OF DUTIES. When an Employee is first hired or when an Employee is reassigned to another position in the Bargaining Unit, the Employer shall, before the Employee is assigned to that position, provide the Employee with a current and accurate written statement of duties of the position to which he is assigned. Upon written request, an Employee shall be given a complete and current statement of duties and responsibilities his position.

Where the Employer changes the duties of a classification, it shall promptly notify the Union of the change. The fact that the job duties are set out in a job description does not mean or imply that those job duties may not be changed.

Subject to operational requirements, a request by an employee for a change in the assignment of duties shall not be denied without reasonable cause. Article does not apply to a change in the assignment of duties within a position.

The Lender Agent may execute any of its duties under this Agreement or any other Facility Document by or through agents, employees or attorneys in fact and shall be entitled to advice of counsel concerning all matters pertaining to such duties. The Lender Agent shall not be responsible for the negligence or misconduct of any agent or attorney in fact that it selects with reasonable care.
