Mileage Regulation. The BLE and the Carrier recognize that mileage regulation rules in the various collective bargaining agreements and their applications will be adjusted to reflect previous and subsequent changes in the basic day in through freight service. In applying the regulation rules, miles physically operated (or paid for in the case of standard mileage agreements), including deadhead mileage, whether separate or combined with service, will be counted in determining the number of engineers to be assigned in a set of runs or the appropriate regulation factors for pools under Section 2 below. To adjust for the current basic day, the regulation limits will be adjusted to reflect the change by increasing such limits by the percentage change from the 100 mile basic day in through freight service.

Mileage Regulation. A. The parties agree that the method of regulation of all pool freight boards will be as follows: 1. Standard 20-day checking period will start with Saturday. 2. Monday will be the weekly adjustment day. 3. Pool freight runs of 160 miles or less will be regulated on paid miles. Runs over 160 miles will be regulated on line miles. NOTE: On runs where dual destination pool operations are in place and the mileage of one leg is 160 miles or less and the other(s) exceeds 160 miles, the pool will be regulated on paid miles. 4. Formula: Total miles accumulated by the pool divided by the checking period (20 days) times 30, divided by 4000, will determine the number of employees to be assigned to the pool. 5. Decimal figures of .5 or higher will be rounded up and less than .5 will be rounded down to the nearest whole number. 6. Adjustments will only be made when the mileage falls outside the 3800 to 4200 mile range at which time the pool will be adjusted to the 4000 mile target. 7. In the event of significant service interruptions, traffic surges, detours, acts of God, etc., CMS and the Local Representatives agree to confer in order to adjust the pools to properly address these anomalies.
Mileage Regulation. The first paragraph of Article 32, Section 6(d) of the BLE Western Lines Agreement and Article 24, Section 23, of the EP&SW Agreement provide: "In the regulation of passenger or other assigned service, sufficient engineers will be assigned to keep the mileage or equivalent thereof within the limitations of 4000 and 4800 miles for passenger service, and 3200 and 3800 miles for other regular service, as provided herein. If in any service, additional assignments would reduce earnings below these limits, regulation will be effected by requiring the regular assigned man or men to lay off when the equivalent of 4800 miles in passenger or 3800 miles in other regular service has been reached." The above provision will be canceled and replaced with the following language: "In the regulation of passenger or other assigned service, sufficient engineers will be assigned to keep the mileage or equivalent thereof within the limitations of 4000 and 4800 miles for passenger service, and 3600 and 4200 for other regular service, as provided herein. If in any service, additional assignments would reduce earnings below these limits, regulation will be effected by requiring the regular assigned employee to lay off when the equivalent of 4800 miles in passenger service or 4200 miles in other regular service has been reached."
Mileage Regulation. (a) In regular and extra passenger service, a sufficient number of Engineers will be assigned to keep the average mileage, or equivalent thereof, between 4000 and 4800 miles per month. In assigned, pooled or chain gang freight, or other service paying freight rates, a sufficient number of Engineers will be assigned to keep the average mileage, or equivalent thereof, between 3200 and 3800 miles per month. If, in any service, additional assignments would reduce earnings below these limits, regulation will be effected by requiring the regularly assigned Engineer or Engineers to lay off when the equivalent of 4800 miles in passenger, or 3800 miles in other road service, has been reached. (b) On extra lists, a sufficient number of Engineers will be maintained to keep the average mileage, or equivalent thereof, between 2600 and 3800 miles per month; provided that when Engineers are cut off the extra lists and it is shown that those remaining thereon are averaging the equivalent of 3100 miles per month, Engineers will be returned to the extra lists if the addition will not reduce the average mileage, or equivalent thereof, below 2600 miles per month. (c) In yard service, regular assigned Engineers will be required to lay off when they have earned the equivalent of 35 days in any month. (d) Engineers used in combination service as such, will not be permitted to earn in excess of 3800 miles at the through freight rate for engines weighing between 250,000 and 300,000 pounds on drivers. (e) In order that the Company's service may be protected, it is understood that the mileage limitations specified herein are only effective when relief Engineers are available. If, for any reason, an Engineer exceeds the maximum mileage in any month, such excess will be deducted from the maximum mileage he may be permitted to make in the following month. (f) In regulating the working lists in the respective classes of service, each list will be handled separately. In the regulation of mileage, neither the minimum nor the maximum is guaranteed. (g) Each time an Engineer returns to his home point after a trip in other than passenger service, he will correctly register, on the roundhouse register or book to be provided for that purpose, the mileage, including overtime or other earnings reduced to miles, he has made in all classes of service since the first of the current month, and will not be considered available for service until he has done this; it being understood that this does not...

  • Applicable Regulations If an issue relating to investments is covered both by this Agreement and by the national legislation of one Contracting Party or by international conventions, existing or to be subscribed to by the Parties in the future, the investors of the other Contracting Party shall be entitled to avail themselves of the provisions that are the most favourable to them.

Licensee acknowledges that it is not a citizen, national, or resident of, and is not under control of the governments of Cuba, Iran, North Korea, Sudan or Syria and is not otherwise a restricted end-user as defined by applicable export control laws. Further, Licensee acknowledges that it will not download or otherwise export or re-export Software or any related technical data directly or indirectly to the above-mentioned countries or to citizens, nationals, or residents of those countries, or to any other restricted end user or for any restricted end-use.

  • Voltage Regulators Whenever the Large Generating Facility is operated in parallel with the New York State Transmission System, the automatic voltage regulators shall be in automatic operation at all times. If the Large Generating Facility’s automatic voltage regulators are not capable of such automatic operation, the Developer shall immediately notify NYISO, or its designated representative, and ensure that such Large Generating Facility’s real and reactive power are within the design capability of the Large Generating Facility’s generating unit(s) and steady state stability limits and NYISO system operating (thermal, voltage and transient stability) limits. Developer shall not cause its Large Generating Facility to disconnect automatically or instantaneously from the New York State Transmission System or trip any generating unit comprising the Large Generating Facility for an under or over frequency condition unless the abnormal frequency condition persists for a time period beyond the limits set forth in ANSI/IEEE Standard C37.106, or such other standard as applied to other generators in the New York Control Area on a comparable basis.
