11.02 In considering applications from regular employees for job postings, employees with seniority and qualifications will be given consideration on a plant-wide basis in filling such jobs. Any employee aggrieved by The senior applicant qualified to perform the job will be selected. Qualifications as applied to job postings shall mean such factors relating to job performance as physical fitness, skill and ability, licenses (where required) and past work record with the Company. JOB VACANCIES. 10.01 Prior (a) Booked Jobs: All booked and posted jobs shall be frozen for the duration of a Booking as long as City efficiency is not impaired. Any permanent or temporary shift vacancies due to posting employees being on vacation, leave of absence, illness, etc. shall be made available to Spares by order of seniority. New employees hired between bookings shall hold trainee or Spare status and fill open slots. Spares shall be given the opportunity, provided they are qualified, to select an open permanent shift and give up their Spare status for the remainder of a job and when booking. Notice in writing signed by the company determines employee shall be forwarded to the Union. In an emergency, where no qualified Spares are available, the vacancy may be made available to regular booked employees by order of seniority on the shift where the vacancy has occurred. Notification of vacancies and position requirements will be placed on the Distribution Centre noticeboard. All applications will have the date posted and a close date on them. Applicants responding to an internal advertisement shall be posted full time permanent Employees unless otherwise agreed by CEAL and the Union Delegates.
c) All internal applicants must notify the person specified in the advertisement as to their interest in the position within thirty (30the time frame specified in the advertisement. All other terms and conditions of the job advertisement will apply.

h) It is accepted that during the life of this agreement resignations and/ or retirements will take place. In such circumstances replacement will not be automatic. The decision whether to replace particular positions will be based on the companies assessment consistent with continuously improving productivity. The company will work to a timetable where it will fill a vacancy within 3 months. When a job has been taken down. Any employee aggrieved filled, all managers, supervisors and Grade 5’s will be notified as to the appropriate details by the selection shall have the right to present their grievance in accordance with the provisions of Article 17,relevant Manager/Supervisor.

JOB VACANCIES. 10.01 Prior to A. All positions declared vacant by the Superintendent, or his/her designee, shall be posted for a period of seven (7) calendar days and such posting a job and when shall include, among other things, the company determines a vacancy exists and is going to post such a positionclassification title, employees within the same job title as the position vacancy will be polled by seniority to determine if there is any interest in the vacancy. The qualified senior employee will be allowed to fill the vacancy from this bargaining unit wage rate, work schedule, work location, and the resulting vacancy will be posted.
10.02 The Company will determine the methods and procedures used for posting jobs. Such notice shall include the title and location qualifications of the job, . Employees possessing the qualifications needed for the job, vacant position may bid upon the closing job within the seven (7) calendar days and bids received after that date for submission of interest and the process for submitting interest. Only those job vacancies which the Company has declared to shall not be a job vacancy will be available for employee bids. The Company will provide a copy of the posting to the union. The Company may post vacancies as fully qualifiedconsidered. When ability, merit, capacity and qualifications are equal among the company posts a job as fully qualified, it does not restrict interested and qualified employees from submitting a bid for the fully qualified position. Employees must submit interest through the methods and procedures determined by the Company within the timeframe indicated on the posting. If two or more employees meet the fully qualified requirements, then seniority shall prevail. The Company will attempt to fill the vacancy internally from those employees submitting a job bid request. However, it is understood that the Company may also consider candidates outside the bargaining unit when filling vacancies. In order to be considered a candidate for selection, the candidate must successfully pass any reasonable and job appropriate tests used by the Company applicants bidding for the position, then the position shall be awarded to the senior employee applicant who is clearly qualified in all respects to perform all of the required duties of the vacant position. If The employee awarded the candidate passes such testingposition shall be subject to a trial period, or if the Company elects not to use testing as part of the selection process, qualifications shall be determined by the total circumstances including work experience, performance (and any performance evaluations), applicable technical education and attendance. The position will be filled by the most qualified candidate as determined by the Company. Seniority will govern in the event multiple internal candidates are determined to be most qualified by the Company. If no candidates are deemed qualified by the Company, the Company may elect to fill the vacancy from any available source. If the employee is not selected, the Company will meet and discuss with the employee the necessary skill sets and qualifications that are required. The Company will discuss and suggest avenues by which the employee can pursue in an effort for the employee to fill future job openings.
10.03 Notice as to who was selected to fill the vacancy will be posted on the bulletin boards and copy of such notice will be furnished the Local Union President. The selection to fill a job shall be posted within exceed thirty (30) days of actual work, to determine that he/she is capable of performing the required work in a manner satisfactory to the School District. At any time during the trial period the Superintendent, or his/her designee, in his/her sole discretion, may disqualify the employee and the employee shall be permitted to return to his/her former position. Provided, however, this right to return shall not be applicable if the employee is discharged for just cause. It is expected that initial postings will be open to inside and outside candidates alike. In the event the Employer decides to open a position to outside applicants after the initial posting, it will provide written notice to the Union. A disqualified employee may file a grievance and pursue the grievance through Step 2 of the Grievance Procedure, but the decision of the Superintendent, or his/her designee, shall be final and binding on the aggrieved employee and the Union, and the decision to disqualify shall not be subject to the arbitration provisions of this Agreement.
B. The former job position of an employee who is serving a trial period may be filled without posting on a temporary basis by a current or substitute employee during the former employee's trial period.
C. All applicants shall be informed in writing of the decision regarding her application promptly following the decision. In the event the senior employee applicant does not receive the position, upon written request from the employee, the Employer will provide said employee with written reasons for the denial.
D. In the event that a position is filled by an employee who has had school office experience, allowances may be made for such experiences.
E. No vacancy shall be filled except in case of an emergency on a temporary basis, until such vacancy shall have been posted job for at least seven (7) calendar days, except as provided in Section B of this Article. When a position is filled on a temporary or emergency basis, the president of the Local will be notified promptly following the decision.
F. When an employee has been taken down. Any previously displaced due to job elimination, said employee aggrieved by the selection shall have the right to present their grievance return to the next vacancy in accordance with the position classification from which the employee had been displaced; provided, such employee is clearly qualified in all respects to perform the required duties of the vacant position. This provision supersedes and shall be applied without regard to the seniority provisions of Article 17,Paragraph B above.

JOB VACANCIES. 10.01 Prior Section 8.1 A position shall be considered vacant when an employee has separated from University employment, for any reason, voluntarily or involuntarily. A new position created by the University shall also be considered a vacant position. Should the University decide to posting fill a job and when the company determines a vacancy exists and is going to post such a vacant position, employees the position shall be posted according to the procedure in Section 8.2. Should the University decide not to fill a vacant position, if the Union submits a written request to the Manager of Labor Relations, the University shall provide a reason for the decision in writing to the Union. Vacancies must be posted within 30 days of the last incumbent’s permanent separation or reassignment.
