(a) A vacancy means The Employer shall continue its current practice of providing written notice of continuing and term job va- cancies. Continuing part-time positions that are twenty- four (24) hours a teaching assignment covered week or less shall be posted in accord- ance with this article; casual positions are not required to be posted. Such vacancies shall be posted for a per- iod of not less than six (6) working days. Employees desiring consideration in the filling of these continuing and term job vacancies shall signify their desire by sub- mitting a written application during the Teachers’ Collective Agreement that period in which it is unoccupied because:
i) the incumbent has been transferred, promoted or has resigned;
ii) a vacancy that has occurred posted. The Employer may advertise externally as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedwell as posting internally. Qualified internal applicants will be interviewed prior to external applicants.
(b) Prior to external advertisingIn all cases of filling permanent vacancies, promotions/ demotions, transfers, layoffs, and recall after layoff, the Board shall attempt University will select the qualified candidate, if any, who the University can demonstrate is the most quali- fied candidate for the position taking into account skill, ability, qualifications, and relevant experience. Where these factors are relatively equal between two or more candidates, the candidate with more seniority will be selected. The University agrees that the onus lies with the employer to fill elementary teaching vacancies subject demonstrate that the successful xxxxx- date was the most qualified. Where an external appli- cant is selected, when requested to do so, the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days prior University will meet with the Union to elaborate upon its selec- tion decision. On an annual basis, the closing date in all elementary schools University will provide the Union the percentage of successful internal and on the Occasional Teachers’ Hotline as well as the Board’s secure website. iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.
iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on it until they have filled a job vacancy or until December 31 of each school year when the Preferred Hiring List is collapsedexternal candidates.
(c) Only after Occasional Teachers have been short listed When an employee applies, is found to be qualified, but is not given the position, the employee may ask for interviews (as through 11.01(b)(i) above) shall the Board advertise externallyand will be given advice on how to improve their qualifi- cations, and assistance in developing a career develop- ment plan and/or job search skills.
i(d) Occasional Teachers In the event that a successful applicant proves unsatis- factory during or at the end of a familiarization period of thirty (30) calendar days or feels dissatisfied and chooses not to continue in the position within a seven (7) calendar day period, they shall be interviewed in conjunction with external applicantsreturned to their former job.

(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) shall the Board board advertise externally.

(d) Occasional Teachers, who are currently teaching in Long-Term Occasional assignments that have not concluded by the commencement date of the teacher vacancy, shall be eligible to apply for the new posted teacher vacancy.

iii) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.
iv) Once Occasional Teachers have been placed on a Preferred Hiring List, they shall stay on which it until they have filled a job vacancy or until December 31 of each school year when the Preferred Hiring List is collapsedposted.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) In filling the position, the following factors shall the Board advertise externallybe considered.
(i) Occasional Teachers shall be interviewed the skill, reliability, qualifications and efficiency of the applicants;
(ii) seniority in conjunction with external the bargaining unit of the applicants.
ii(iii) when the factors in (i) are relatively equal, then seniority shall prevail.
(iv) Unsuccessful applicants will be advised that the successful applicant was awarded the job in accordance with the provisions of article 11.08(c)(iii)
(d) In the event the employer does not select a candidate internally, then nothing herein interferes with the right of the Company to advertise externally or to fill such vacancy from outside sources if it so decides. Any jobs left vacant as the result of the filling of the original vacancy under the above procedure need not be posted. If such resulting vacancy is to be filled, it shall be filled in accordance with clause 11.07 (c) and 11.07 (d).
(e) An employee who successfully bids on a job will not be permitted to bid again on another job for a period of six (6) months from the date of his successful bid.
(f) Within the first three (3) months in the new position, the Company may return the successful applicant to his original job without loss of seniority or the employee may choose to return to the original job without loss of seniority. Anyone else affected by this process will be returned to his original job or will be laid off, as the case may be. If the applicant chooses to return to his original job the employee may not apply to the same position during the next eighteen (18) months. An employee who chooses to return to his original position may not do so until the expiry of any notice, which may be necessary in the event, the return to the original position results in a lay-off. Should the applicant return to his previous job within thirty (30) days of filling the position and the Company intends to fill the position, the other applicants from the same posting may be considered and appointed, or the Company may repost at its discretion.
(g) Employees who are promoted to a supervisory position outside of the bargaining unit may remain in the supervisory position for a period of up to six (6) months during which time their seniority will continue to accumulate. If the employee is returned or returns to the bargaining unit within this time period then the employee shall lose no seniority. If the employee remains in the supervisory position for more than a period of six (6) months and returns to the bargaining unit thereafter he shall do so as a new employee.
(i) The parties may agree to alter name of the process by mutual consentsuccessful applicant will be posted on the bulletin board.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS6 A. The Board agrees that notices of vacancies shall be posted on the district’s website at least ten (10) 7 calendar days before the application deadline.
11.01 Elementary Teacher Vacancies9 B. Within fifteen (15) days after filling the vacancy, the Superintendent shall give written notice thereof to 10 all educators who shall have made written application for said position. Within five (5) days after 11 receipt of such notice, an educator who was not selected to fill said vacancy may request a conference 12 with the Hiring Administrator to discuss with her/him the reasons for her/his decision. Such 13 conferences shall be scheduled as soon as practicable.

