Uninterrupted operation for a duration, as necessary, with a maximum of 1 week, to determine proper operation. “Uninterrupted supply” or “uninterrupted operation” is defined as: no involuntary shutdowns due to mechanical or electrical difficulties. OpTerra Energy Services will provide written notice to Merced County of the date of Substantial Completion and commencement of OpTerra Energy Services Warranty for each scope of work of above. OpTerra Energy Services, its designers and contractors will promptly and timely submit and provide documentation required for approvals of the ECMs above to the Authority Having Jurisdiction (AHJ), the local Fire Xxxxxxxx and the serving Utility. OpTerra Energy Services will obtain approvals from Utility or other responsible party for the interconnection of the Work with Merced County’s utility provider. Merced County, at its sole cost, will retain plan approval and inspecting authorities to include the services of an Authority Having Jurisdiction-approved Inspector of Record (IOR) and Special Inspection Agency (SIA) who will represent the authority having jurisdiction and perform all inspections necessary. OpTerra Energy Services will notify the IOR and SIA of required inspections and will provide reasonable access and accommodations for inspections. Americans with Disabilities Act (ADA) accessibility upgrades to existing buildings, parking lots, or path of travel are specifically excluded. No allowance has been made to repair or replace damaged, defective or inoperable existing equipment that has not been specifically identified to be replaced under the Scope of Work. When such items are discovered, OpTerra Energy Services will notify Merced County’s representative. No allowance has been made for underground obstructions or unsuitable soil conditions encountered during trenching or other excavation. Merced County permit fees are not included. Work will not include repairs, modifications, or upgrades to buildings or adjacent facilities not specifically shown in the final design unless damaged during the construction process. Work will not include excavation, installation of drainage systems, and shoring of unstable soil or substructures. LED STREET LIGHTS. For settlement purposes, the Parties agree that language in MidAmerican’s street lighting tariff (Rate SL) shall be modified to clarify customer responsibilities related to installation of LED street lights, as shown in Schedule F. In addition, MidAmerican will develop a customer LED street light education sheet by January 15, 2014, that will inform customers regarding potential savings from LED lights, options customers will have for installation of LED lights and the process to order replacement of existing lights with LED lights. The education sheet will communicate to customers the potential benefits to the customer of designing new installations for LED street lights. MidAmerican will provide a copy of the education sheet for review and comment to Environmental Law & Policy Center and Iowa Environmental Council prior to January 15, 2014. Customer options for installation will include, but are not limited to, replacing existing street lights with LED lights as existing lights burn out or otherwise fail, replacing existing street lights with LED lights by street, and replacing all existing street lights with available LED street lights.
