Level of Review. If the grievance is not settled at Step 1, the grievant may serve written notice of the grievance on a form provided by Management upon the person designated to review the grievance at Step 2 within seven (7) calendar days of receipt of the grievance response at Step 1. Failure of the grievant to serve such written notice shall constitute a waiver of the grievance. If such written notice is served, said person shall meet with the grievant, and a written decision or statement of the facts and issues shall be rendered to the grievant and his/her representative, if any, within fifteen (15) calendar days from the date of service. Failure of Management to respond within such time limit shall entitle the grievant to process his/her grievance at the next level of review.

If such written notice is served, the person designated by Management to review the grievance at Step 1 shall meet with the grievant, and a written decision shall be rendered to the grievant within twenty-one (21) calendar days from the date of service. If the grievance is not settled at Step 2, then the grievant may file an appeal with the Labor Relations Office on the form provided by the Department within fourteen (14) calendar days following receipt of the grievance response or expiration of time limits if no response is received at Step 2. Upon request, the time limits will be automatically extended to twenty-one (21) calendar days. Failure of the grievant to serve such written notice or make such request shall constitute a waiver of the grievance. If such notice is served, the grievance shall be heard by the General Manager or a designated representative within twenty-one

Forms shall be delivered to the lowest ranking Chief Officer in the employee's chain of command for routing to appropriate persons. It shall be the responsibility of that Chief Officer to date and indicate the time of receipt of all forms. All forms shall contain clear and concise statements of pertinent information, with no attempt to expand or conceal facts. This form must be completed and served on said Chief Officer within fifteen (15) calendar days of the receipt of the grievance response at Step 1. Failure of the grievant to serve such written notice shall constitute a waiver of the grievance. If such written notice is served, the designated Chief Officer shall meet with the grievant and his/her representative, if any, and a written decision or statement of the facts and issues shall be rendered within fifteen (15) calendar days from the date of service. Failure of Management to respond within such time limit shall entitle the grievant to process his/her grievance at the next level of review.

The appeal shall be presented in writing to the employee’s immediate supervisor who shall render his or her decision and comments in writing and return them to the employee within five (5) calendar days after receiving the appeal. If the employee does not agree with his or her supervisor’s decision, or if no answer has been received within five (5) calendar days, the employee may present the appeal in writing to his or her supervisor’s immediate superior. Failure of the employee to take further action within five (5) calendar days after receipt of the written decision of his or her supervisor, or within a total of fifteen (15) calendar days if no decision is rendered, will constitute a dropping of the appeal.

Failure of the grievant to serve such written notice shall constitute a waiver of the grievance.

The appeal shall be presented in writing to the EMPLOYEE'S immediate supervisor, who shall render a decision and comments in writing and return them to the EMPLOYEE within 15 calendar days after receiving the appeal. If the EMPLOYEE does not agree with the supervisor's decision, or if no answer has been received within 15 calendar days, the EMPLOYEE may present the appeal in writing to the supervisor's immediate superior. Failure of the EMPLOYEE to take further action within 10 calendar days after receipt of the written decision of the supervisor, or within a total of 25 calendar days if no decision is rendered, will constitute a dropping of the appeal.
Level of Review. Informal
a) The unit employee(s) and/or Union shall discuss the grievance with the immediate management supervisor on an informal basis in an effort to resolve the grievance.
b) Said grievance shall be considered waived if not so presented to the immediate management supervisor within ninety (90) calendar days following the day when the event upon which the grievance is based occurred.
c) The immediate management supervisor may require that the unit employee(s) or Union submit the grievance in writing.
d) Similar grievances submitted by more than one (1) unit employee may be consolidated by management into one (1) or more separate grievances.
e) The immediate management supervisor shall respond within five (5) calendar days following the meeting with the unit employee(s) or Union.
f) Failure of the immediate management supervisor to respond within such time limit shall entitle the unit employee(s) or Union to process the grievance at the next step.
