Level Two. 51% to 80% immersion:
(a) te reo Māori is for most of the time, the language of communication and instruction;
(b) English is accepted as a temporary language of instruction and communication;
(c) There is an agreement between the school and parents that the programme will achieve a particular level of immersion over a specified period of time;
(d) The level of fluency of the teacher will vary considerably, from not very fluent to native-like fluency;
(e) There is a reliance on kaiarahi reo to increase the amount of spoken Māori in the programme;
(f) It is expected that not all students in the programme will interact freely in Māori.
Level Two. If no settlement is reached at Level One, the written grievance may be submitted to the District Chancellor or designee by the AFT. Receipt of the grievance shall be acknowledged in writing. The grievance must be filed within fifteen (15) calendar days after the Level One answer is received. The grievant(s) and the AFT representative shall be present at any meeting called to consider the grievance at Level Two. Additional investigatory measures may be utilized by the District at this level. The District chancellor or designee shall serve the Level Two answer on the AFT representative within twenty (20) calendar days of the Level Two filing. The representative shall acknowledge service by signing and dating the District's copy. If the answer does not grant the remedy requested, the Chancellor (or designee) shall include the reasons.
Level Two. If no resolution is obtained within three (3) days of the discussion, the employee shall reduce the grievance to writing and proceed within five (5) days of said discussion to file a copy of the written grievance with his/her immediate supervisor. Within ten (10) days the immediate supervisor shall prepare a written response to the submitted written grievance and shall provide his/her answer to the grievant with a copy to the Association. Level Three: If the Association is not satisfied with the disposition of the grievance at Level Two, or if no disposition has been made within ten (10) days of receipt of the grievance, the grievance shall be transmitted to the Superintendent or his/her designated agent. More Definitions of Level Two
Level Two. A copy of the written grievance shall be filed with the Superintendent of his designated agent and the Association as specified in Level One. Within ten (10) days of the grievance, the Superintendent or his designated agent shall arrange a meeting with the grievant and the Association. Within five (5) days of the discussion, the Superintendent or his designated agent shall render his decision in writing, transmitting a copy of the same to the grievant and the Association Secretary. Level Three: If no decision is rendered within ten (10) days of the discussion or the decision is unsatisfactory to the grievant and the Association, the grievant may appeal same to the Board of Education by filing a written grievance, along with the decision of the Superintendent, with the officer of the Board in charge of drawing up the agenda for the Board's next meeting at least ten (10) days preceding the next regularly scheduled Board meeting. Once filed, in accordance with the above requirements, the grievance shall be placed upon the agenda of the next regularly scheduled meeting. Any grievance appealed to the Board shall contain the endorsement of approval or disapproval of the Association thereon. The Board shall allow the teacher and the Association an opportunity to be heard at the meeting for which the grievance is scheduled. Level Four: Only the Association shall have the right to process a grievance at Level Four.
Level Two. If the aggrieved professional employee is not satisfied with the disposition of the grievance after the completion of level one, a formal written grievance may be filed with the principal or immediate supervisor within five (5) school days after the completion of level one, on a form provided by the board of education. Within ten (10) school days after the receipt of the written formal grievance by the principal, the principal shall meet the aggrieved professional employee in an effort to resolve the grievance at this level.
Level Two is the ability to converse in the second language(s); to read English and translate orally into the second language(s); read the second language(s) and translate orally into English; and to write in the second language(s).
Level Two means provisional compliance in that the electronic file submitted by the publisher can be converted into most specialized formats without substantial effort or expense.
Level Two. A copy of the written grievance shall be filed with the Superintendent or his designated representative as specified in Level One with the signature of the Association. Within five days of receipt of the grievance, the Superintendent shall meet with the grievant and/or the Association representative in an effort to resolve the grievance. Level Two. If, as a result of the informal discussion with the building principal, a grievance still exists, after three (3) school days, he/she may invoke the formal grievance procedure as set forth. A copy of the grievance shall be given to the principal, grievant, and the Association representative or building representative. Within five (5) days of receipt of a grievance, the principal shall meet with the grievant and the Association representative in an effort to resolve the grievance. The principal shall make his/her decision known in writing, within three (3) days after the meeting. A copy thereof shall be given to the grievant, Association representative, and the Superintendent. LEVEL THREE: In the event that the Association or the grievant is unsatisfied with the decision rendered at Level Two, the grievance may be appealed to the Superintendent, provided that such a request is transmitted within at least five (5) days of receipt of the Level Two decision, or within ten (10) days of the Level Two meeting, if no decision has been rendered. LEVEL FOUR: In the event the grievance is not satisfactorily resolved by the Superintendent or his/her designee, or no written decision has been given within three (3) days, the grievance shall be transmitted to the Board by filing a written copy of said grievance with the Secretary of the Board or his/her designee. The grievant shall have five (5) days to file from the date of the receipt of the reply, or from the time established because of a lack of written reply. The Board, upon receipt of the letter, not later than its next regular meeting, or two (2) calendar weeks, whichever shall be later, shall hold a hearing upon the request of the grievant, review such grievance in executive session, or give other consideration as it shall deem appropriate. Disposition of the grievance by the Board shall be no later than seven (7) days afterward. A copy of such disposition shall be furnished to the grievant, Superintendent, Principal, and Association. LEVEL FIVE: If the Association is not satisfied with the disposition of the grievance at Level Four, or if no disposition has been made within the period above provided, the grievance may be submitted to arbitration before an impartial arbitrator within ninety (90) days of the Board’s decision, except in grievances involving monetary issues.
