OBLIGATIONS OF THE LEAD BENEFICIARY. The Lead Beneficiary shall be responsible to the MA for the implementation of the Project. The Beneficiaries shall be responsible to the Lead Beneficiary for their part of the activities and costs. The Lead Beneficiary is authorised by the Beneficiaries to represent them in all dealings with the MA in the context of the implementation of the Project and shall manage the EU funding in accordance with the details of this Partnership Agreement, the Grant Contract and applicable legal framework. In particular, the Lead Beneficiary shall fulfil the following obligations: to ensure timely commencement and implementation of the entire Project within the time schedule and in compliance with all obligations to the MA; to ensure smooth operational transfer of the EU funding (grant) for all the Beneficiaries and timely financial transactions to all the Beneficiaries as defined in the Project; with assistance and approval of the Beneficiaries, prepare and submit progress reports and final report, follow-up budget documentation, handle requests for payments and requests for amendments; to distribute copies of the Grant Contract and other documents related to the project to all Beneficiaries; to start and implement the Project in accordance with the Grant Contract and the Programme Manual. The Lead Beneficiary shall notify the MA of any factors that may affect implementation of the Project; to manage and monitor appropriate spending of the EU funding (grant) awarded; to carry out the overall accounting of the Project in compliance with the Grant Contract, paying a special attention to the correctness of the public procurement procedures taken for the needs of implementation of the Project and respecting rules on eligibility of costs and requirements of publicity and visibility; to consult other Beneficiaries regularly and keep them fully informed of the progress of the Project; to communicate with the bodies implementing the Programme and notify other Beneficiaries of any substantial communication with the bodies implementing the Programme; to react promptly to any request of the bodies implementing the Programme and Beneficiaries.

OBLIGATIONS OF THE LEAD BENEFICIARY. 1.4 The obligations of the Lead Beneficiary shall include: receiving the financial contribution from the Managing Authority for the implementation of the Project; ensuring that other project beneficiaries receive the total amounts of the grant as quickly as possible and in full further to the arrangements referred to in partnership agreement. No amount shall be deducted or withheld and no specific charge with equivalent effect shall be levied that would reduce these amounts for the beneficiaries; assuming responsibility for ensuring implementation of the entire Project and coordination with all beneficiaries in the implementation of the Project in accordance with this Contract and the legal basis of the Programme; The Lead Beneficiary shall provide the Managing Authority with any requested information, clarification or other relevant documents; information as well as any request submitted by the Lead Beneficiary to the Managing Authority, shall be deemed as given in agreement with all beneficiaries of the Project; informing the Managing Authority of any event likely to affect the implementation of the Project; signing the partnership agreement with all beneficiaries defining rights and responsibilities of the parties that, inter alia, guarantee the sound financial management of the funds allocated to the project including the arrangements for recovery of funds unduly paid. ensuring that each beneficiary is legally and financially responsible for its part of Project activities and for the share of its budget as defined in the Annex 1; never delegating any, or part of these tasks to the beneficiaries or other entities; ensuring that provisions of this Contract are applied equally to all the beneficiaries of the Project; ensuring that the EU and national legislation concerning financial management and controls, public procurement, information and publicity and state aid rules and principles is respected and observed by the beneficiaries;
OBLIGATIONS OF THE LEAD BENEFICIARY. The Lead Beneficiary shall: regularly monitor the progress in the Project implementation and inform the Managing Authority immediately of any existing irregularities, circumstances significantly delaying or preventing the complete implementation of the Project, or of the intention to cease the Project implementation; monitor the output and result indicators achieved during the Project implementation, pursuant to the monitoring indicators defined in the Application Form; use the financial support funds only for eligible expenditures, for which the date of accounting event is no later than the deadline for the submission of the final Progress Report defined in up-to-date Programme Manual; spend the subsidy granted in a manner which ensures their optimum utilisation, pursuant to the best economic practice rule and guarantees fair competition between the potential sub-contractors. In particular, the Lead Beneficiary is obliged to apply the national provisions relating to the public procurement and the up-to-date document: Commission Interpretative Communication on the Community law applicable to contract awards not or not fully subject to the provisions of the Public Procurement Directives (2006/C 179/02); prepare and timely submit documents, information and Progress Reports referred to in § 6 item 1 and 2 and correct identified errors and submit written explanations in the period specified by the Managing Authority, on pain of withholding of the next payment for Project eligible expenditure. maintain separate accounting for the Project implementation purposes, in manner ensuring the identification of each financial operation within the Project; disclose any revenues which occur or may occur with relation to the Project implementation and during the period of five years after the Project completion as stated in § 6 item 11 and 12 and Article 55 of General Regulation. keep the documentation related to the Project implementation until 31 December 2020 but not shorter than during the period of three years after the Programme closure (according to Article 90 of the General Regulation and Article 19 of the Implementing Regulation); ensure that the public is informed about the Project being co-financed from the Fund, pursuant to requirements referred to in the Implementing Regulation and in the Communication Plan adopted for the Programme; transfer the payments from the ERDF to Project Partners in the amount deriving from the Progress Reports, mentioned in § 6 item ...
