Save and except any clause in this Collective Agreement, the Management shall have the absolute right to increase or decrease the establishments, to schedule, direct, recruit, discharge, classify, transfer, promote, demote, maintain order, discipline and efficiency and without restricting the generality of the foregoing, select, acquire, install and operate any equipment, plant and machinery as it deems necessary. The said absolute right shall not be exercised in an arbitrary or discriminatory manner, or in a manner which would deprive any employee of their employment, except for just cause.
OF MANAGEMENT RIGHTS. The Union acknowledges that it is the exclusive function of the Company to:
(a) Maintain order, discipline and efficiency; Hire, promote, demote, transfer, assign, direct, classify, retire and for just cause to suspend or otherwise discipline or discharge associates subject to the right of an associate to submit a grievance with the grievance procedure; Generally to manage the industrial enterprise in which the Company is engaged, and without restricting the generality of the foregoing, to determine the products to be manufactured, method of manufacturing, kinds and locations of machines and tools to be used, process of manufacturing, including the right to institute changes therein, the engineering and designing of its products, the control of materials and parts to be incorporated in the products produced, the extension, limitation, curtailment or cessation of operations and all other matters concerning the operation of the Company's business not specifically dealt with elsewhere in this Agreement.

The Management will inform every new employee of the existence of the Collective Agreement and direct their attention to Articles and All employees coming within the scope of this Appendix shall become members of the Union upon commencement of employment and thereafter shall remain as such members in good standing, according to the Constitution of the Canadian Union of Public Employees.

a) maintain order, and hire, discharge, classify, transfer, promote, layoff, suspend or otherwise discipline employees; establish and enforce rules and regulations, not with the provisions of

The Union acknowledges that the administration and management of all the affairs of the Company is the sole function of the Managers and Officers of the Company save only as restricted herein. While it is the sole function of the management of the Company to maintain discipline, order and efficiency, to hire, discharge, transfer, promote or demote employees, to make, enforce and alter reasonable rules and regulations, a claim of or unjust promotion, demotion or transfer, or ‘a claim of discharge or discipline without reasonable cause, may be the subject of a grievance and dealt with as hereinafter provided. Any change in rules and regulations to be observed by employees shall be negotiated by the parties.
OF MANAGEMENT RIGHTS. The Association acknowledges that it is the exclusive function of the Company to: Maintain order, discipline and efficiency. Hire, discharge, classify, direct, transfer, promote, lay off and demote, subject to the provisions of this Agreement. Suspend or otherwise discipline employees for just cause. Generally to manage the industrial enterprise in which the Company is engaged and, without restricting the generality of the foregoing, to determine the products to be manufactured, the methods of manufacturing, schedules of production, kinds and locations of equipment to be used, processes of manufacturing, the formulation of its products, to determine and establish standards of performance for all equipment and operation, and the extension, limitation, curtailment or cessation operations. The Company agrees that these functions will be exercised in a manner consistent with the provisions of this Agreement.
