Level 2 - Formal. If the grievant is not satisfied with the decision at the Level 1 conference, then within ten (10) days after the informal conference, the grievant may present the grievance in writing on the prescribed form (see Appendix D) to the immediate supervisor. This statement shall be a clear, concise statement of the specific sections of the collective bargaining agreement allegedly violated, the circumstances involved, the decision rendered at the informal conference, and the specific remedy sought. The immediate supervisor shall communicate his/her decision in writing within ten (10) days after receiving the written grievance. Failure by a grievant to appeal the decision within the specified time limit shall be deemed an acceptance of the decision. Failure by the immediate supervisor to communicate his/her decision within ten days shall entitle the grievant to move the grievance to the next level.

Level 2 - Formal. If the aggrieved is not satisfied with the disposition of his/her grievance, he/she may file, through their representative and/or the Association, a written grievance with his/her immediate supervisor within ten (10) working days following the decision at Level 1. This complaint shall be in writing and shall set forth the grounds upon which the complaint is based, the contract clauses involved and the remedy requested. The immediate supervisor shall communicate his/her decision in writing within five (5) working days to the aggrieved with a copy to the Association.
Level 2 - Formal a. If a complaint is made against a member to the District and is not resolved in the informal discussion outline in Section B,1 above, such complaint shall be processed under the following circumstances:

  • Level Two – Formal If the Grievant is dissatisfied with the disposition of the grievance at Level One – Formal, the Grievant may complete Level Two Grievance Form and submit to the Superintendent within ten (10) days of written disposition of Level One – Formal. Within ten (10) days of receipt of the Level Two Grievance Form, the Superintendent shall meet with the Grievant. The Superintendent shall execute written disposition of the grievance within ten (10) days of such meeting.

  • Level 1 If an Employee wishes to submit a grievance, he/she shall first discuss the complaint with his/her immediate supervisor. The Grievance Committee representative and one administrator may also be present. This discussion must occur within ten (10) days of the event causing the complaint.

  • Level 4 If the Employee is not satisfied with the response of the Assistant Superintendent for Administrative Services, the Employee may submit the grievance to the Superintendent within ten (10) days of the receipt of the response to Level 3. The Superintendent shall sign and date all copies when he/she receives them. The Superintendent shall respond in writing within ten (10) days of the above date. Either party may be accompanied by one other Employee or administrator.

  • Staffing Levels To the extent legislative appropriations and PIN authorizations allow, safe staffing levels will be maintained in all institutions where employees have patient, client, inmate or student care responsibilities. In July of each year, the Secretary or Deputy Secretary of each agency will, upon request, meet with the Union, to hear the employees’ views regarding staffing levels. In August of each year, the Secretary or Deputy Secretary of Budget and Management will, upon request, meet with the Union to hear the employees’ views regarding the Governor’s budget request.

  • Level 2 If the aggrieved person is not satisfied with the disposition of the grievance at Level 1 or if no decision is reached within ten school days after a formal presentation, the employee may appeal the matter in writing to the superintendent. If the grievant appeals the grievance to the superintendent, the superintendent or designated representative shall confer with the grievant in an effort to arrive at a satisfactory solution within ten school days after the superintendent has received the appeal. If the grievant does not appeal the grievance to the superintendent within 15 school days after the formal conference at Level 1, the grievance shall automatically be waived.