20 D. The Board agrees to give notice of acting positions as follows:
i22 1. Summer Appointments: Any educator who wishes to be notified of an acting position vacancy 23 that may occur during the summer shall notify the Superintendent in writing prior to June l of 24 each year, indicating the position of interest and the educator's summer address. Each such 25 educator shall receive a written notice of any indicated acting position vacancy, postmarked at 26 least ten (10) calendar days before the incumbent has been transferreddate of appointment for vacancies occurring prior to 27 August l, promoted or has resigned;and five (5) calendar days for vacancies occurring after August l.
ii29 2. School Year Appointments: Only acting position vacancies that (l) a vacancy that has occurred as defined by current legislation;
iiioccur during the first 30 semester of the school year and (2) enrollment increase has created a new teaching vacancy;
ivare expected to extend for at least the balance of the school 31 year shall be posted in each school. Such postings shall be for at least five (5) a Teacher is on personal leave of absence for one full year or longer; or

11.01 Elementary Teacher Vacancies
(a) A Where a permanent vacancy means occurs in a teaching assignment covered classification within the bargaining unit, which the Employer has determined to fill or a new position within the bargaining unit is established by the Teachers’ Home, such vacancy shall be posted for a period of ten (10) consecutive calendar days. Employees within the same classification and department will have first opportunity for selection. Selection between Employees in the same classification and department will be based on seniority, provided the Employee possesses the necessary qualifications to perform the required duties. Where there are no Employees within the classification who apply or are able to meet the minimum requirements, the remaining candidates will be considered in accordance with Article 11.06(c). The first subsequent vacancy created by the filling of a posted vacancy will be posted for five (5) consecutive calendar days. All other subsequent vacancies need not be posted. Vacancies which are not expected to exceed ninety (90) days may be filled at the discretion of the Employer. Where Part-Time Employees fill temporary Full-Time vacancies, such Employees will continue to be considered as Part-Time Employees for the purpose of the Collective Agreement that is unoccupied because:
i) Agreement. Upon completion of the incumbent temporary vacancy, all affected Employees will be reinstated to their for- position, unless the position has been transferreddiscontinued, promoted or has resigned;
ii) in which case they shall be placed in a vacancy that has occurred as defined by current legislation;
iii) enrollment increase has created a new teaching vacancy;
iv) a Teacher is on personal leave of absence for one full year or longer; or
v) the incumbent has diedcomparable position.
(b) Prior to external advertisingUpon request, a list of vacancies filled in the Board shall attempt to fill elementary teaching vacancies subject to preceding month under Article 11.06(a), and the following procedures:
i) The Board shall post elementary vacancies for seven (7) Days prior to names of the closing date in all elementary schools and on the Occasional Teachers’ Hotline as well as the Board’s secure website. A copy of all postings shall successful applicants, will be forwarded provided to the Union. Unsuccessful applicants will be notified prior to successful applicants, where possible. At the request of the Employee, the Employer will discuss with unsuccessful applicants ways in which they can improve their qualifications for future postings.
iic) Employees shall be selected for positions under 11.06(a) on the basis of Seniority, qualifications, skill, ability and work record. Where these are relatively equal, seniority shall be the determining factor.
d) All applications from Occasional Teachers vacancies shall be posted on the List shall be screened according to the Board’s current Recruitment Practices and Procedures Booklet. Successful candidates shall be advised of an interview. An opportunity for debriefing shall be granted to unsuccessful candidates upon requestEmployee bulletin board.
iiie) The Board will notify Occasional Teacher candidates when they are successfully placed on the Preferred Hiring List.

If, during this thirty (30) working day familiarization period, the Employer determines that the Employee is not capable of performing the work adequately, or until December 31 if the Employee decides she does not want the position, she will be returned to her previous position without loss of each school year when the Preferred Hiring List is collapsedseniority.
(c) Only after Occasional Teachers have been short listed for interviews (as through 11.01(b)(i) above) shall the Board advertise externally.
i) Occasional Teachers shall be interviewed in conjunction with external applicants.

JOB VACANCIES. ELEMENTARY TEACHING POSITIONS10.01 When filling job vacancies (except to positions excluded from the bargaining unit), and in cases of layoff or recall of the working force, the following factors will be considered.
