred Hiring the Long-Term Occasional List, they shall stay on it until they have filled a job vacancy or until December 31 of each school year when the Preferred Hiring Long- Term Occasional List is collapsed.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) shall the Board board advertise externally.
i) i. Occasional Teachers shall be interviewed in conjunction with external applicants.
ii) . The parties may agree to alter the process by mutual consent.
(d) Occasional Teachers, who are currently teaching in Long-Term Occasional assignments that have not concluded by the commencement date of the teacher vacancy, shall be eligible to apply for the new posted teacher vacancy.
L11.02 The board shall include Occasional Teachers in any scheduled training/in- servicing regarding recruiting.

11.01 Elementary Teacher Vacancies
(a) A vacancy means a teaching assignment covered by the Teachers’ Collective Agreement that is unoccupied because:
i) the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has died.
(b) Prior to external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures:
(i) The Board shall post elementary vacancies for seven (7) Days prior to the closing date in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure secured website. A copy of all postings shall be forwarded to the Union.
(ii) All applications from Occasional Teachers on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon request.
(iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.
(iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on it until they have filled a job vacancy or until December 31 of each school year when the Board informs them in writing that they are no longer on the Preferred Hiring List is collapsedList.
11.01 (cb) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(iin 11.01(a)(ii) above) shall the Board advertise externally.
(i) Elementary Occasional Teachers shall be interviewed in conjunction with external applicants.
(ii) The parties may agree to alter the process by mutual consent.
(a) The Board shall provide the Union with a current copy of the Recruiting and Hiring Policy.

11.01 Elementary Teacher Vacancies
(a) A vacancy means a teaching assignment covered by Job vacancies or newly created jobs that are within the Teachers’ Collective Agreement that is unoccupied because:
ibargaining unit and which will be of more than three (3) months duration will be posted for three (3) working days on the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedbulletin board.
(b) Prior to external advertising, An employee desiring consideration in the Board shall attempt to fill elementary teaching vacancies subject to filling of the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days prior to position must make application in writing during the closing date period in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure website. A copy of all postings shall be forwarded to the Union.
ii) All applications from Occasional Teachers on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon request.
iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.
iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on which it until they have filled a job vacancy or until December 31 of each school year when the Preferred Hiring List is collapsedposted.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) In filling the position, the following factors shall the Board advertise externallybe considered.
(i) Occasional Teachers shall be interviewed the skill, reliability, qualifications and efficiency of the applicants;
(ii) seniority in conjunction with external the bargaining unit of the applicants.
ii(iii) when the factors in (i) are relatively equal, then seniority shall prevail.
(iv) Unsuccessful applicants will be advised that the successful applicant was awarded the job in accordance with the provisions of article 11.08(c)(iii)
(d) In the event the employer does not select a candidate internally, then nothing herein interferes with the right of the Company to advertise externally or to fill such vacancy from outside sources if it so decides. Any jobs left vacant as the result of the filling of the original vacancy under the above procedure need not be posted. If such resulting vacancy is to be filled, it shall be filled in accordance with clause 11.07 (c) and 11.07 (d).
(e) An employee who successfully bids on a job will not be permitted to bid again on another job for a period of six (6) months from the date of his successful bid.
(f) Within the first three (3) months in the new position, the Company may return the successful applicant to his original job without loss of seniority or the employee may choose to return to the original job without loss of seniority. Anyone else affected by this process will be returned to his original job or will be laid off, as the case may be. If the applicant chooses to return to his original job the employee may not apply to the same position during the next eighteen (18) months. An employee who chooses to return to his original position may not do so until the expiry of any notice, which may be necessary in the event, the return to the original position results in a lay-off. Should the applicant return to his previous job within thirty (30) days of filling the position and the Company intends to fill the position, the other applicants from the same posting may be considered and appointed, or the Company may repost at its discretion.
