Maintenance and Repair by Xxxxxx. Tenant shall maintain the Property in substantially the same condition as of the Commencement Date of this Lease Term, subject to Landlord reimbursement at the following rates: Landlord’s reimbursement rate for Common Areas will be at the rate of Landlord’s share, as detailed in Basic Lease Information. Areas of the Property that are not the Premises or Common Areas will be at the rate of 100%. Landlord shall reimburse Tenant within thirty (30) days of receipt of invoice from Tenant. Tenant’s repair and maintenance obligations include, without limitation, repairs to: all interior and exterior work and Common Areas on the Property, and all janitorial, pest control, plumbing, fire sprinkler, sewage, heating, ventilation, air-conditioning, roof repair and replacement, electrical and lighting facilities, irrigation systems, fences, landscaping, litter collection and removal. Tenant shall further, at its own costs and expense, repair or restore any damage or injury to all or any part of the Property caused by Tenant or Tenant’s agents, employees, invitees, licensees, visitors or contractors, including but not limited to repairs or replacements necessitated by (i) the construction or installation of Alterations to the Premises by or on behalf of Tenant; (ii) the moving of any property into or out of the Premises; or Tenant’s use and occupancy of the Premises. In the event that any law, regulation or mandate requires the expenditure in excess of $250,000 to bring the Property into compliance the parties shall negotiate in good faith a cost sharing agreement as between Landlord and Tenant for any amount in excess of $250,000. If no agreement is reached after ninety (90) days from the commencement of negotiations, the parties agree to resolve the matter through the option available in Section 22.7 of this Lease.
Maintenance and Repair by Xxxxxx. 8.1.1 Lessee shall, at its sole cost and expense, keep the Premises – together with all Alterations, equipment and installations – in good order, condition and repair at all times. Lessee shall make all repairs and replacements (ordinary as well as extraordinary, foreseen and unforeseen) which may be necessary or required so that at all times the Premises are in good order, condition and repair. Without limiting the generality of the foregoing, Lessee shall keep the glass of all windows and doors on the Premises clean and presentable, shall replace all cracked or broken glass in the Premises, shall keep the mechanical and electrical systems and all drains clean and in a good state of repair, shall protect the sprinkler system and all pipes and drains so that they will not freeze or become clogged and shall not permit or suffer any waste, damages, or disfigurement to or upon the Premises or any part thereof. Lessee shall be responsible for any and all maintenance in the yard area and on the docks of which they have exclusive use.
Maintenance and Repair by Xxxxxx. Tenant shall, at its sole expense, repair, maintain and replace as necessary and keep in good, clean and safe condition all portions of the Premises which are not, pursuant to Paragraph 11 hereof, specifically the responsibility of Landlord as set forth herein, including, without limitation, all windows, doors, partitions, and utility and HVAC systems Tenant shall maintain in force at all times a maintenance contract for the HVAC systems in a form and with a contractor acceptable to Landlord. A copy of the maintenance agreement shall be given to Landlord within the first 60 days of Tenant’s occupancy Tenant is responsible for all repairs to the mechanical systems. Provided, however, subject to Tenant maintaining the maintenance contract as set forth herein and further subject to Tenant’s negligence, the maintenance responsibilities of Tenant hereunder as to repair and replacement of HVAC units snail be limited to Seven Hundred Fifty Dollars ($750.00) per Lease Year per HVAC unit. Landlord may, at its option, and without relieving any duty or obligation of Tenant to perform under the Lease, and after appropriate notice to Tenant, perform any duty of Tenant hereunder and Tenant shall pay the cost thereof to Landlord as Additional Rent and shall be subject to any other remedy or right Landlord may have should the failure to perform constitute a default under the Lease. Tenant will not injure the Premises, or commit or allow to be committed any waste therein. Tenant shall repair any damage to the Premises or the Building caused by Tenant or Tenant’s agents, contractors, employees, invitees and visitors Maintenance, repair and additional service requests of Landlord by Tenant will be charged to Tenant at cost plus a ten percent (10%) management fee and an additional ten percent (10%) administrative fee.
Maintenance and Repair by Xxxxxx. During the Term, Tenant shall maintain the entirety of the Property (including its principal components) and other Improvements (including without limiting the generality of the foregoing the roof, foundation, water, sewer and gas connections, pipes and mains, plumbing, heating and ventilation, and electrical systems) in good operational condition for the conduct of Tenant's business at the Property, ordinary wear and tear, damage by eminent domain and damage or destruction of the Property excepted. All repair work shall be done in a good and workmanlike manner. Tenant shall not commit waste with respect to the Improvements or the Property.
Maintenance and Repair by Xxxxxx. 7.1.1 Lessee shall, at its sole cost and expense, keep the Premises together with all Alterations, equipment and installations – in good order, condition and repair at all times. Lessee shall make all repairs and replacements (ordinary as well as extraordinary, foreseen and unforeseen) which may be necessary or required so that at all times the Premises are in good order, condition and repair. Without limiting the generality of the foregoing, Lessee shall keep the Premises clean and presentable, shall keep the mechanical and electrical systems and all drains clean and in a good state of repair, shall protect the sprinkler system and all pipes and drains so that they will not freeze or become clogged and shall not permit or suffer any waste, damages, or disfigurement to or upon the Premises or any part thereof. Lessee shall also be responsible for maintenance and repair of the underdock sprinkler system.
