Noise Ordinance. Marco Island has a 24 hour noise ordinance that makes it "unlawful for any person to make, continue, or cause to be made or continued any noise..within the limits of the City." Guests must keep conversations, music, etc. at a level which does not disturb the peace and tranquility of the adjoining neighbors. Failure to do so may result in a penalty up to $500. Guest agrees that if they fail to comply with the ordinance and/or are cited by the City of Marco Island for a noise- related violations, the guest is financially liable for any assessed fines and/or will be required to vacate the premises and forfeit all rental fees.

The sound when measured at the receiving property (neighbors’ home) may not exceed 68 dBA between 7:00am – 9:00pm or 60 dBA between 9:00pm – 7:00 am (equivalent to a conversation). Between 10:00pm – 7:00am , the sound may not be plainly audible from fifty (50) feet from the property line or within a fully enclosed structure of a residence. The property’s quiet hours are in place to ensure that you and our whole community can enjoy a restful night’s sleep. We are dedicated to protecting our guests and neighbors from bothersome levels of noise. In an effort to do so, this property may be equipped with noise monitoring technology which is 100% privacy compliant and helps protect you from aggravating noise from nearby renters or neighbors, as well as proactively prevents noise complaints. HAZARDOUS PRACTICES No barbeque grills of any kind are permitted on balconies or inside the property. No open flames i.e. candle burning is permitted on balconies or in the unit. Do not dismantle smoke detectors as they are there for your protection. Use the overhead stove fan when cooking to avoid accidental, activation of smoke detector alarm. FAMILY RENTAL ONLY Reservations made for teenagers or young single groups will not be honored without any accompanying adult staying in the unit at ALL times. We require at least one member of the party to be 25 (twenty-five) years of age! Any violators will be evicted according to California Statute 508.141 with forfeiture of all monies. FALSIFIED RESERVATION any reservation obtained under false pretense will be subject to forfeiture of reservation deposit, damage deposit, and/or balance of rental payment.

Noise Ordinance. 49. The County noise ordinance will be enforced at the edge of the dock. A quiet time will be observed between the hours of 12:00 Midnight and 8:00 a.m. daily. The volume of all conversations, televisions, radios, or other sources of noise must be kept at a reasonable level during these hours. Any complaints of excessive noise will be addressed by the Marina personnel and may result in termination of the offending party’s Slip Rental Agreement. THESE RULES, REGULATIONS AND POLICIES FORM A PART OF YOUR 2017 SLIP RENTAL AGREEMENT AND ARE PROVIDED FOR IN YOUR RENTAL AGREEMENT CONTRACT. THEY ARE NOT INTENDED TO REPLACE ANY CONDITIONS FOUND WITHIN THE 2017 SLIP RENTAL AGREEMENT CONTRACT. In the event any owner or contractor, subcontractor or agent fails to comply with SOUTH BAY Marina Vessel and Mooring Rules, or any family member, relative, agent, friend, invitee, representative, guest or anyone else that an owner agent or any of the other people listed herein may invite onto SOUTH BAY Marina’s property breaches these Rules and Regulations; SOUTH BAY Marina shall have the right to terminate any and all agreements that it then has with the owner / agent. SOUTH BAY Marine Center, Inc. dba South Bay Marina shall be entitled to retain all monies paid to it by the owner / agent to cover the rental to the date of termination; the lost rental, if SOUTH BAY Marina is unable to rent the space; and, even if the space is re-rented, liquidated damages caused by the breach of these Rules and Regulations and the Agreement referred to herein.