(g) Employees who are promoted to a supervisory position outside of the bargaining unit may remain in the supervisory position for a period of up to six (6) months during which time their seniority will continue to accumulate. If the employee is returned or returns to the bargaining unit within this time period then the employee shall lose no seniority. If the employee remains in the supervisory position for more than a period of six (6) months and returns to the bargaining unit thereafter he shall do so as a new employee.
(i) The parties may agree to alter name of the process by mutual consentsuccessful applicant will be posted on the bulletin board.

11.01 Elementary Teacher Vacancies
(a) A Casual labour may be used to fill a job vacancy means in line with clause 9 of this agreement. If the job vacancy is a teaching assignment covered permanent position, the position must be filled by the Teachers’ Collective Agreement that is unoccupied because:
i) the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedpermanent employee within 3 months.
(b) Prior to external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures:
i) The Board shall post elementary All Distribution Centre position vacancies for seven (7) Days prior to the closing date in all elementary schools grade levels will be advertised internally for a period of not less than 48 hours. Notification of vacancies and on the Occasional Teachers’ Hotline as well as the Board’s secure website. A copy of all postings shall position requirements will be forwarded to the Union.
ii) All applications from Occasional Teachers on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon request.
iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring ListDistribution Centre noticeboard. All applications will have the date posted and a close date on them. Applicants responding to an internal advertisement shall be full time permanent Employees unless otherwise agreed by CEAL and the Union Delegates.
ivc) Once Occasional Teachers have been placed All internal applicants must notify the person specified in the advertisement as to their interest in the position within the time frame specified in the advertisement. All other terms and conditions of the job advertisement will apply.
d) All internal applicants for vacancies will be assessed on the basis of their qualification, knowledge, experience, attitude, past accomplishments, aptitude and potential.
e) Any successful applicant will be advised as to why they were selected. Any unsuccessful internal applicants will be advised why they were not selected.
f) After giving due consideration to all internal applicants, if in CEAL’s view, an appropriate internal applicant is not identified, CEAL will seek external applications.
g) External applicants will undergo pre-employment checks to ensure suitability to undertake the proposed position. The pre-employment checks will be determined and agreed via the JCC.
h) It is accepted that during the life of this agreement resignations and/ or retirements will take place. In such circumstances replacement will not be automatic. The decision whether to replace particular positions will be based on the companies assessment consistent with continuously improving productivity. The company will work to a Preferred Hiring List, they shall stay on timetable where it until they have filled will fill a vacancy within 3 months. When a job vacancy or until December 31 of each school year when has been filled, all managers, supervisors and Grade 5’s will be notified as to the Preferred Hiring List is collapsedappropriate details by the relevant Manager/Supervisor.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) shall the Board advertise externally.
i) Occasional Teachers shall be interviewed in conjunction with external applicants.

11.01 Elementary Teacher Vacancies
(a) A Where a permanent vacancy means occurs in a teaching assignment covered classification within the bargaining unit or a new position in the bargaining unit is established by the Teachers’ Collective Agreement that is unoccupied because:
i) the incumbent has been transferredHome, promoted or has resigned;
ii) such vacancy shall be posted for a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave period of absence for one full year or longer; or
v) the incumbent has died.
(b) Prior to external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days prior consecutive calendar days. Employees within the same classification and department will have first opportunity for selection. Selection between employees in the same classification and department will be based on seniority, provided the employee possess the necessary qualifications to perform the closing date required duties. Where there are no employees within the classification who apply or are able to meet the minimum requirements, the remaining candidates will be considered in all elementary schools and accordance with Article 11.06(c). Applicants will put their signature on the Occasional Teachers’ Hotline postings. All subsequent postings created by filling a posted vacancy will be posted for four (4) consecutive calendar days. Vacancies which are not expected to exceed sixty (60) days may be filled at the discretion of the Employer. Where part‐time employees fill temporary full‐time vacancies, such employees will continue to be considered as well as part‐time employees for the Board’s secure websitepurpose of the collective agreement. A copy Upon completion of the temporary vacancy, all postings affected employees will be reinstated to their former position, unless the position has been disconnected, in which case they shall be forwarded placed in a comparable position.