Maintenance and Repair by Xxxxxx. Tenant shall take good care of the Premises. At the expiration of the term, Xxxxxx shall surrender the Premises broom clean, and in as good of a condition as when Xxxxxx takes possession, reasonable wear and tear excepted. Landlord shall provide reasonable snow and ice removal/treatment from the parking lot and walk ways.
Maintenance and Repair by Xxxxxx. 8.1.1 The Port shall, at is sole cost and expense, keep the Premises (specifically including all Alterations, equipment and installations) in good order, condition and repair at all times. Port shall make all repairs and replacements (ordinary as well as extraordinary, foreseen and unforeseen) which may be necessary or required so that at all times the Premises are in good order, condition and repair. With limiting the generality of the foregoing, Port shall keep the glass of all windows and doors on the Premises clean and presentable, shall replace all cracked or broken glass in the Premises, shall keep the mechanical and electrical systems and all drains clean and in a good state of repair, shall protect the sprinkler system and all pipes and drains so that they will not freeze or become clogged and shall not permit or suffer any waste, damages, or disfigurement to or upon the Premises or any part thereof.
Maintenance and Repair by Xxxxxx. Xxxxxx agrees to permit no waste to occur of, to, or about the Premises, such as, but not limited to, removal of garbage and washing of dirty dishes on a prompt regular basis to prevent the attraction of bugs, etc. Lessee shall at all times maintain and take good care of the Leased Premises during the term of this Lease. Upon termination of this Lease, Xxxxxx agrees to give possession of the Leased Premises to Lessor without notice by Xxxxxx and the Leased Premises shall be in as good condition as at the commencement of the term hereof, normal wear and tear excepted. Lessee shall make no alterations, repairs, changes or improvements of any type or character to the Leased Premises, without the consent in writing of Lessor, which consent may be withheld with or without justification; except necessary repair for proper care and maintenance of the Premises may be made by Lessee in an emergency. In the event Lessee does not maintain the Leased Premises in a good state of repair and keep the Premises in a safe, clean and sanitary condition during the term of this Lease, Lessor shall have the right to terminate this Lease, as permitted by applicable law. If the damage is caused by Lessee and/or visitors, Lessee must report this immediately to the Lessor and arrangements for payment by Lessee must be made with Lessor within 30 days. If Lessor does not receive payment from Lessee within 30 days, a separate legal process may be used to collect the charges due. Payment to Lessor shall not be deducted from monthly rental payment received. Intentional damage to the unit, grounds, and/or common areas by the Lessee and/or visitors, is cause for Lease termination. In the event Lessee does not return the Leased Premises to Lessor at the end of the Lease term in as good condition and state of repair as at the commencement of the Lease term, usual wear and tear excepted, Lessee shall be obligated to pay to Lessor any such sums expended by Lessor to return the Leased Premises to such condition and Lessor may utilize the security deposit to offset the cost of such repairs incurred by Lessor. All such repairs will be made at Xxxxxx’s sole cost and expense. Lessee shall promptly notify management of any breakage, leakage or stoppage of waste pipes of sewers located above the ground and which service the Premises. Maintenance and Repair by Xxxxxx. 8.1.1. Lessee shall make all repairs and replacements (ordinary as well as extraordinary, foreseen and unforeseen) which may be necessary or required so that at all times the Premises are in good order, condition and repair. In addition, the Lessee shall, at its sole cost and expense be responsible for the repair and maintenance of the apron, pilings, floats, docks and any and all over-water structures and any installation Lessee requires for security, not limited to the area above the breezeway fence beyond what is currently in place.
Maintenance and Repair by Xxxxxx. The Lessee shall at all times throughout the Lease Term, at its sole cost and expense, keep the Property in good order and condition in accordance with the best practices and maintenance standards. The costs and repairs shall be paid by the Lessee. The bills and invoices for Lessee's costs shall be delivered directly to the Lessee by the contractor providing such services. Without limiting the generalities thereof, the Lessee shall keep the glass of all windows, doors and showcases clean and presentable; replace immediately all broken glass in the Property; at reasonable intervals paint or refinish the interior of the Property, including entrances; make any necessary repairs to or replacements of, all door closure apparatuses and mechanisms; keep all plumbing clean and in good state of repair including pipes, drains, toilets, basins, water heaters; and keep all utilities (including circuit breaker and panel boxes and Xxxxxx's meters) within the Property in a good state of repair. Xxxxxx hereby agrees to expend PKR <-> for maintenance and repairs immediately after the signing of this Agreement as per list given in Exhibit G. In this regard, the Lessee shall maintain complete record to make it accessible to the Lessor.
