Level Three - Board. If an Association Representative is not present at the Level Three meeting, the Board shall provide the Designated Building Representative with a copy of the Level Three Decision at the same time and manner as the aggrieved.
Level Three - Board. 1. If the grievant or the Association is not satisfied with the superintendent’s disposition of the grievance at Level Two, the grievant or the Association may appeal the grievance to the Board of Directors of the District. Such appeal shall be made in writing within five (5) days after a decision by the superintendent, or if no decision has been rendered by the superintendent then such appeal shall be made within fifteen (15) days after the superintendent’s hearing.
2. The appeal shall include a copy of the original grievance, the decisions rendered by the principal or immediate supervisor or other administrator and by the superintendent, a clear concise statement of the reasons for appeal, and the specific remedy requested.
3. The Board shall hold a hearing on the appeal not later than its second regular meeting following the filing of the notice of appeal from the superintendent’s decision. The Board shall allow time for oral presentation by the parties in interest, or their representatives.
4. The Board shall render its decision in writing to the parties in interest not later than ten (10) days after the close of the hearing.
Level Three - Board. If a grievance is not satisfactorily resolved at Level Two, the grievant may appeal it to the Board, in writing, within ten (10) days following receipt of the Level Two written answer (or following the time when it should have been received if it was not timely received). The written appeal to Level Three (Board) shall, however, be filed with the Superintendent.
Level Three - Board. If the grievance is not resolved by the Level Two response, the written grievance and answer may be referred to the School Board within twenty (20) working days of receipt of the Level Two response. The Board may, in its discretion, hold a meeting. The Board shall render a written decision within twenty (20) working days after receipt of the written grievance.
Level Three - Board a. If the grievant is not satisfied with the disposition of his/her grievance at Level Two, he/she may, within five (5) days after the decision or eight (8) days after the meeting with the Superintendent, file the grievance with the Board with a copy to the Association.
b. The Board or a Committee thereof shall, within ten (10) days after the receipt of the grievance, meet with the grievant and the Association for the purpose of hearing the grievance.
c. The Board shall, within five (5) days after such meeting, render its decision and the reasons in writing to the grievant with a copy to the Association.
Level Three - Board. If the grievant is not satisfied with the superintendent’s decision the grievant may, within five (5) days of the decision, file a written notice with the office of the Superintendent that the grievance be submitted to the Board or proceed by mutual agreement to Level Four, below. The Board shall meet within ten (10) days of such request and render its decision within ten (10) days of meeting.
Level Three - Board. In the event the aggrieved person is not satisfied with the disposition of the grievance at level two, or in the event no decision has been rendered within ten (10) school days after the aggrieved has first met with the superintendent, he/she may file the grievance in writing with the superintendent, who shall place it on the Board agenda. The Board shall meet and discuss with the aggrieved person, and/or with the representative (if requested by the aggrieved person) at its next regular meeting or sooner for the purpose of resolving the grievance. If the aggrieved person is not satisfied with the disposition of his/her grievance at Level Two, or if no decision has been rendered within three days after he/she has first met with the Superintendent, he/she may file the grievance again with the Association's PR & R Committee within three days after a decision by the Superintendent, or six days after he/she has first met with the Superintendent, whichever is sooner.
b. Within three days after receiving such further appeal, the PR & R Committee through its chairperson shall refer the grievance to the Board.
c. Within ten days after receiving the written appeal, the Board shall meet with the aggrieved person and with representatives of the PR & R Committee for the purpose of resolving the grievance. The decision of the Board shall be rendered in writing within three days.
Level Three - Board. If the aggrieved person is not satisfied with the disposition of his grievance at Level Two, or if no decision has been rendered within fourteen (14) calendar days after the grievance was delivered in writing to the Superintendent, the grievant may, within seven (7) calendar days after a decision by the Superintendent or twenty-one (21) calendar days after the grievance was delivered in writing to the Superintendent, whichever is sooner, file the grievance in writing to the Board of Education. The written filing should include, the results of previous discussions, the basis of the grievant’s dissatisfaction and the specific remedy sought. The Board or a committee thereof shall review the grievance and may at its discretion, hold a hearing with the employee. The Board will render a decision in writing within forty (40) calendar days of receipt, by the Board, of the written grievance.
Level Three - Board. (a) If the aggrieved teacher is not satisfied with the disposition of his/her grievance at Level Two, he/she may, within three (3) days after the decision, or within six (6) days after the meeting, file the grievance for appeal with the Board.
(b) The Board shall, within ten (10) days after receipt of the appeal, meet with the aggrieved teacher and with his/her representatives for the purpose of resolving the grievance.
(c) The Board shall, within fifteen (15) days after such meeting, render its decision and the reasons hereof in writing to the aggrieved teacher with a copy to the Association.