b) Upon request, a list of vacancies filled in the preceding month under Article 11.06(a), and the names of the successful applicants, will be provided to the Union. Unsuccessful applicants will be notified prior to successful applicants, where possible. At the request of the Employee, the Employer will discuss with unsuccessful applicants ways in which they can improve their qualifications for future postings.
iic) Employees shall be selected for positions under 11.06(a) on the basis of Seniority, qualifications, skill, ability and work record. Where these are relatively equal, seniority shall be the determining factor.
d) All applications from Occasional Teachers vacancies shall be posted on the List shall employee bulletin board. A photocopy of the job posting with signatures in tact will be screened according given to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon requestchief xxxxxxx.
iiie) The Board Where the applicant has been selected in accordance with this article and it has been subsequently determined that she cannot satisfactorily perform the job which she was awarded, the employee or employer may during the first thirty (30) shifts (225 hours for employees whose regular hours of work are other than the standard work day) worked from the date from which the employees was first assigned to the vacancy, returned to her former job, and the filling of the subsequent vacancies will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring Listbe reversed.
ivf) Once Occasional Teachers have been placed on An employee selected for a Preferred Hiring Listvacancy need not to be considered for a further vacancy for a period of up to six (6) months from the date of selection, they shall stay on it until they have filled unless such position is a job permanent position or is a substantial betterment to their current vacancy or until December 31 of each school year when the Preferred Hiring List their current posting is collapsedexhausted.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) shall the Board advertise externally.
i) Occasional Teachers shall be interviewed in conjunction with external applicants.
ii) The parties may agree to alter the process by mutual consent.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS6 A. The Board agrees that notices of vacancies shall be posted on the district’s website at least ten (10) 7 calendar days before the application deadline.
11.01 Elementary Teacher Vacancies9 B. Within fifteen (15) days after filling the vacancy, the Superintendent shall give written notice thereof to 10 all educators who shall have made written application for said position. Within five (5) days after 11 receipt of such notice, an educator who was not selected to fill said vacancy may request a conference 12 with the Hiring Administrator to discuss with her/him the reasons for her/his decision. Such 13 conferences shall be scheduled as soon as practicable.
(a) A vacancy means a teaching assignment covered 15 C. In the filling of vacancies as set forth above, any educator presently employed by the Teachers’ Collective Agreement that is unoccupied becauseBoard, who 16 applies for a position and meets the stated qualifications for the position, shall be scheduled for an 17 interview. If the foregoing procedures have been followed, the Superintendent's decision as to who shall 18 fill a vacancy shall be final.
20 D. The Board agrees to give notice of acting positions as follows:
i22 1. Summer Appointments: Any educator who wishes to be notified of an acting position vacancy 23 that may occur during the summer shall notify the Superintendent in writing prior to June l of 24 each year, indicating the position of interest and the educator's summer address. Each such 25 educator shall receive a written notice of any indicated acting position vacancy, postmarked at 26 least ten (10) calendar days before the incumbent has been transferreddate of appointment for vacancies occurring prior to 27 August l, promoted or has resigned;and five (5) calendar days for vacancies occurring after August l.
ii29 2. School Year Appointments: Only acting position vacancies that (l) a vacancy that has occurred as defined by current legislation;
iiioccur during the first 30 semester of the school year and (2) enrollment increase has created a new teaching vacancy;
ivare expected to extend for at least the balance of the school 31 year shall be posted in each school. Such postings shall be for at least five (5) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has died.
(b) Prior to external advertising, the Board shall attempt to fill elementary teaching vacancies subject to the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days calendar days 32 prior to the closing date in all elementary schools and on of appointment. 34 The provisions of this Section D shall not be construed so as to limit the Occasional Teachers’ Hotline scope of the Superintendent's 35 discretion as well as the Board’s secure website. A copy of all postings to who shall be forwarded appointed to the Union.
ii) All applications from Occasional Teachers on the List an acting position, and any decision thereon shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon requestfinal.
iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.
