Marketing/Sales. Borrower shall not market, attempt to sell or sell or permit or justify any sales or attempted sales of any Intervals except in compliance with the Timeshare Act and applicable laws in state and other jurisdictions where marketing, sales or solicitation activities occur.
Marketing/Sales. AGENCY must clearly identify itself by name and define its relationship to PROVIDER as a third party on all material promoting PROVIDER. Any images used for marketing purposes by the AGENCY, including print media, posters and on the internet, must be approved in writing by PROVIDER, prior to the usage of such images. For all sales of PROVIDER’s products, AGENCY must utilize descriptions supplied by PROVIDER in the Activity/Attraction Fact Sheet Description, attached hereto as Exhibit B, unless PROVIDER otherwise agrees in writing. The following service marks, trade names, trademarks, copyrights, logos and/or trademark configurations registered by PROVIDER, whether with the Department of Commerce and Consumer Affairs of the State of Hawaii, the United States Patent and Trademark Office, or any other state or country agency, together with any other service marks, trade names, trademarks, copyrights, logos and/or trademark configurations which shall hereafter be duly registered, shall be and remain the sole and exclusive property of PROVIDER: [LIST ALL TRADEMARKS, SERVICES, NAMES, COPYRIGHTS, LOGOS,ECTS…] Any and all rights under service marks, trade names, trademarks or copyrights and any other property rights under service marks, trade names, trademarks or copyrights involving PROVIDER shall inure to the sole and exclusive benefit of PROVIDER. An AGENCY’s right to use any of the above shall be subject to the prior written consent of PROVIDER and shall be further subject to all the terms and conditions hereof. Any such right shall be non- assignable and nontransferable, shall be limited to the AGENCY’s use for PROVIDER as set forth herein and in the AGENCY Agreement, and shall be only for the term of the AGENCY Agreement.
Marketing/Sales. Provide a detailed ninety-day plan beginning from award date of the Master Agreement describing the strategy to immediately implement the Master Agreement as supplier’s primary go to market strategy for Public Agencies to supplier’s teams nationwide, to include, but not limited to:
Marketing/Sales. Both parties shall provide what each respective organization determines to be adequate staffing and resources to facilitate the marketing and sale of products and services covered by this Agreement. Fair, Xxxxx shall provide said resources under the direction of a single Marketing Director who shall aggressively pursue all mutually agreed upon marketing and publicity activities. Equifax shall name a lead marketing individual who shall have final authority to coordinate the combined efforts. However, this provision shall in no way prohibit either party from contacting mutual customers on other sales and customer service matters. Equifax shall have primary responsibility for sales. Fair, Xxxxx will make best efforts to participate in joint sales calls, when the customer is large, and when technical expertise is needed to close the sale. However, Fair, Xxxxx is not obligated to make a minimum number of sales calls, unless otherwise so stated in this Agreement.
9.1 Marketing materials intended for prospects, customers, or staff of Equifax and Fair, Xxxxx shall from time to time be prepared by Fair, Xxxxx and/or Equifax. Such materials and literature shall be furnished by the originating party to the other for review and modification. Equifax shall, at its expense and within the constraints of its advertising/promotion budget, print all marketing material and sales literature approved by both parties. Any media releases with regard to products or services covered by this Agreement shall be prepared jointly by Fair, Xxxxx and Equifax and shall not be disseminated without the approval of both parties.
9.2 It is understood that the coupling of the names of Equifax and Fair, Xxxxx is mutually advantageous in marketing products and services covered by this Agreement and each of the parties hereto agree to the reasonable use of the other party’s name in connection with such products and services. Each party proposing to use the other party’s name in a public communication must first furnish an exact copy of the proposed communication to such other party and such other party shall make a prompt response to the requesting party either approving or amending such communication. Any written marketing or customer service materials including, but not limited to, manuals, brochures, and instructions for general dissemination to Equifax customers shall be identified as a Equifax product and shall remain Equifax’s property; provided, however, that any portions of such material...
Marketing/Sales. During the Agreement Period, Consultant will be actively seeking merger candidates and marketing the Company's products to businesses.

3. Each entity will refer potential clients to the "partnership" for potential sales.
4. Each entity will offer in house marketing resources to develop the sales/marketing strategy for XpressNet products.
5. Internet Passport will resell DigitalXpress, XpressVideo, XpressData and XpressAudio products.
6. Internet Passport will bundle DigitalXpress products into corporate Internet designs and resellers programs for Internet Passport products.
7. Additional demonstration areas will be set up as each Internet Passport expands to other offices.
