NO EXTRA CLAIMS COMMITMENT. During the life of this agreement the parties agree and are therefore bound not to pursue any additional claims. It is agreed that up to the nominal expiry date of this agreement:
(i) The parties will not pursue any extra wage claims against each other;
(ii) The parties will not seek any changes to conditions of employment without mutual agreement;
(iii) This agreement covers all matters or claims regarding the employment of the employees, which could otherwise be the subject of protected actions pursuant to the Workplace Relations Act: and
(iv) The parties will not engage in protected action pursuant to the Workplace Relations Act; in relation to the performance of any work covered by this Agreement.

NO EXTRA CLAIMS COMMITMENT. 3.5.1 The Employees covered by this Agreement undertake that they will not pursue any further claims against the Company during its period of operation.
3.5.2 Notwithstanding the provisions of this clause, any party to this Agreement may apply to the FWC to vary the Agreement in accordance with the relevant provisions of the FW Act. However, such variations shall be compliant with the Building Code 2016.
3.5.3 If, subsequent to approval of this Agreement by the FWC, any clause of this Agreement is deemed inconsistent with the Building Code 2016, the parties agree to vary the Agreement pursuant to the FW Act to address any inconsistency.
NO EXTRA CLAIMS COMMITMENT. 3.5.1 The Employees covered by this Agreement undertake that they will not pursue any further claims against the Company during its period of operation.
3.5.2 Notwithstanding the provisions of this clause, any party to this Agreement may apply to the FWC to vary the Agreement in accordance with the relevant provisions of the FW Act.
NO EXTRA CLAIMS COMMITMENT. 1.8.1 During the life of the Enterprise Agreement subject to 1.8.2, the parties bound by this Enterprise Agreement will not pursue any further or additional claims in relation to remuneration or conditions of employment except where consistent with the National and State Wage Case Principles, or any successor thereto.
1.8.2 A party to this enterprise agreement is not precluded from making an application pursuant to relevant provisions of section 72B of the Fair Work Act 1994 (SA).
1.8.3 The no extra claims commitment will not prevent the parties bound by this agreement from initiating claims where specifically provided under a term of this Enterprise Agreement.
